Wednesday Morning Rant

No Venue

One major outcome from the aftermath of the 2020 election was the egregious behavior of the Supreme Court. Everyone here surely remembers how that litigation shook out. Some states sued other states over their handling of the election and subsequent vote-counting, and the Supreme Court used elaborate mental and legal gymnastics to to reject those cases. Handling litigation between the states is one of the Court's actual jobs, and in 2020 it simply refused to do it so as to end the litigation and make the problem go away. Whether cowardly terror or simple activism, it doesn't matter. The Court was derelict.

It's pretty straightforward how. Article III, Section II:

The judicial power shall extend to all cases, in law and equity, arising under this Constitution, the laws of the United States, and treaties made, or which shall be made, under their authority;--to all cases affecting ambassadors, other public ministers and consuls;--to all cases of admiralty and maritime jurisdiction;--to controversies to which the United States shall be a party;--to controversies between two or more states;--between a state and citizens of another state;--between citizens of different states;--between citizens of the same state claiming lands under grants of different states, and between a state, or the citizens thereof, and foreign states, citizens or subjects.

It is the Court's job to, among other things, adjudicate conflicts between states. It chose not to in 2020. As we see in 2026, that was not a one-off.

Last year, an unqualified illegal alien named Harjinder Singh executed an illegal U-Turn in a big rig on the Florida Turnpike. The illegal maneuver caused a car wreck that killed three people. Despite being an illegal alien who could not speak English and failed to recognize road signs, Singh was improperly issued a CDL by the states of California and Washington, and he fled to California after the wreck. A few days after his return to California, he was arrested by the US Marshals. California's (and other states') regular issuance of improper and illegal CDLs to unqualified and often illegal aliens is a problem with interstate ramifications.

In response to this incident, Florida filed suit against California and Washington in October of last year. Being a conflict between the states, the case went before the Supreme Court. Or, rather it should have gone before the Supreme Court. This time, like every time there is a suit between the states that may prove politically difficult, the Court flatly refused to take the case. Unlike 2020, however, there were no mental gymnastics to justify it.

A solid majority of the Court simply refused, and the majority issued no explanation. There was no rationale or justification, and the majority opinion was unsigned. Per the Washington Examiner:

Florida filed a motion for the Supreme Court to hear the lawsuit directly because it was a lawsuit between two or more states, a rare instance of the high court’s original jurisdiction, but the unsigned majority did not offer an explanation for why it denied hearing the case.

The actual opinion shows that clearly:

The motion for leave to file a bill of complaint is denied. JUSTICE THOMAS, with whom JUSTICE ALITO joins, dissenting from the denial of motion for leave to file complaint

This dissent follows, signed by the two justices who usually try to do the right thing. No majority opinion and therefore no author. Just "nah, we're not gonna do it." This is, as the Examiner pointed out, in the Court's actual, real, legitimate, Constitutional jurisdiction. And the Court refused, as has become its habit. Thomas made his opinion on this plain-language point quite clear:

This Court has exclusive original jurisdiction over Florida’s suit because it involves one State suing other States.
Article III establishes that "[i]n all Cases . . . in which a State shall be [a] Party, the supreme Court shall have original Jurisdiction." §2, cl. 2. Congress has made our original jurisdiction "exclusive" in "all controversies between two or more States," meaning that no other court can hear this case. 28 U. S. C. §1251(a).
I doubt this Court has discretion to refuse to hear cases within its exclusive original jurisdiction. ... "If this Court does not exercise jurisdiction over a controversy between two States, then the complaining State has no judicial forum in which to seek relief." Nebraska v. Colorado, 577 U. S. 1211, 1212 (2016) (THOMAS, J., dissenting from denial of motion for leave to file complaint). The only statute addressing this Court’s jurisdiction over these kinds of cases nowhere contemplates a process of discretionary review. See §1251(a) Nonetheless, this Court has adopted a discretionary approach to its exclusive original jurisdiction ...

This is not the first time Thomas has made this precise point, which is why quotes himself in his dissent. There is no venue for litigation between the states if the Court refuses to hear such cases, and the Court routinely refuses to hear such cases. I am sure the Court has much better things to do than hear "nuisance claims" (as this case was called by the defendants) - things like legislating from the bench.

The non-communists have seen some victories in the Court over the past few years, but this case continues to underscore an ongoing problem. The Court is populated with political justices who never fail to find jurisdiction when it's a case they want to take, and never fail to reject their responsibilities when it's a case they don't - even if that leaves states with no venue whatsoever to sort out their grievances with each other.

The solution in Florida, absent SCOTUS intervention, is to check drivers with state/local resources, use the relationships with DHS in agreements like 287(g) to verify immigration status, and then hold them until deportation proceedings can happen.

Make the state so inhospitable to foreign, especially illegal, drivers that they simply refuse to take freight to the state.

In addition, though, with the recent SCOTUS ruling about how freight companies are liable for safety concerns from subcontracted drivers, well, it already seems like the foreign, illiterate drivers are getting squeezed out.

Nothing moves industries faster than financial incentives.

The commerce clause isn't a suicide pact. Could California just redefine a CDL as a license to go around in other states in clown suits and rape the populace? They are not far from that. Fuck it. Violate the Commerce Clause. When Cali or Washington sues over the matter, point out that, as a controversies between two or more states, SCOTUS has exclusive original jurisdiction. If SCOTUS, once again, refuses to hear the issue... done and dusted.

If they choose to hear the issue, Florida may rightly point out that the whole unpleasantness could have been avoided by them doing their fucking job in the first place and then point out that Cali and Washington are violating federal law by issuing CDLs to persons not fluent in English.

Time to point out, again and again, the utter lack of feck amongst most of the members of the judiciary. If they want to play black robed gods then they cannot ignore the issues for which they are the specific judge.

51 The Florida legislature could require a special supplemental fee on CDL's issued in "certain" other states, say California, Washington, and New York (to name a few), to be paid by trucking companies and/or insurers before a driver could operate on Florida roads.

They'd get sued by those other states, and lets see if that case gets taken by the court.

55 Honoring licenses isn't required by the Constitution or SCOTUS. It's a compact between the states called the Driver License Compact.

Florida could remove itself from it, enter agreements with individual states to honor their drivers licenses, and refuse to honor CA's.

So, anyone with CA tags in FL gets pulled over and fined unless they get some kind of specific license from FL allowing them to drive.

IIRC, he also shut down Florida - for a time - during covid and had people arrested on the beach.

This is the pattern, but I think the energy of anti-Trumpism is unique in a way that's going to hinder the Democrats ability to extend it full strength to the next target.

It's like how one major candidate can't retain the same coalition as the last. There will be changes (more Catholics here, fewer blacks there, etc.) in each transition.

So, what is anti-Trumpism? Well, it's hard left, AWFLs, black activists, and La Raza. GA primary voters this year were 9% white male.

One of the animating factors of anti-Trumpism has a sexual angle (grab 'em), and that goes away with Vance (or whomever).

I think that deflates the AWFL attack against whomever is next. Doesn't make it go away, but deflates it a bit.

All while Democrats have actively pushed out the white working class for pretty much 20 straight years since the rise of Obama.

The animating anti-Trump factors decrease but they get replaced with...what?

121 55 Honoring licenses isn't required by the Constitution or SCOTUS. It's a compact between the states called the Driver License Compact.

Florida could remove itself from it, enter agreements with individual states to honor their drivers licenses, and refuse to honor CA's.

So, anyone with CA tags in FL gets pulled over and fined unless they get some kind of specific license from FL allowing them to drive.

Since his two terms have been labeled as "anomalies" by the press, many of our political class and a large segment of the public... yes, his term(s) were a "one off."

The political class will see to it that any like him are excluded, the chattering class will demonize anyone like him, and the public will be told to shun anyone like him.

Vance, Rubio, DeSantis, etc. will all be overshadowed by Trump. And diminished in the press as ineffective.

Whether Trump's detractors lose all life's meaning is debatable. There's still demonizing to be done.

I'm not saying that the next won't be subject to attacks. He will be.

But I'm saying that the attacks just won't retain the same coalition as anti-Trumpism. They'll replay the Trump playbook against Vance or Rubio, and it just won't hit as well.

So, they'll have to shift and pivot into a new kind of attack to appeal to a new coalition. But, they've hollowed out the rest of their coalition overall.

Attacks against the next will feel...tired and exhausted and uninspiring.

My conspiracy theory isn’t so much of a theory, if you read the policy planning documents and articles published of the 1950s, the path to a globalist society had to do something about the role of established religion.

Unless you can guarantee conviction, impeachment just makes the target more powerful politically because they get acquitted of any charges.

That D+30 districts and R+30 districts will move in the same direction at the same rate because the national environment went from R+3 to D+6 or whatever? That the D+30 district will become D+39 and the R+30 district will become R+21?

Because that's not how it works.

How it works is that the deep blue enclaves will turn out at higher numbers and the deep red enclaves will turn out at slightly lower numbers. It will be uneven.

So, if the national environment does shift 9 points left from 2024 (doubtful, I suspect 6 or so), TX won't shift 9 points to the left. It'll shift like 2-3 points while NY shifts 15.

There is little force behind any of it. If you want to put that under stress you need to make sure you have a solid backing behind you. The left no longer has that solid backing. They hold most of the 20% of the 80/20 issue splits. They've managed to split the billionaire class such that the most innovative and powerful of that group don't buy the left's message anymore.

You cannot make dramatic moves without support. If Florida refused to recognize Cal and Wash CDL's that would work because the people would be behind that move. And there wouldn't be enough political blowback to force Florida to back off.
