Sefton: sefton at cutjibnewsletter.com | Appeals Court Rules That Trump Doesn't Have to Pay Lunatic Fantasist E. Jean Carroll for the "Defamation" of Continuing to Deny This Vicious Fruitloop's Sex Fantasy About HimNot only was the original allegation of "rape" insane and ripped off straight from an episode of Law & Order: SVU -- with this lunatic attention-whore unable to even say when the "rape" occurred more specifically than "in the nineties" -- but a subsequent New York jury also decided it was "defamation" when Trump later insisted upon his innocence. Note that this rule has never been applied to anyone except Donald Trump. Any time a man proclaims his innocence following an adverse court ruling, someone can sue that man for "defamation" for denying his or her story. And note that every instance of a false claim is a fresh defamation case -- so you can just keep suing an innocent man forever, for saying he's innocent. This is government-compelled speech of the worst kind: When a partisan jury wrongly finds you culpable, not only do you have to pay the exorbitant penalty they impose on you for partisan bullshit reasons, but you are then compelled by government action to admit the lie of your guilt, forever, anytime someone asks you about it.An Appeals Court has agreed with Trump that he should not have to pay the insane jackpot $83 million judgment until the Supreme Court rules on this preposterous new Trump-Only Law. Separate -- every time he denies this floridly insane woman's preposterous story, it's a fresh defamation claim.

After all the money he's stolen / grifted you think he'd just pay up but it's an ego thing for him more than anything else. He wants to crush her under heel and claim victory. Trump and Gorsuch are both text book examples of a "he said/she said" rape case.
Even in a civil trial, the standard of conviction is still a "preponderance of the evidence". If the only evidence is he said/she said, then the "evidence" is still 50/50, and an honest jury would not return a conviction/finding of guilt. Of course, the "vicitim" can spin a lurid tale for the jurors, while the accused can only say he wasn't there and it didn't happen. The only possible way the accused can raise an evidentiary defense is to prove they were somewhere else when the rape occurred. I have certainly noticed that in both of the cases I cited above, the "victim" will NOT state for the record when the rape occurred. Therefore, the accused can never provide any evidence of their innocence. I am pretty sure that is a deliberate design by the well-oiled Democrat smear machine. -- - even though it's technically a civil law, this may be close enough that ex post facto applies; where NY retroactively changed the statute of limitations. Including that the lobbying funding the change was specifically to get Trump. And that no one has been sued under it since. - the trial judge prevented Trump from putting on any evidence she was lying. - NYC is so biased against Trump, he was denied a fair trial - She made herself a public figure and Sullivan should apply. - the verdict is excessive. Posted by: runner ========= Throw out the jury verdict as Ace notes, the alleged predicate offense (rape) was NOT proven to be true by the jury, so a he said, she said, would risk any person claiming to be innocent (and thus the other person is lying) to be targeted for a slander and/or a libel suit. Ridiculous and ridiculous that the federal appellate courts did not stop this nonsense from NY state in the first place. This would financially penalize someone for claiming they are innocent and that the events never happened. And without proving the underlying offense--the jury never found Trump committed a rape, they claimed he slandered Carroll by denying he did it and attacking her story as false. Now, apply this liability standard to anything that you have denied in your life--work, school, etc. If you denied it, now you can be sued for slander under the NY State's insane Get Trump jurisprudence. There are also serious due process violations and other shenanigans involved in this case that appellate courts have ignored because Orangeman Bad. Posted by: whig at May 13, 2026 01:24 PM (E4rtv) 74

I'm primarily a lurker, but the crow comments remind me of my youth, so I thought I'd share my crow experience.
Growing up we had several crows as pets. Our first two, Heckle and Jeckle, lasted a couple of years, but neighbors complained about the constant noise so we freed them. They continued to hang around for about a year as we continued to put out food for them. Eventually, we would only see once or twice a month and then no more. The last pet we had was with us for 10 years. We had him in a large cage outside (big enough to stand up in) and in the winter, a huge cage in our basement. Super smart and very devious pet. He loved to terrorize our dog. He had a large vocabulary and had full sentences in his repertoire. He ate our dinner leftovers and loved hard boiled eggs. He would eat the shells to help with digestion. He would also call in wild crows to the point where they'd hang out on top of his cage during dinner time, hoping for handouts. He ended up getting killed by a mink in early spring after moving from the basement to outside. His name was Clarence and a special childhood memory Posted by: DitkaCA at May 13, 2026 01:28 PM (utChY) 96

Posted by: Elric The Blade And that is probably what will cause the verdict to be thrown out. It rankles me that a key part of the defamation suit against Trump was his claim he'd never met Carroll. The prosecution then produced a picture of Trump with Carroll.
Trump is a celebrity and has been for many years. He probably meets more people in a week than most of us meet in years. He's not going to remember most of them, especially decades later. Sure, he'll remember someone who was a big name at the time, but not a nobody like Carroll. Posted by: bonhomme at May 13, 2026 01:40 PM (mkw2N) 165

Adobe suite has very recently made TERRIBLE changes I literally just use AI to do simple things now bc it's easier to use Chat for image composition than Photoshop with the changes. Posted by: BlackOrchid (j+aD2) at May 13, 2026 01:24 PM (j+aD2) Most suite software is like that- people rearranging deck chairs because they have nothing to really add to the system. But don't think the Red/Green alliance isn't using the issue as a propaganda weapon against the US and the West.

Posted by: Oldcat at May 13, 2026 01:42 PM (8avO+) I know you’re being facetious, but “adjudicated” is a legal term of art used to signify that a matter has reached a final legal conclusion, with all appeals exhausted. I honestly don't understand the complaint. The new data center site is a seasonal livestock grazing area. It's cooling system is a closed loop, so it doesn't take a continuous water feed. The site will produce its own power, so there's no grid drain. It's supposed to generate $30 million in new revenues annually for the locals immediately, and that could go up. What's the problem? Execution by the Japanese was actually not the worst fate for downed pilots. Don't even want to type what some were subjected to (before death). Forget the survival rate of Allied POWs in Japanese captivity, but it was the worst in WWII, pretty much matching that of Soviet POWs in German hands.
Meanwhile a significant number of German POWs immigrated to the US and Canada after the war, many of them marrying locals. Remember kids, *all* cultures are exactly equal and the same. Posted by: rhomboid at May 13, 2026 02:12 PM (U/Byj) 338

Governor McMaster is calling a special session to redistrict in South Carolina.
I think the legislation to redistrict in a special session called by the governor would only need bare majorities to pass (the thing voted on yesterday was about adding it to the existing session which required super majorities). Posted by: TheJamesMadison He had to. SC has no state budget approved. The House caucus refused to do it to force a special session. Once a special session starts, the Governor cannot limit the topics on the session. Found that out yesterday from reading the laws of SC. So the stupid senators outed themselves as anti trump for nothing. The vote was 29-17 in favor of redistricting in the Senate but required the full supermajority to do it. McMasters decided to make lemonade out of lemons where he had no real choice anyway. Probably to get a chit on future POTUS actions. Posted by: whig at May 13, 2026 02:16 PM (E4rtv) 354

Washington Nearsider is a great resource for WWII records etc. I haven't yet done much on my project, but imagine I'll be consulting him again when I do. BTW, for those who visted the Smithsonian Air & Space museum (original one, on the Mall) over the last 30+ years, the forward B-26 fuselage section displayed in the WWII room, from "Flak Bait", was his plane. Three pilots flew her, as I recall. He was the first and did all 50 missions in that plane. Kind of interesting. Not sure if it's still on display, haven't been to that museum in decades. No such problem with Navy/Marines but Army and Air Force were affected severely on records. Some units kept more detailed records than others, of course, but in many, many cases, there are treasure troves of data out there for the nosy and curious. You could consider an external drive with those programs and a partition on another system with windows on it for when you have to use those programs. Less space. Or a bootable external drive.
Posted by: Oldcat ========= I was going to build a container system rather than dual booting which I currently do. But that plan went under with the current elevated costs for building a specced out computer. Been building them since the 90's about every 3-5 years or so. I rarely use the Windows partition but keep it for my wife who uses Windows and Microsoft Office at work. I use it for taxes only. But using a linux docker (or other) container system would allow me to decommission some really old computers that I keep simply for Stata, SPSS, some qualititative stat software, graphing software, and Mathcad for projects. Current expenses for them are way too high as I no longer qualify for faculty/student discounts. Was learning R for projects but as I retired, no real reason to relearn the wheel if I want to do a quick and dirty stat analysis of some data. Posted by: whig at May 13, 2026 02:24 PM (E4rtv) 372

Rare in politix any more. Something to savor a bit. Posted by: rhomboid I think politicians in general have gotten dumber over time. That is part of the problem with rotten boroughs, fake elections, and safe seats, they no longer look to please constituents; only their donors and themselves. As bad for those in GOP districts as it is for inner city minorities. Our leaders simply do not care by and large for their constituents. Cloud people in other words versus dirt people. Most of us are dirt people. Posted by: whig at May 13, 2026 02:27 PM (E4rtv) 374
LinkedIn has gotten much, much worse since Hoffman sold it. It turns out malevolent liberal billionaires still make a better product than one million H1Bs with a typewriter. Posted by: Ian S. at May 13, 2026 01:22 PM (2ocoG) Try finding out what the subscription amount is for a paid membership. Basically, it's the Pelosi Standard where "you have to subscribe to find out how much it costs". Plus, if your account gets locked because you tried to access it with a new phone, you have to send them a fucking photo of your ID. And when you try to do the verification, it goes into an endless loop and still never lets you in. Just went through this earlier this week I rather suspect that there's no way to delete your account either. Posted by: IllTemperedCur at May 13, 2026 02:29 PM (y9nCu) 375

Posted by: Axeman I am not interested in arguing anymore with people that argue dishonestly. I did it professionally for years, don't have to do it anymore now I am retired. They can go straight to hell as far as I am concerned if they reject the message of salvation. They get that one chance from me, if they desire no Logos and peace in their life, it is on them, not me. Shake the dust off and move on. Posted by: whig at May 13, 2026 02:30 PM (E4rtv) 376

Posted by: IllTemperedCur My guess is legally they have to let you delete your account but like Fakebook, they simply put it in deep storage to be reactivated if you stumble or run across their tracking icons buried on websites. Stinked In along with other social media is all about tracking you so data can be sold about you to everyone. I have a paid service that does nothing other than kill data on me via databroker acquisitions. And the number of databrokers is proliferating so much that every couple of days, there are new whack a mole databrokers that need to be thwacked with removal requests. Upside, I rarely get any spam calls nowadays. Getting ready to go medieval on spam email by moving mission critical emails to another service and nuking the one I have used for decades now. Considered several years ramping up an old computer to run my own mail server but really don't want the security hassle of doing it. Aliases make that less appealing now as well. Simply use throwaway email aliases on all the stupid forms required to create accounts and channel all those sold emails to the trash heap. Hoffman remains on the Microsoft BOD since he sold LinkedIn to them. As such, he still touches the product.
So I can still hate it for his taint. Posted by: Black JEM at May 13, 2026 02:54 PM (GZYu7) 381
My dad does this. Hates his first name. Goes by his middle name, but he still acknowledges that he has a first name with the first initial.
My dad went by his middle name because his first name was Dwayne. His middle name was Arlo, so you can decide if it was an improvement. Posted by: Rob Crawford at May 13, 2026 02:54 PM (psX8/) Processing 0.06, elapsed 0.0707 seconds. |
