South Carolina's Legislature Will Delete C***s***er Jim Clyburn's Seat Tomorrow; Alabama Now Free to Eliminate One of Its Two Democrat Districts

Alabama has two majority-minority districts due to unconstitutional racist and Democrat Protection Racket mandates.

The Supreme Court just vacated a lower court ruling mandating the racially rigged districts, and Alabama will swiftly move to eliminate one of them.

The U.S. Supreme Court cleared the way for Alabama to implement a new race-neutral congressional map ahead of the 2026 midterms on Monday.


In a 6-3 order, the high court vacated a series of lower court rulings that effectively resulted in the state's use of a congressional map that includes two majority-minority districts. As The Federalist reported, such affirmative action districts were historically carved out under past interpretations of Section 2 of the Voting Rights Act to Democrats' benefit.

Responding to Monday's decision, Allen said in a statement that Alabama's May 19 primary election "will proceed as scheduled," and that his office "will remain in close contact with the Governor's Office and the Attorney General's Office as this situation continues developing."

Writing for the dissent, Sotomayor argued that "[t]here is no reason" for the Supreme Court to vacate the district court's order and remand the matter "for reconsideration in light of the Court's new interpretation of §2 of the Voting Rights Act" in Callais. She contended that the lower court's "finding of intentional discrimination" in the battle over Alabama's 2023 proposed map "is independent of, and unaffected by, any of the legal issues discussed in Callais."

With that lawless lower court ruling vacated, the maps Alabama actually drew in 2023 should now back in effect.

The U.S. Supreme Court on Monday set the stage for Alabama to eliminate one of two largely Black congressional districts before this year's midterm elections, creating an opening for Republicans to gain an additional U.S. House seat in a partisan battle for control of the closely divided chamber.

Alabama officials had pointed to the Louisiana case as reason for the Supreme Court to end a judicial order to use a court-imposed House map until after the 2030 census. The high court on Monday overturned that order and directed a lower court to reconsider the case in light of the Louisiana decision. That could free the state to instead use a map approved in 2023 by the Republican-led legislature that includes only one district where Black residents comprise a majority.

Anticipating a court reversal, Alabama officials recently enacted a law allowing it to void the results of a May 19 primary for some congressional districts and instead hold a new primary under the revised district boundaries. Alabama had asked for an expedited decision ahead of the primary.

I don't know how long the lower court will take to issue a ruling, though. The Supreme Court vacated and remanded -- the latter word meaning "sent back to the lower court for reconsideration of its decision, now informed by the Supreme Court's new ruling and instruction." I guess the lower court could once again attempt to impose the old map, making new claims.

Shipwreckedcrew, a former federal prosecutor, thinks it's unlikely the lower court can attempt to re-impose the court-mandated map without the unconstitutional command to gerrymander as many majority-minority districts as possible:

Alabama didn't make the same argument that the petitioners did in Louisiana. It did not argue that the race-consicous remedy was a 14th Amendment violation that was only available in very narrow circumstances.

The plaintiffs in the Alabama case can challenge the old map again, but they aren't entitled to "majority-minority" districts ordered by a court as the remedy. Alabama may be forced to draw new maps that explicitly rely on partisanship and not race, but the end result is going to be the same.

But this could take time. I don't know which maps will be in effect if the lower Hawaiian judge drags this out.

Meanwhile, South Carolina will eliminate race hustler Jim Clyburn's seat tomorrow.

By the way: Every district will still be strongly pro-GOP. This isn't a case of reducing the GOP's margins to dangerously thin levels to eke out an extra GOP congressman. With virtually any map except an unconstitutionally racially-gerrymandered one, every district in SC will be stronkly pro-GOP.

Clyburn's district, and a Democrat-leaning district in SC, only existed due to racism and the Democrats' rigging of the rules to keep themselves in power.

And soon that blemish will be excised.

14 Just to be clear, democrats have already gerrymandered every state that they are able to outside of Virginia. The reason they are trying in Virginia is a narrow election win.

In the south, democrats used the VRA to create artificial, racist districts to achieve a congressional majority, and now that the court has ruled those unconstitutional, those must go.

Based on non-gerrymandered districts, the democrats cannot win.

Having more competitive districts will moderate the radical Dems, and it will also expose those voters to more reasonable candidates and make them consider reality for a change.

I have spoken to blacks in safe districts, and they consider Rs to be completely unacceptable. They have no exposure to ideas like school choice except though the lens of the Dem propaganda machine (which is often driven by teachers unions, for example.)

In the hasty desire for a quickly restored Union, the nation (after soundly defeating the Confederate insurgency) gave in to the innate tendency of human desire to take the easy route. Instead of crushing the traitors into oblivion, and never allowing them to rise again, we opted for appeasement.

I feel this also applies present day, as we are quickly approaching the end of the era known as Trumpism in America. Over the last decade, much like the Civil War, this country was torn apart. The political cult known as MAGA quite literally attempted to overthrow the U.S. government — much like the Confederacy. The actions of MAGA politicians over the last 10 years amounts to a treason that should never be forgiven.

When this long dark era of Trumpism comes to an end (and it will), I fear that once again we will, as a nation, exchange the gavels of justice with our all-too-familiar desire to return to normalcy. If normalcy is what allowed the Confederate blood of this country to rise again in the 21st century in the form of Trumpism, then normalcy is not something that we should be seeking in which to return.

Croson (1989) required strict scrutiny on using race during the Rehnquist court but the weaker sisters of O'Connor and Kennedy kept those precedents from being widely used by undercutting them with decisions like Grutter and Gratz in education.

Yep. O'Keefe has come out with some new video hits this week showing voters being paid for their votes. 5-8 bucks per vote. Warnock did that in GA for his race by airdropping gift cards into the electorate to avoid triggering the financial surveillance of cash.

Basically, you spray out mail in ballots in poor areas and then send your ballot harvesters out to collect those ballots paying the voter. The ballot harvesters then fill them out and submit them along with the vacant lot and warehouse ballots that are collected on the route.

But all polls are right, even if the results are outside of each others' margins of error, and the only thing to do is assume that the real result is halfway between them.

That's science.

But, like the Voting Rights Act misinterpretation, the clear solution is to go constitutional. 14th Amendment clearly is colorblind in application and was never intended to give the power to Congress to do what the Brits call positive discrimination powers.

Does not meet strict scrutiny of being narrowly tailored remedy for past discrimination. The focus of the CRA was individual fairness in consideration for jobs, etc. not 'groups' and the same goes for the 13th to 15th Amendments. Equal protection of the laws was drafted so that no classification should be used by the state to purposefully affect individuals right to be treated fairly under the law--e.g. like every one else that is similarly situated.

I doubt it. Minorities are not enamored of their elites which they have noticed have done little to help them over time but done quite well for themselves in the process. There is a reason these are rotten boroughs in urbanized and racialized cheat districts. The elected officials do nothing to help the people but yet do quite well for themselves. See Tiffany Henyard, Stacey Abrams, or Fani Willis as an example.

Hard to get upset when these sorts lose their jobs when they never actually did them in the first place.
