Until very recently, a degree from an ABA-accredited law school was necessary in all 50 states to be able to take the bar exam. Concurrently, the ABA had become radically left-wing, imposing its agenda on law schools. For instance, to maintain accreditation, the ABA had imposed a requirement that law schools demonstrate a commitment to diversity and inclusion, with statistical proof that its faculty and student bodies were diverse with respect to gender, race, and ethnicity. As I documented at The American Spectator, Texas and Florida recently ended the ABA’s monolithic power, at least in those two states, and that the action of the two big red states should be a spark for other red states to follow suit. Specifically, ”The liberation of Texas and Florida law schools from mandatory, ABA-enforced woke orthodoxy is a major milestone. Other conservative states should quickly follow suit, helping accelerate the nullification of the ABA’s authority into a broad preference cascade.” That preference cascade appears to be under way. The bright red state of Tennessee may be the next to defenestrate the ABA. The Tennessee Supreme Court recently reached out to the Federal Trade Commission, seeking advice regarding the state’s reliance on the monopoly accrediting agency. Joined by the U.S. Attorney for the Middle District of Tennessee, the FTC has just assertively advocated for revoking the ABA’s monopoly in the state. “FTC Urges Tennessee Supreme Court to Oppose the ABA’s Law School Accreditation Monopoly” [FTC Press Release – 5/01/2026]Federal Trade Commission staff urged the Tennessee Supreme Court yesterday to open law school accreditation to competition by reducing its reliance on the American Bar Association (ABA) in determining which law schools provide sufficient education for their graduates to take the Tennessee bar examination. The letter was joined by the U.S. Attorney for the Middle District of Tennessee and officials at the Department of Justice, Antitrust Division. Responding to the court’s invitation to comment on whether it should “modify, reduce, or eliminate” its reliance on the ABA, the letter recommended reforms to the current process.Here is a link to the full FTC letter, which is also signed by Braden Boucek, the U.S. Attorney for the Middle District of Tennessee. While I’m not sure there should even be accrediting agencies – bar exam results should be the proof of whether a law school is doing its job well – I can state with authority that the imprimatur of the ABA should be considered a demerit for a law school. A group who measures and supposedly rules on whether a company or group meets a standard (whatever that is.) People use that to determine 'Well, what do I believe' because it frees them from having to do their own research. See, someone else did the research (in a non biased manner.) I can 'trust' them. It is one thing the leftists learned particularly well: in a high trust society, if you can capture the reliable institutions mentioned above and turn them to your own ends, then people will continue to believe in them (at least for a while) even if they are obviously captured. While we're at it, let's do away with the law school requirement altogether.
One year of torts, contracts, property, criminal law, legal writing and research, and trial advocacy teams (coached by actual practitioners), followed by a few weeks of intensive study with a bar review course is all you need. Of course, you shouldn't bother with any of the foregoing unless you can make 150+ on the LSAT. Don't use the LSAT as a barrier to entry, just a red flag that some people are wasting their time. The statement that ABA accreditation is a prerequisite to take a bar exam is not fully correct. In Tennessee, one can take the bar exam after graduation from the Nashville School of Law (formerly the YMCA Law School) and it is not ABA accredited. Some other states don't even require a law degree; you can "read for the law" under the supervision of licensed attorney and then sit for the bar exam. I know Virginia at least used to allow reading for the law. I recall that was the path Kim Kardashian took to sit for the CA bar exam.

I know there are different layers of accreditation for higher education. For instance the HLC accredits the university I work for as a whole, but different groups accredit the individual programs (e.g., ABET accredits our engineering programs). Bar exam results don't necessarily reflect well on a law school. Students highly likely to pass the bar, regardless of who teaches them the law and how, will self-select into certain law schools.

Many states use a Multistate Bar Exam (multiple choice in my day) produced by the National Conference of Bar Examiners. I don't see any direct affiliation between them and the ABA, although there is probably significant overlap.

In NYS, the bar exam is administered by the state (Board of Bar Examiners, if I recall correctly, it has been a long time since i worried about the bar) and attorney admission and discipline is controlled by the state court system. There is no requirement to be a member of any bar organization (ABA, NYSBA, NYCBA, and others) to be admitted and to practice in NY. I do not belong to any bar association. The state bar association and city bar association have some say in the election and appointment of judges, but the reality is, at least where I practice, you have to be a democrat, because NYS is a one party state. Our local county bar association decided to make recommendations on judges . We took a vote at a restaurant meeting and argued about it . Myself and a few others argued that rating qualifed or unqualified would seem like a popularity contest or sucking up. We were defeated. Back in the dark ages, no one could sell any device which plugged in to 110V (the electrical grid) without that device being approved by Underwriters Laboratories (UL), a private organization, like the ABA, which gave it, again, like the ABA, life and death power. The complaints were not political, instead they were economic; their charges for approval reflected that monopoly status. The government (I believe it's the FTC) has established standards for NRTLs (Nationally Recognized Testing Laboratories) and now there are multiple organizations whose approval is sufficient to allow sale of electrical devices. Following that, the government needs to establish standards for accrediting organizations which would apply to both schools and post-education as well. I struggled in a 3rd rate law school, but when I sat for the MD bar (way back when), I looked around at all these pointy headed people and concluded I would definitely do better than at least half of them. Passed, but I agree that about 95% of my answers were definitely least worst option.

Not true for all 50 states. For decades California, for example, has allowed graduates of state accredited law schools that were NOT ABA accredited to sit for the California Bar, and to practice law if they passed the Bar; not a sure thing as the last Bar passing rate for California-only accredited schools was about 14%. Some lawyers who get admitted to the California Bar through this process can, or could in the past, get admitted to practice in other jurisdictions by taking other states' bar exams or through admission on foreign license. I've known a lawyer or two in the past who have done that. California also had a program allowing students to "read law" with a California lawyer and if the student met the program requirements he or she could take the state bar without any law school whatsoever. At different times other states have also had such programs; before WW 11 (eleven) my uncle took the Indiana Bar exam and practiced law without being a law school grad-he finished law school later, while he was practicing law. Also not true. The ABA does not administer bar exams in all states and never did; I doubt they do so directly anywhere. The ABA has some influence on the law of a state (and thereby influences questions asked on the bar exam) through providing model rules of procedure which mostly have been adopted by the statest. I sat on my state's Ethics 2000 committee to evaluate the ABA's model Rules of Professional Responsibility. Our adoption recommendation included some modifications to the ABA's proposed rules. The National Conference of Bar Examiners does prepare and administer the Multi-State Professional Responsibility Exam which is part of the Bar Exam for most or all US jurisdictions. The NCBE provides resources and assistance for bar exams to states and other bar jurisdictions. The NCBE is independent of The ABA, but they have a cooperative and interdependent relationship. Lawyer discipline is handled differently in the various states, districts and territories in the US. More than half of all states are what is known as "unified bar states." Those states require lawyers to be members of the state bar association (most or all state bar associations are part of The ABA) and lawyer discipline is done by the state bar association (DC has a unified bar). In other states lawyer discipline is handled by a government agency, generally as a part of the state court system administered by the state's highest court. Although the ABA drafted the model Rules of Professional Responsibility used, as modified by each state, for lawyer discipline in most or all states, I don't believe the ABA has an actual role in lawyer discipline anywhere-it might provide assistance or witnesses in high profile cases thought I never saw it. lawyer discipline cont below... Lawyer discipline for misconduct in Federal Court is handled by the individual districts or circuits-admission to federal court is done by the individual district and circuit courts. I never studied the subject, so I don't know if different district or circuit courts have different rules. What I know about the topic is through experience. I was once loaned out by my state's disciplinary agency to assist a federal court in investigating a case of lawyer misconduct in federal court. The District Court's rules allowed for such a joint investigation as the district court simply didn't have the resources or expertise to easily investigate the case on its own; the case also involved a state law violation so I would have investigated the case for my agency anyway.
