Sefton: sefton at cutjibnewsletter.com | Quick HitsThe DOJ says it will enforce the Supreme Court's ruling against racist gerrymanders- - which means they'll sue the states to comply. Missouri GOP Sen. Eric Schmitt asked the Justice Department earlier Thursday to enforce the Supreme Court ruling nationwide, noting it had the power to do so. "Senator -- we are ON IT!" Dhillon replied on X. "The [Justice Department] under [Acting Attorney General Todd Blanche] continues to prioritize equal protection of the laws for ALL Americans, be it in employment, housing, education -- and voting."This may make it easier for weak-sister red states like Indiana to redistrict. Indiana's currently resisting doing so, but if the DOJ says it has to.... Surprise! Biden's IRS sued conservative-leaning churches for bringing up political topics during sermons, but let all of their liberal black pastors preach the Democrat Gospel as much as they liked. A new report released Thursday by the Task Force to Eradicate Anti-Christian Bias reveals what investigators describe as a "stark contrast" and a systemic double standard in how the Biden Internal Revenue Service policed American churches. "The Biden IRS ... [opened] multiple investigations into Christian churches focused on the content of their sermons. The IRS asked these churches for detailed information about their operations, not just about the alleged violations," the task force wrote. "But during the same time, when other houses of worship gave sermons that reflected different scriptural interpretations on culture war issues, or prayed for Democrat candidates, the Biden IRS appeared to take no action," the group added. The task force, which was established by President Donald Trump in an executive order last year, reviewed internal administration discussions, case files and prosecutorial decisions from the Biden administration across 17 federal agencies. Beyond the IRS's apparent targeting of conservative Christian churches, the task force concluded that the Biden administration's prosecution strategy, internal policies and practices demonstrated an overall anti-Christian bias that permeated throughout the federal government during that period. ... The task force determined that the Biden administration used the Johnson Amendment -- a 1954 provision added to the tax code which prohibits 501(c)3 nonprofit organizations from endorsing or opposing political candidates -- to probe churches that hold traditional Christian teachings, arguing those positions amounted to political support for Republican candidates. Though the amendment, in theory, limits what pastors whose churches have 501(c)3 nonprofit status can say in evaluating candidates running for political office, it has only been "sporadically enforced," according to the Justice Department. For example, under the Obama administration, when 30 pastors instructed their congregations in 2008 on how to vote according to their interpretation of scripture, the IRS appears to have only opened an investigation into one pastor. Even then, the IRS dropped the investigation and took no enforcement action. But, the Biden administration was different. The Justice Department task force documented several investigations opened by the administration into Christian churches for possible violations of the Johnson Amendment. Pressure grows to prosecute Fauci now that his co-conspirator in the Wuhan Cover-Up has been charged. The indictment of Dr. Anthony Fauci's former adviser David Morens Tuesday revived calls for the Justice Department to prosecute Fauci himself for allegedly lying to Congress about funding risky research in China before the COVID-19 pandemic. Just two weeks remain before the five-year legal deadline on May 11 to indict Fauci for denying under oath that he funded "gain of function" experiments that modified bat coronaviruses in the same city where the pandemic started. Morens, 78, was charged with one count of conspiracy, two counts of destruction, alteration, or falsification of records in federal investigations and two counts of concealment, removal, or mutilation of records relating to the origins of COVID-19. He faces up to 51 years in prison. Critics say Fauci, 85, bears the most responsibility and that he should be hauled into court. Trump told The Post in a phone interview on March 31 that he intended to "look into" Fauci's status and Republicans say they believe acting attorney general Todd Blanche, who is seeking the role permanently, might be willing to test Trump's assertion that former President Joe Biden's preemptive autopen pardons, including for Fauci, are invalid. "99% of this country has no idea who Morens is," said Oversight Project President Mike Howell. "It's Fauci that they will blame for one of the worst government catastrophes in history in America. And so the test is Fauci. The Morens indictment is great, and we applaud it. But there are a lot of people out there that want to see Fauci held to account for the damage he wrought." Howell, whose group sent the Justice Department a draft indictment for Morens last year, believes the adviser's actions were closely linked to his boss. "[Fauci] lied about one of the most damaging events in American history routinely and was behind a massive coverup of the key factors," Howell said. ... "On Anthony Fauci's case, we think lying to Congress is one felony," Paul said in an interview on Tuesday. "We also think that destroying federal records and advising others to destroy federal records is also a felony. So I think there's opportunity there... There was a vast both organized and unorganized conspiracy to cover up the fact that the US government was funding the research that led to the pandemic." Trump said in December that Biden was so mentally diminished that he was either unable to authorize autopen pardons or that his staff did so without his knowledge -- setting the stage for potential legal test-cases. Biden claimed to the New York Times last year that he was aware of them. To determine the validity of those pardons, "you would have to indict somebody who's been pardoned. And I think it's worth a challenge," Paul said. ... Paul said it's also possible that Fauci committed crimes after Biden's pardon and that "it might involve the question of conspiracy charges."The Supreme Court is deciding a very difficult question: is the temporary protective status granted Haitians actually temporary or is it actually, secretly permanent? Is it all just a con on the rubes so they'll be tricked into accepting mass permanent immigration by fiat? The Party of Plunder: Wall Street Apes Did the SPLC stage a hate crime in Wisconsin? The circumstantial evidence is suggestive. Two groups, Moms for Liberty and Gays Against Groomers, protested "Blessings of Liberty," aka drag queen story hours. The SPLC rushed to smear them, adding them to its "hate map." Viral video shows the true face of "progressivism:" At one point, the drugged-out humans begin to sway and move a bit, as Smith tells one of them to pull their pants up. Drug use can be seen throughout the clip, with one person holding a glass pipe, stating that they were using fentanyl and crystal to get high. Smith also spoke to one of the people who said they were from Sacramento and came to SF because "the dope is cheaper" and better there. People on social media reacted to the clip and said it looked like "the start of the apocalypse."The videographer says the video is from "November or December." SF Police are lying, as usual, claiming it's from years ago, because the government won't admit what they've done.

Hell, there's a chance that the VA map "passed" last month was actually out of alignment with Gingles since it diluted a black district. Posted by: TheJamesMadison ====== From Callais majority opinion, page 3, "In short, §2 imposes liability only when the evidence supports a strong inference that the State intentionally drew its districts to afford minority voters less opportunity because of their race. Not only does this interpretation follow from the plain text of §2, but it is consistent with the limited authority that the Fifteenth Amendment confers. Pp. 22–26. (b) This interpretation does not require abandonment of the framework for evaluating §2 claims that the Court established in Thornburg v. Gingles, 478 U. S. 30. The Court need only update the framework so it aligns with the statutory text and reflects important developments since the Court decided Gingles 40 years ago." Roberts has single handily destroyed most of the judiciaries credibility. He has let a generation of leftists who use the law and process as their shield, to ultimately subvert and undermine the process.
I know he probably believes he’s actually showing the beneficence of the judiciary, but he’s really exposing its flawed, authoritarian underbelly and the weakness of nostalgic retards like himself. These cases should have been dismissed and laughed at. Posted by: The Crow where the hell are my peanuts. at May 01, 2026 03:38 PM (SqxZS) 72
It's one of the reasons why 20th-century progressives have viewed "conservatism" as inherently "anti-intellectual".
Really depends on how much the courts want this enforced. The blue states will likely just claim the current districts are the partisan makeup they want or something else not raced based BUT there will be plenty of paper trail saying they are race based. If the courts really want to screw with them they could make a reverse VRA test where the blue states, which have a history of racial discrimination now have to prove their districts aren't racially gerrymandered and could even end up with right wing judges setting the districts which would be just...Chef's Kiss... The blue states will likely just claim the current districts are the partisan makeup they want or something else not raced based BUT there will be plenty of paper trail saying they are race based.
I imagine that you could use demographics to show that the districts had significantly concentrated a single race into the district, thereby negatively affecting all other races in the district, to at least suggest that while partisan makeup may have been a factor, even the key factor, in the design, that race was the mechanism used to achieve it. 38 Blue states will sue the doj to prevent enforcement of this ruling and they will make zero changes, file endless appeals and they will wait it out until the next democrat gets elected as president. Once that happens everything will go back to normal racist gerrymander stuff no matter what SCOTUS ruled.
Posted by: Mister Scott ======= It doesn't really matter anymore what blue states try to do or Marc Elias. It is done and in fact, blue states themselves are now liable for citizen lawsuits over districts, particularly state legislative and city district lines. Race is not permissible as a standard anymore for districting and those state AGs are going to face a raft of lawsuits themselves as Democrats often documented out loud in hearings, etc. that they were using race just that way. That is how we ended up with urban rotten boroughs like AOC's. And Mr. Scott, as I put above, Thornburg v. Gingles was NOT overruled and thus "Stated succinctly, a bloc voting majority must usually be able to defeat candidates supported by a politically cohesive, geographically insular minority group. " Thornburg v. Gingles. And that applies to black block voting as well as white btw. Posted by: whig at May 01, 2026 03:44 PM (E4rtv) 95

Blue states will replace race with partisan makeup and change almost nothing. Posted by: TheJamesMadison =============== They align so well, this should be doable. Posted by: Blonde Morticia ====== TJM, as a legal matter, not as simple as you think. I went back and reread the key parts of both Callais and Gingles and it is not as easy as you think. Basically, drawing extreme gerrymanders might trigger reverse racial bloc voting as that is still allowed because Callais did not overrule Gingles. It applied strict scrutiny (Brennan in Gingles could not get the court majority on board with his positive discrimination musings) to the VRA and that kills intentionally structuring districts using race because strict scrutiny forbids it because the remedy is not narrowly tailored to meet the VRA's compelling interest in preventing racial discrimination on voting and districting. Thornburg v Gingles is a mess of a decision and that is why the majority minority districts came about in the first place. Via the DoJ and the Civil Rights Division during Reagan Bush years. It doesn't really matter anymore what blue states try to do or Marc Elias.
The guy who drew up CA's new districts explicitly crowed how he used race; that he wanted to increase the number of Hispanics in the districts.
And the reason for the minority-majority districts is because racist white Dems didn't want black Dems deciding the Dem candidate in the primaries. I think we underestimate how much Dems will fight each other when redistricting is re-opened in blue states. Minority-majority districts were fine as long as the minorities knew their place was to elect white liberals. But, there is significant growing angst in within the Dems that now these minorities want a seat at the table. Probably not, Sponge. Blacks did not get voting rights till after the Civil War.
Posted by: FenelonSpoke Depends on the state. Most Northern states got to universal suffrage for males pretty quickly including blacks and it gets weird before 1820 or so even in the South. Places like Georgia and Louisiana (which had the ridiculously fractional rules) had free blacks voting early on, holding property, etc. and that was true in places like Appalachia with the Melungeon mixed race populations. There was not formal voter registration in such years until the 1890's so it is difficult to determine exactly who was voting at times. Same with voting by sex, NJ allowed widows who were head of the household and property owners to vote for example until they didn't. Wyoming allowed women to vote in state elections in the 1870's. We shall know more about August or so about what the electorate is likely to look like by then. Posted by: whig at May 01, 2026 04:18 PM (E4rtv) 226

Posted by: whig at May 01, 2026 04:18 PM (E4rtv) ====== I believe all polling, even when completely contradictory and well outside the margin of error for each other. I just average them (and exclude the ones with decent histories because leftists online call them trash polls and Republican pollsters) and say that they are ironclad realities because I'm smart because I used math. I only know Zoe Saldaña from her mobile phone service commercials, but she seems a very likable person. Time lists her among its list of 100 most something or other people and includes the following in their description of her: "she celebrates her Afro-Latina roots with fierce pride"
Is Time smearing her as a racist? Posted by: Oglebay at May 01, 2026 04:20 PM (2ap+5) 228

I was looking at that CATO chart claiming rightwing violence was more common then leftwing. I see from 2017-2022 they list 80 people murdered by conservatives.
I can't remember a single notable politically motivated rightwing killing in that time frame. Is this really just Aryan Nation methheads killing 80 Latin Kings in prison? Posted by: 18-1 at May 01, 2026 04:16 PM (sKqQm) Data from multiple sources indicate that right-wing extremists have been responsible for significantly more political murders than left-wing extremists. For example, a 2024 report by the National Institute of Justice found that right-wing extremists murdered 520 people since 1990, compared to 78 by left-wing extremists. Another analysis covering 1975–2025 attributed 363 murders to right-wing ideology and 68 to left-wing ideology, with the vast majority of terrorist killings linked to Islamism, primarily due to the 9/11 attacks. -- National Institute of Justice - part of the DOJ so politicized data. Posted by: TheJamesMadison ===== I don't. Did surveys for fedgov, not polling, but it gives you a real sense, even if I didn't have grad education about it and a friend that ran a state poll as director, that polling is badly done for the most part. Crime is down because Trump sent in some people, same as DC. Said mayor is under a *lot* of fire locally for, among other things, having taxpayers buy him a $750,000 armored SUV with gold rims while the Key Bridge progress is halted.

The TPS thing is especially infuriating. The law, as written, and passed by congress, and signed by the president, long before Trump took office, says straight up the decisions on temporary protected status are NOT subject to judicial review.
NOT. That means extending such status is not subject to judicial review NOR IS ending that status. The judges have no decision to make. There is no case or controversy. By the by, Article 3 judges have NO ROLE in immigration judicial proceedings. None. They have no say. BECAUSE the people being dealt with are NOT American citizens and hence HAVE NO RIGHTS under U.S. Law. They lack any standing to sue anyone or appeal any decision in an article 3 court. Article 2 judges decide immigration cases, and that is an administrative function of the executive branch. Every Article 3 judge inserting themselves into immigration proceedings is doing so ILLEGALLY. They have no authority. The supreme court has no standing to hear the case, and the plaintiffs have no standing to even bring the case. Posted by: The Whine Guy at May 01, 2026 04:35 PM (954tc) 241
I just ranted, but again - non-citizens do not have rights in Article 3 courts. Furthermore, the supreme court has previously ruled, that deportation is not punishment. Since the foreign national is not being punished, there is no cause or standing for any sort of legal action in an article 3 court.
According to the supreme court, enduing TPS status simply means the person is being deported, and since deportation is not punishment, there is no harm, and hence no basis for standing, and no lawsuit. "My client doesn't wish to leave" is not a basis for a lawsuit. Nor is "I think these guys might be racists". It doesn't matter. That this doesn't get tossed in the first court the motion is filed in is appalling. Posted by: The Whine Guy at May 01, 2026 04:41 PM (954tc) 242
Still. Maybe don't send someone to Congress for six years who says "I had a rough time but I'm totally over that now."
