Sefton: sefton at cutjibnewsletter.com | IN EPOCHAL RULING, SUPREME COURT HOLDS, 6-3, THAT RACIAL GERRYMANDERS ARE UNCONSTITUTIONAL -- MUCH LESS REQUIRED BY THE CONSTITUTIONI don't know if the southern states affected like this can impose an emergency redistricting double-quick for the midterms, but some analysts believe that this ruling will eventually flip 19 Democrat seats to Republican. ![]() ![]() ![]() The Supreme Court just handed down one of the most consequential redistricting decisions in a generation -- and Democrats are not going to like it one bit. In a 6-3 ruling in Louisiana v. Callais, the majority held that Louisiana's congressional map -- redrawn to include a second majority-black district -- constitutes an unconstitutional racial gerrymander under the Fifteenth Amendment. The Court stopped short of striking down Section 2 of the Voting Rights Act entirely, but it dramatically narrowed the ways in which states may use race when drawing congressional maps. Gingles was decided at a time when this Court often paid insufficient attention to the language of statutory provisions, and Justice Brennan’s opinion for the Court followed this pattern. [lol, what a FU this is] For this reason, the focus of sec. 2 must be enforcement of the Fifteenth Amendment’s prohibition on intentional racial discrimination. ... In short, sec. 2 imposes liability only when the evidence supports a strong inference that the State intentionally drew its districts to afford minority voters less opportunity because of their race. -- Before, and Kagan whines, mere showing of racial effect was sufficient Now, they must show racial intent was the almost sole motivation to draw the district. These retards in the dissent are describing EXACTLY what Virginia is attempting to do to the voters in the more rural parts of the state. The only difference is that the people they intend to dilute and disenfranchise are white and therefore don't matter to democrats. QUOTE from the Dissent: The state legislature decides to eliminate the circle district, slicing it into six pie pieces and allocating one each to six new, still solidly White congressional districts. The State’s Black voters are now widely dispersed, and (unlike the State’s White voters) lack any ability to elect a representative of their choice. Election after election, Black citizens’ votes are, by every practical measure, wasted. Posted by: ballistic at April 29, 2026 12:15 PM (oqH4h) 112

Alito (yeah, we're not playing the "cry racism" game anymore):
The upshot of Rucho was that, as far as federal law is concerned, a state legislature may use partisan advantage as a factor in redistricting. And litigants cannot circumvent that rule by dressing their political-gerrymandering claims in racial garb. Imposing liability “based on the racial effects of a political gerrymander in a jurisdiction in which race and partisan preference are very closely correlated . . . would, if accepted, provide a convenient way for future litigants and lower courts to sidestep our holding in Rucho that partisan gerrymandering claims are not justiciable in federal court.” Alexander, 602 U. fn2 The dissent claims that the Fourteenth Amendment is irrelevant to our analysis, post, at 39–40, n. 11 (opinion of KAGAN, J.), but the dissent appears to forget—or at least tries to lead readers to forget—that the decision before us is based on the Fourteenth Amendment. That analysis had its priorities backwards. The Fifteenth Amendment, which the Voting Rights Act enforces, “is not designed to punish for the past” but works “to ensure a better future.” Shelby County, 570 U. S., at 553. The focus of §2 must therefore be on “current conditions,” not on “decades-old data relevant to decades-old problems.” Third, while the dissent wraps itself in the mantle of stare decisis, the dissent is unabashedly at war with key precedents. See post, at 45 (claiming that Rucho was disastrously wrong and should be cabined); post, at 5, 8–9, 42–43 (repeatedly criticizing Shelby County and citing the dissent in that case); post, at 4 (criticizing the Court’s decision in Brnovich). Thomas (and Gorsuch), burn it all down:
As I explained more than 30 years ago, I would go further and hold that §2 of the Voting Rights Act does not regulate districting at all. See id., at 922–923. The relevant text prohibits States from imposing or applying a “voting qualification,” “prerequisite to voting,” or “standard, practice, or procedure,” in a manner that results in a denial or abridgement of the right to vote based on race. 52 U. S. C. §10301(a). How States draw district lines does not fall within any of those three categories. Holder, 512 U. S., at 922–923 (opinion of THOMAS, J.); Allen v. Milligan, 599 U. S. 1, 46 (2023) (THOMAS, J., dissenting). The words in §2 instead “reach only ‘enactments that regulate citizens’ access to the ballot or the processes for counting a ballot’; they ‘do not include a State’s . . . choice of one districting scheme over another.’” Ibid. (quoting Holder, 512 U. S., at 945 (opinion of THOMAS, J.)). Therefore, no §2 challenge to districting should ever succeed. Posted by: People's Hippo Voice at April 29, 2026 12:22 PM (tUP1A) 165

He also has a forthcoming book scheduled for release this fall: "So Ordered: An Originalist’s View of the Constitution, Our Court, and Our Country." I heard Mollie Hemingway interviewed last week about her book "Alito: The Justice Who Reshaped the Supreme Court and Restored the Constitution." Not just the south. In Pennsylvania, the Democrats challenged a republican redistricting years ago. Despite the republican majority in the legislature and the PA constitution saying only the legislature can re-district, the PA SC (Liberal then and liberal now) shot it down, and THEN hired a Stanford Univ. political hack to come in and redistrict on their behalf (violating the constitution). This hack then proceeded to apply the same process that is just ruled illegal by the USSC. And, of coure the redistricting in PA ended up removing republican seats. The same Stanford hack professor did the same in SC, and KY.

Apparently he has not stopped taking new clerks, so I anticipate it won't be until '27. As much as I would hate to lose Thomas and Alito, we simply cannot risk a Ginsberg situation. People's Hippo Voice @164 that's a key point I was going to add.
The catastrophe of judicial usurpation of legislative and executive power is brightly illustrated in the entire history of the VRA. Section 2 does in any way justify racial gerrymanders (which, separately, are abhorrent and unconstitutional in themselves). The absurd self-regard and mumbo jumbo and toxic arrogance of the Legal Cult - empowered by supine legislatures and cowardly executives - have crippled this country in ways very few understand. This is a byproduct of the 1981 New Jersey "Consent decree" finally expiring in 2018, which allowed contestation of Gerrymanders, voter roll cleanups, voters ID requirements, etc. That consent decree effectively handcuffed scared repubs nationwide, but particularly in the south to remain silent, not fightback in any way shape or form...to avoid being labeled "Racist" and having congress/federal agencies able to regulate all state/local elections. The Prime threat of those attacks was actions and efforts of the SPLC, and the NAACP..."Shut up...Or ELSE!". The original "Offense" took place in an offyear, NJ Governors race, but the DNC managed to use the tool of the Ill Considered Consent decree to cripple the Republicans and the actual "Word of Law"nationwide for 45 YEARS.

====== Majority Minority districts came about because the DoJ during the Reagan Bush years decided that was a tactic for the GOP to gain seats in the South. Drawing upon the disparate impact precedents, the DoJ constructed the idea that proportional representation of a minority population was required. That in turn, destroyed moderate Blue Dogs as you had either distinctly white, or black predominate majority districts in the state legislatures as well as the congressional districts. Civil Rights Division (which were race libs) came up with the idea but the top mgmt at DoJ embraced it (and the CRD implemented some of Lani Guinier ideas on representation). It was related to preclearance under the Emergency provisions of the VRA which were still in effect and extended by Congress several times. Once the machine started, the new black Democrats obviously were not going to upset the apple cart as it would abolish their districts. So it destroyed moderate Southern Dems to the benefit of very liberal blacks in urban areas and white GOP candidates. Gingles ratified it. Posted by: whig at April 29, 2026 12:39 PM (E4rtv) 300

For decades blacks in MS were bussed from one place to another. Paid under the table. My elderly mother would overhear some black ladies discussing voting for their sister at the poll. Don't get me wrong, there are great black people my family knows and I was not raised in entrenched racism and hatred. The inner cities are one thing, the country people in the rural areas are another type of white and blacks who look out for each other. This is why I was never surprised at the bs that went on in big blue cities with illegals, as it's been done by Dimmycrats for decades. Turning the red state of MS redder by wiping out the Delta is going to sting. LA is worse in corruption. The shrunken blue pocket of Georgia (Atlanta...an airport I try to avoid) is not surprising. Read today that Dims in the House in FL screamed about the ruling. Wonderful 4 burning skulls plus a pudding cup, Ace! 336 I liked the part of the majority where they repeatedly emphasize that these decisions that permitted racial discrimination for "in-effect" claims under section 2 were all based on white Democrats trying to keep black Democrats from electing blacks.
It wasn't racist Republicans trying to keep blacks from electing a black Democrat candidate--it was racist Democrats trying to prevent blacks from electing a black Democrat. Posted by: People's Hippo Voice ======= Historically correct. There were hardly any GOP members around in the South after Reconstruction. A few state representatives in the Appalachians now and again in VA, NC, and GA. Had to compile the data for a prof that I worked for as an research assistant. In the sixties, you began to see a few GOP congress and state reps/senators in new suburban districts around cities and this increased modestly by the 70's. The words in §2 instead “reach only ‘enactments that regulate citizens’ access to the ballot or the processes for counting a ballot’; they
‘do not include a State’s . . . choice of one districting scheme over another.’” Ibid. (quoting Holder, 512 U. S., at 945 (opinion of THOMAS, J.)). Therefore, no §2 challenge to districting should ever succeed. == What a wonderful Justice he is. Solid as can be. I really enjoyed watching the biopic on him In his Own Words. I'm a li'l confused myself. The decision still lets states district by political affiliation, and that's an easy shortcut to racial districting, isn't it?
From Hippo's quote of Alito in #124: Alito (yeah, we're not playing the "cry racism" game anymore): The upshot of Rucho was that, as far as federal law is concerned, a state legislature may use partisan advantage as a factor in redistricting. S., at 21. “Instead of claiming that a State impermissibly set a target Republican-Democratic breakdown, a plaintiff could simply reverse-engineer the partisan data into racial data and argue that the State impermissibly set a particular [racial] target. Our decisions cannot be evaded with such ease.” Posted by: Archimedes at April 29, 2026 12:57 PM (Riz8t) 434

It still bothers me because we have not fixed the underlying issues. Voter ID. Election integrity. Posted by: Aetius451AD at April 29, 2026 12:58 PM (bss/y) == The RNC gave Democrats the win. That's the explanation. In 2020 and 2022, under Ronna McDaniel, the RNC was more concerned with corruption and playing nice with Democrats in the hope that a post-Trump Republican Party would be treated nicer by Democrats. Trump finally got McDaniel fired and replaced by Lara Trump and Michael Whatley. They actively worked to stymie Democrat efforts at cheating. Election night 2024, Philadelphia tried to shut down counting at about 10pm. The RNC immediately sued and Philadelphia kept counting (Trump won the state by pure coincidence). The story of the 2020 and 2022 cheats isn't that Democrats got real good at it, but that Republicans actively helped make it happen. 2 years of DOJ lawsuits on voter rolls will do more Posted by: TheJamesMadison, discovering British horror with Hammer Films at April 29, 2026 01:00 PM (R/457) 449

WASHINGTON — King Charles III presented President Trump with the bell from a World War II-era British submarine — dubbed the HMS Trump — at the White House state dinner Tuesday, where the two leaders bonded over highs and lows of the centuries-long US-UK relationship. The shiny brass bell bearing Trump’s name and 1944, the year the submarine left a UK shipyard, was part of a vessel that played “a critical role during the war in the Pacific,” according to the king. https://is.gd/DTNK7B Posted by: Anonosaurus Wrecks, Fat, Dumb, and Happy at April 29, 2026 01:05 PM (ndZc7) 479

Posted by: ShainS ============ Before the court of appeals, multi judge panels were used for all appellate matters; after 1896, they were used where state laws were declared unconstitutional. We should actually go back to that along with direct appeals involved so that the decisions binding to one state are binding precedent to another. That in part is how the massive resistance to Scotus on integration failed. The district judge panels ruled, Scotus affirmed or reversed, then those binding precedents were enforced on other states doing the same crap. Reason Democrats abolished most of it aside from voting districts in 1976. Basically panels of judges for unconstitutionality removes the stupidity and partisanship of one judge and it would also force Scotus to make a ruling immediately by bypassing the Courts of Appeals on such matters. Va broke their process not just to get the change in for this election but also to snooker voters, some who already voted in primaries. That’s one of the appeal issues.
It’s not a guarantee this will pass again. -- It won't. And it probably would not have if they had followed the rules this time. Note: one of the bigger issues is, they lied to the Republicans to get the special session: 1/3 +1 is all that's needed--which Rs have more than enough to do. Dems said, "we're only going to do budget issues" Then instantly added redistricting to the agenda. Posted by: Tom Servo at April 29, 2026 01:11 PM (rGqqI) ====== Also true. The GOP has been actively trying to "win by losing" for years. All this does is lead to losing. However, the biggest loser ends up being the party leaders who try it because they push out their most loyal congressmen while the upstart taking over the party has an easier time of filling those seats with loyalists. It's honestly how Gaetz was able to get rid of McCarthy. There were simply not enough McCarthy loyalists in the very thin GOP majority to stop a small group of upstarts from causing trouble. In a somber tone, Kagan read a summary of her 48-page dissent from the bench – a signal of her strong disagreement with the majority’s ruling. “The Voting Rights Act,” she wrote “is—or, now more accurately, was—‘one of the most consequential, efficacious, and amply justified exercises of federal legislative power in our Nation’s history.’” But the requirements that the court imposes on Wednesday, she contended, “will effectively insulate any practice, including any districting scheme, said by a State to have any race-neutral justification. That justification can sound in traditional districting criteria, or else can sound in politics and partisanship. As to the latter, the State need do nothing more than announce a partisan gerrymander,” she said. “Assuming the State has left behind no smoking-gun evidence of a race-based motive (an almost fanciful prospect), Section 2 will play no role.” In another sign of her disagreement with the majority’s decision, Kagan omitted the traditional “respectfully” from her conclusion, writing only, “I dissent.” Posted by: L - No nic, another fine day at April 29, 2026 01:14 PM (NFX2v) 553

FL's new map is in alignment with Gingles (also the FL constitution has a racial makeup requirement).
Posted by: TheJamesMadison ===== My mention was that of states that were redistricting. This decision simply prevents, like the shadow docket decisions on Texas, challenges under the VRA going forward. Gingles is dead, mort, is no more. That decision allowed majority minority districts as long as the other factors (contiguity, political community, etc.) were not violated. Same as Bakke and later decisions on racial admissions to schools. Under Gingles, correcting racial imbalances in representation could be a factor but not the determinative one. The NC district in Gingles was so badly drawn that it followed the interstate to connect urban islands to create a Dem majority minority district. The joke was you could go down the interstate and hit every voter with your car doors open between those urban redoubts. My supervising prof in grad school for my research assistantship was an expert witness for that case. Posted by: whig at April 29, 2026 01:21 PM (E4rtv) 571
