I don't know if the southern states affected like this can impose an emergency redistricting double-quick for the midterms, but some analysts believe that this ruling will eventually flip 19 Democrat seats to Republican.
The Supreme Court just handed down one of the most consequential redistricting decisions in a generation -- and Democrats are not going to like it one bit. In a 6-3 ruling in Louisiana v. Callais, the majority held that Louisiana's congressional map -- redrawn to include a second majority-black district -- constitutes an unconstitutional racial gerrymander under the Fifteenth Amendment. The Court stopped short of striking down Section 2 of the Voting Rights Act entirely, but it dramatically narrowed the ways in which states may use race when drawing congressional maps.

I'm not worried about the birthright citizenship ruling. If it turns out it that doesn't go in Trump's favor (which it probably won't) you can simply tax all anchor babies turned adults that live abroad for any income they earn outside the US borders. If they don't pay up, they forfeit their citizenship; we either get their money or they lose their vote. They're not going to get both.

District courts will see lawsuits. 90% of Republican appointed judges at this level will follow precedent. 50% of Democrat appointed judges at this level will follow precedent.
A couple of appeals courts will throw some sand in the gears for a few months before being smacked down on the shadow docket by SCOTUS.

As I explained more than 30 years ago, I would go further and hold that §2 of the Voting Rights Act does not regulate districting at all. See id., at 922–923. The relevant text prohibits States from imposing or applying a “voting qualification,” “prerequisite to voting,” or “standard, practice, or procedure,” in a manner that results in a denial or abridgement of the right to vote based on race. 52 U. S. C. §10301(a). How States draw district lines does not fall within any of those three categories. Holder, 512 U. S., at 922–923 (opinion of THOMAS, J.); Allen v. Milligan, 599 U. I've started watching Ken Burns' documentary on the Revolutionary War. It's generally okay, but I'd guess that at least 25-30% is spent on blacks and how the RW couldn't have succeeded without them. It is so damn tiresome. When it starts up, I just fast forward for 5-10 minutes to get to the stuff about the actual war.
PBS is like this in general. You'd never know it isn't still 1964.

She mentioned two things: (1) there is some historical "white whale" SCOTUS decision that Alito wants to be able to help possibly overturn (sorry, can't recall which); and (2) there are three Justices on the right over age 70 now (obviously Thomas) but even Roberts (which I wasn't aware of).

Mississippi already announced redistricting special session. Louisiana must do it. Alabama is likely to. That leaves GA, SC, and NC if it wants to. Also protects preemptively Florida's redistricting. The amendment was directed at preventing states from banning voters by race, not to provide secure districts for minorities.
The Court has long said that the emergency provisions of the VRA of 1965 could not be justified constitutionally any other way than being considered an 'emergency'. You cannot have a constitutional emergency that lasts in perpetuity.
Democrat justices are the ones that want to enshrine race in our color blind Constitution because it helps the Democrat party.

So, there are limits to what finagling things can happen.

Sounds insurrection-y -- maybe the Executive Branch, charged with enforcing the law -- invades and takes over, turning those states into de facto territories with military governors?

Majority Minority districts came about because the DoJ during the Reagan Bush years decided that was a tactic for the GOP to gain seats in the South. Drawing upon the disparate impact precedents, the DoJ constructed the idea that proportional representation of a minority population was required. That in turn, destroyed moderate Blue Dogs as you had either distinctly white, or black predominate majority districts in the state legislatures as well as the congressional districts. Civil Rights Division (which were race libs) came up with the idea but the top mgmt at DoJ embraced it (and the CRD implemented some of Lani Guinier ideas on representation).
It was related to preclearance under the Emergency provisions of the VRA which were still in effect and extended by Congress several times.
Once the machine started, the new black Democrats obviously were not going to upset the apple cart as it would abolish their districts. So it destroyed moderate Southern Dems to the benefit of very liberal blacks in urban areas and white GOP candidates.
Gingles ratified it.

Lawsuits over districts go to three judge panels composed of district court judges. They have the power themselves to draw districts under existing law and precedent and decisions can be appealed directly to Scotus. Callais is such a case.

For decades blacks in MS were bussed from one place to another. Paid under the table.
My elderly mother would overhear some black ladies discussing voting for their sister at the poll.

Look for the older and far superior Liberty!, The American Revolution by Thomas Fleming, an actual historian. Shown on PBS in 1997 originally and then the History Channel back in the day and Fleming wrote a book. Far better than Ken Burns crapola techniques which are dated and woke nowadays.
Fleming was not a woke historian but a genuine American treasure who could write historical novels and straight history in a clear and concise way. Died in the last couple of years but had a very long and productive career.

I'm a li'l confused myself. The decision still lets states district by political affiliation, and that's an easy shortcut to racial districting, isn't it? Just like our finer universities now advising prospective DEI students to include "hints" in their personal statements, or taking their location into consideration (South Side of Chicago, anyone?).

Historically correct. There were hardly any GOP members around in the South after Reconstruction. A few state representatives in the Appalachians now and again in VA, NC, and GA.
Had to compile the data for a prof that I worked for as an research assistant. In the sixties, you began to see a few GOP congress and state reps/senators in new suburban districts around cities and this increased modestly by the 70's. It was really the Reagan Bush DoJ though that killed the S. Democrat rule over Dixie with majority minority districts being pushed in preclearance under the Voting Rights Act emergency clause.

Districting for extreme partisan advantage is not unconstitutional.

The RNC gave Democrats the win. That's the explanation.
In 2020 and 2022, under Ronna McDaniel, the RNC was more concerned with corruption and playing nice with Democrats in the hope that a post-Trump Republican Party would be treated nicer by Democrats.
Trump finally got McDaniel fired and replaced by Lara Trump and Michael Whatley. They actively worked to stymie Democrat efforts at cheating.
Election night 2024, Philadelphia tried to shut down counting at about 10pm. The RNC immediately sued and Philadelphia kept counting (Trump won the state by pure coincidence).

It was pretty clear from the oral arguments and prior decisions on cases like the Texas redistricting that this was coming. Yet, I am sure that Action Jackson's or the rest of the leftist coven on the Scotus would have no problem leaking it.
Apparently this decision was delayed because the leftist judges were dragging their feet on the dissent so that it could not apply to existing elections in 2026.

Before the court of appeals, multi judge panels were used for all appellate matters; after 1896, they were used where state laws were declared unconstitutional.
We should actually go back to that along with direct appeals involved so that the decisions binding to one state are binding precedent to another.
That in part is how the massive resistance to Scotus on integration failed. The district judge panels ruled, Scotus affirmed or reversed, then those binding precedents were enforced on other states doing the same crap. Reason Democrats abolished most of it aside from voting districts in 1976.
Basically panels of judges for unconstitutionality removes the stupidity and partisanship of one judge and it would also force Scotus to make a ruling immediately by bypassing the Courts of Appeals on such matters.

The GOP has been actively trying to "win by losing" for years.
All this does is lead to losing.
However, the biggest loser ends up being the party leaders who try it because they push out their most loyal congressmen while the upstart taking over the party has an easier time of filling those seats with loyalists.
It's honestly how Gaetz was able to get rid of McCarthy. There were simply not enough McCarthy loyalists in the very thin GOP majority to stop a small group of upstarts from causing trouble.

That caused a LOT of political strife and issues pre antebellum era in Georgia, NC, Virginia, etc.
As the state populations shifted westward, the political power stayed in the coastal regions. Was particularly acute in GA as the governor was selected somewhat like the electoral college does for the federal government. County unit system.

Dems are going to try to make Puerto Rico, Guam, American Samoa states. (They're heavily welfare states) and pick up both senate and congressional seats. It's all they have left. The complete scale of how nutty they are going to get is going to be fun to watch. With the SPLC shown for who they are, and USAID essentially dried up the Libs are going to get desperate.

My mention was that of states that were redistricting. This decision simply prevents, like the shadow docket decisions on Texas, challenges under the VRA going forward.
Gingles is dead, mort, is no more. That decision allowed majority minority districts as long as the other factors (contiguity, political community, etc.) were not violated. Same as Bakke and later decisions on racial admissions to schools. Under Gingles, correcting racial imbalances in representation could be a factor but not the determinative one.
The NC district in Gingles was so badly drawn that it followed the interstate to connect urban islands to create a Dem majority minority district. The joke was you could go down the interstate and hit every voter with your car doors open between those urban redoubts.
My supervising prof in grad school for my research assistantship was an expert witness for that case.
