The New York Times Shrieks About the 1% Recividivism Rate for Pardoned J6 Protesters, But Continues to Support the Release of Hardened Criminals with 30%+ Recidivisim Rates

From David Strom, we must re-carcerate the J6 protesters.

But we should also allow Iryna Zarutska's butcher to keep killing women until he's all "murdered out."

Strom is amused/angry that the NYT has suddenly discovered a zeal for punishment by incarceration -- but only for conservative political prisoners.

Maybe it was an April Fool's joke? The New York Times, which is deeply upset that Trump is arresting rapists, pedophiles, and sex traffickers to deport, wants you to know that the people Trump pardoned over January 6th infractions are on a crime spree.

Crime spree.

Apparently, of the more than 1200 people he has pardoned, 12 have been arrested for a crime since their pardon.

"One does not have to be a criminologist to predict that people who commit a violent act and are absolved of any punishment might become repeat offenders,"

Twelve people. Obviously, I want any of these people who committed a crime to get the appropriate punishment, and I wish I could say the same thing about New York Times readers and writers.

But they only care about criminals who support Donald Trump. Antifa rioters? They are "protesters." Homeless drug addicts pooping on the streets? "Victims." Somali fraudsters? No big deal. Hamas supporters taking over college campuses? They are bravely expressing their First Amendment rights.

The man who slashed Iryna Zarutska's throat committed more felonies than all the January 6ers combined, and The New York Times barely tut-tuts. Illegal alien gang members? They are our "neighbors."

Daniel Friedman
@DanFriedman81

The Times editorial board points out that 12 people Trump pardoned for January 6 offenses have been rearrested in the 14 months since Trump pardoned them. Trump pardoned 1270 January 6 convicts. That is a rate of 1% of pardon recipients reoffending.

Among arrestees free pending trial in New York City under the 2018 bail reform, about 22% are rearrested within 6 months. The people we need to worry about becoming repeat offenders after being absolved of punishment are not the J6ers.

I am all for a punitive justice system. I am all for mass incarceration. But to pretend the J6 offenders are dangerous recidivists who need to be locked up while it's fine to immediately release most criminals arrested by the NYPD is profoundly ridiculous.

Say -- what's the recidivism rate for antifa street thugs repeatedly sentenced to "time served" -- just the hours or days they spent in county jail awaiting their "sentencing"?

What do you guess the repeat-offender rate is there? 100% or thereabouts?

By the way, the J6ers were held without trial for up to a year, often in the most degrading and intentionally-damaging conditions. Some were held in solitary confinement for no reason except to punish before trial.

Yes it does. It is estimated that the Bloody Codes adopted by Parliament in the 1700's was responsible for England being far more peaceable and law abiding by the time of the Victorian era.

Dead violent criminals do not breed new criminals essentially whether by genetics or by transmission of family values.

68 The national arrest rate in the general adult population is somewhere between 2200 and 3000 per 100,000 people. By my math, that's somewhere between 2.2% and 3%. That's at least twice the arrest rate than the J6ers!

The NYT doesn't understand that a 1% recividivism rate not only doesn't support their theory that J6ers are bad guys, it actually shows just the opposite: that J6ers are nearly universally law-abiding people, and far less criminal than the average person.

By contrast, the recidivism rate for actual criminals is at least 35-50x higher than the J6ers.

At least one of the Jan 6ers, John Earle Sullivan, was BLM/Antifa and a "photojournalist," was egging them on to start fires and hurt people in the Capitol, and was the guy that got the footage of Ashi Babbitt getting shot. Then sold it for money.

He stupidly recorded audio of himself ENCOURAGING arson. That's why they convicted him. But Pres Trump pardoned him in that big sweep of people he pardoned.

from his Wiki: "On November 16, 2023, Sullivan was convicted of five felonies and two misdemeanor charges. On April 23, 2024, he was sentenced to six years in prison. On January 20, 2025, the first day of the second presidency of Donald Trump, Sullivan was pardoned along with nearly every other participant in the Capitol attack."

The real criminals were the one that put this op together and hounded these people for 4 years.

Contaminated sample. Illegals in sanctuary jurisdictions are often administratively cleared even on fairly serious offenses like DUI, etc. because it might subject them to deportation. So police agencies turn a blind eye on chargeable offenses--sometimes even violent ones.

Unz did some early work dealing only with California arrests in the 90's which is where a distorted view of immigration crimes comes into play. But he ignored federal crimes including serious drug crimes, immigration fraud related crimes including welfare benefits, identity theft, and other non violent crimes.

When including those factors, the crime rate is substantially more. At least double maybe triple at the low end. Half or more at the high end including misdemeanors, etc.

If we do, the knives come out and they can start rounding up the kulaks. They feel that with near-total control of the MSM there is no way to over-commit.

Along that vein, I'm not the only one keenly watching the birthright case argument with the understanding that if the .gov doesn't unfuck themselves on this, we are virtually guaranteed to see political/ethnic cleansing at some point, at a minimum (against who remains to be seen). The progs' behavior is calculated to enrage and specific items like the foreign invasion aren't tolerable.

I'd like to know what the 1% of pardoned J-6ers were arrested for.

How many cases assignable to disruption and stress of being locked up in intentionally abusive conditions for a year without charges? Loss of employment, houses, marriages?

How many because some law enforcement knew who they were, and were eager to get them for something, anything?

I think the EO loses. I don't think the ACLU will like the fact that a majority will kick it to Congress to legislate, not a constitutional amendment as most of the court are supposedly originalist and the historical record using subject to the jurisdiction thereof is clear as well as caselaw.

Remember that Congress set natural born citizenship to include the Canal Zone and for parents of children at foreign military bases. That is why John McCain could run for president as a natural born citizen despite being born in the Canal Zone. His admiral father was stationed at the Canal Zone at the time.

So a split the baby decision that allows Trump to pivot and use that as another cudgel to beat Congress and the Senate with. Will be an election issue in 2026 if that is the case.

The case is a lot more complicated than that. The EO was a means of forcing the issue onto a reluctant ruling class. Court will have a lot more trouble trying to get a majority to rule what the ACLU wants which strips out the words subject to the jurisdiction thereof from the 14th Amendment. I don't think absolute jus soli is going to fly in the ruling. My guess again is that the dispute is kicked to Congress to resolve as it has in prior precedents. That can be done without disturbing Elkins nor Wong Ark Kim caselaw.

My guess is a plurality opinion with a bunch of concurrences and at least one or two dissents. This is going to be like the Obamacare case in my estimation. Some parts for everyone to hate.

Trump did it to force the issue and it worked. And no, I don't think it will enshrine what the ACLU wants even if and when the EO is terminated by a ruling. Both Roberts and ACB are essentially cowards but they would find a hard time to reconcile what the ACLU wants and their supposed originalism. Ditto for textualism from Gorsuch. Alito and Thomas are likely to dissent in part and concur in part is my guess.

I don't see the left gaining much if anything out of it to be honest. There is enough justices to disturb the status quo that is what I think they will do. Rule against the EO, kick the debate over to Congress.

And no, I don't think like Schlicter thinks it will take a constitutional amendment.

Trump is likely though to limit visas to foreigners with third term pregnancies and strike at birthing centers (which are already illegal under existing law).

Good days and bad days, had to have the cervical spine operation as I was losing feeling and control of arms and hands. But fusing the cervical region via a cage means the stress is concentrated lower. Already have 1 herniated thoracic disk and 4 in the lumbar so the pain in those joints is substantial along with muscle spasms from the readjustment process.

The muscle tightness in the cervical region is much diminished as time goes on so everything has moved downward.

Where people get into trouble is when they combine extra acetaminophen in various OTC products with existing pain meds like Nyquil, Tylenol or Headache formulas, etc.

Think the upper limit per day (which is probably generous is about 3000 mg which down from the absolute limit of 4000 previously.

Later cases casually calling children of illegal aliens citizens were drive-by rulings with no real analysis.

---
That's what I keep saying:
Everyone is focused on the wrong question.

The left wants to make this about the horrors of shipping people who've been here for decades out.
And all it does is say, "we no longer deeming children born here of illegals as citizens."
Children who never had citizenship.

Once you strip out "what are we to do with those who are already here?!" with "nothing, they stay" then this is merely no different than, say ... ruling gay marriage is a Constitutional right--overturning near 200 years of practice and law.

Going forward, the parents of noncitizens have to prove their child is a citizen.
Shifting the burden, that's all, where before, the government had to prove they were not a citizen.

That's why I say it's 6-3--since it doesn't change the status of anyone already here.

Eh, painful but that is what inflammatory arthritis leads to. So far, I've kept it away from internal organs so I am better off than others.

Part of it was that the injectables have spike and then fall in levels over time. In my case, that meant about 1/3 of the month, I had levels of the injectables insufficient to ward off arthritic damage. And the injectable biologics can have some side effects.

The pill forms are weaker but right now is keeping my inflammation markers more stable because I take a dose daily. But the first pill I took, stopped being effective around about the covid era from 2020-2023. That required a return to Humira, and then to Cosentyx which never worked right for me in the last two years.

Crazy story out of Nepal:
Trekking company owners, helicopter operators, hospital executives, and mountain guides have all been caught in a dangerous scam. The guides put baking soda in the tourist's food. This gives the poisoned tourist severe gastric distress. The guides and medical teams then pressure them to evacuate by an expensive ride via helicopter to the local hospital. The hospital then falsely identifies the gastric distress as altitude sickness. Everybody profits at the expense of the tourist.
