Sefton: sefton at cutjibnewsletter.com | Appeals Court Overrules Activist Leftwing Minnesota Judges, Declares That Illegal Aliens Can Be Held Indefinitely Without Bond While Waiting for Their DeportationThis is important because if you want to deport someone -- put them on a plane -- you need to have physical custody of their bodies, and activist judges keep ruling that after ICE captures an illegal alien, he must be allowed to go free. He'll just show up for his actual deportation, right? No, of course not. He will disappear "into the shadows," as Jeb Bush might say. But that's what these activist, lawless Democrat judges want -- a soft judicial repeal of the power to deport. They can't just say "we're overruling Congress" -- Congress has the power to make laws about immigration and naturalization, of course -- so instead they just spam out fake requirement after fake requirement to make it effectively impossible to deport anyone. In short -- they want to codify Biden's lawless executive decision to open the borders and guarantee all comers a permanent residency in America into "law" without having to go through the bother of actually changing the law. The Eighth Circuit is the second appeals court to tell lowly court judges they do not have the power to overrule both Congress and the President. And that's not all. The Supreme Court appears inclined to side with the Administration on the government's right to turn away "asylum" seekers at the border. The majority of Supreme Court justices appeared to be sympathetic to the idea that the Trump administration should be able to turn away asylum seekers at the US-Mexico border. If the court rules in favor of the administration, the government will be able to revive a policy used during Trump's first term, where those seeking asylum were stopped at the border from setting foot in the US. Federal law dictates that those who arrive in the US and are "physically present in the United States" or "arrive in the United States" can apply for asylum. The issue is whether noncitizens merely have to show up to the border to request asylum or if they have to cross the border fully before applying. The majority of justices appeared to be sympathetic to the Trump administration in the case, per the New York Times. Chief Justice John G. Roberts Jr. and Justice Amy Coney Barrett suggested that "arrives in" means that someone has fully crossed the border. "'Arriving" sounds more 'in the process of.' 'Arrives in' sounds more like 'you've reached your destination,'" Justice Barrett said in the hearing. "If it's not crossing the physical border, what is the magic thing?" Former President Barak Obama implemented the policy where some seeking asylum would be turned around at the border, which was expanded by Trump. However, that policy was rescinded under the Biden administration. Biden rejected Trump's border security measures and allowed tens of millions of illegal immigrants to cross into the United States, be paroled, and wait for immigration hearings that were often scheduled five or more years down the road. At one point during his term in office, Biden dismissed a bunch of immigration cases, leaving migrants in a legal limbo with neither legal status nor deporation orders. The Trump administration has urged the justices to allow the policy to be reinstated. Justice Brett M. Kavanaugh suggested that the debate about where a migrant is at when they request asylum is "very artificial." Two of the liberal justices, Sonia Sotomayor and Ketanji Brown Jackson, had tougher questions for the administration in the case. They were the only justices who appeared sympathetic to allowing the full embrace of asylum claims at the border. Look, we don't give thanks enough. Trump has had some bumps and oopsies this term, but he's been great 96% of the time. 96% will get you an A anywhere. An A+, really, with the curve.

Confess have not reviewed the actual asylum law (silly, actually considering the law itself in, well, considering a law), but the entire history of the thing was turned on its head in recent years. Started under Obama, though, inexplicably, there was some push-back (as noted in the post).
Those of a certain age will recall asylum as it was originally intended and implemented. Individuals, persecuted for their beliefs, given sanctuary. Often at a US Embassy, to start, later to be negotiated out in some sort of swap. This was the Cold War norm, usually with Soviet bloc countries, and it was exactly why the law was enacted. Literally millions of random people showing up at the border, obviously economic migrants (= zero basis for admission or status under the actual law), just ushered in, and the "asylum" process and meaning completely thrown out. Odd, but one of the most infuriating and depressing things (of the non-stop tsunami of such) in recent years. Probably because those who know recognize what a perversion of a very noble American policy it all is. One way to look at it is that every right leaning pol should be working the same way but honestly Trump hasn't been even particularly rightwing - you can find speeches by Clinton, Sanders, Schumer, and others about the problems illegals cause and the need for vote security. So, imagine if every elected pol, left or right, put America first? Hell, remember when given a choice between even their supposed holy grail of nationalized healthcare or illegals the modern left has consistently choosen illegals. Individuals, persecuted for their beliefs, given sanctuary. Often at a US Embassy, to start, later to be negotiated out in some sort of swap. This was the Cold War norm, usually with Soviet bloc countries, and it was exactly why the law was enacted.
Literally millions of random people showing up at the border, obviously economic migrants (= zero basis for admission or status under the actual law), just ushered in, A couple of points expanding this: A few years ago a German family sought asylum. The German government wouldn't let home school and wanted to indoctrinate them. This is a clear asylum case. Biden sent them back. Its an open secret that most "refugees" travel back home for vacation. What the hell are they refugees from then? Posted by: 18-1 at March 27, 2026 03:41 PM (sKqQm) 73

Nation Wood, 25, was arrested Wednesday, just 24 hours after he allegedly shot and killed Samantha Emge, 22, a 2025 graduate of San Francisco State University, at a home in San Francisco’s Sunset District. Wood identified himself as a part-time security staffer for Biden’s White House Secret Service team starting in November 2023 on his LinkedIn profile. He worked at the White House through July 2025, finishing out his term under President Donald Trump, according to his LinkedIn page that lists him as an “independent pre-event site security advisor.” Posted by: beckster at March 27, 2026 03:50 PM (I7J98) 93

Joaquin Herrera Avila entered the US illegally in 2006. He did so again in 2016. It's easy to see such acts as illegal in their own right, because they are. But, attached to each of these illegal entries are, also, other violations of the law. No VISA, no passport, no border crossing card, no permit. So, international travel without a passport in another violation of the law.
No DUI is necessary for a removal of a non-authorized party. It should be that simple. I'm curious whether those individuals who go through the legal process of immigration have the ability to file civil litigation against anyone entering illegally, and being allowed to stay....based on a violation of the Equal Protection Laws. Yeah, but once you get elected, the power of incumbency is such that you'll mostly stay in office until they carry you out in a body bag. Staying an incumbent by doing what the GOPe leadership tells you to do will keep you waist-deep in quality poontang and twinks.

I suspect a lot of conservative groups feel in the same way the GOP did. Remember the key point in modern politics is when the Dems forced Newt and his chosen successor Livingstone out making way for Hastert - whom they knew AT THE TIME was a pedophile
Given a thorough investigation I suspect you'd find that a key moment in the fall of all of the old right leaning orgs was the Dems identifying one perv and leaning on him... The blue slip policy is not a time honored tradition in the US Senate. It came about due to the Southern Dem senators wanting to block desegregation judges and prosecutors in the South. It is not in the Senate's formal rules but rather is a Judiciary Cmte rule that has wavered back and forth over time depending on who was Judiciary Chair.
And formally, senatorial courtesy was NOT a veto by senators of a presidential pick but rather that they be consulted before the pick went before the Judiciary Committee so that they could develop questions, etc. for the nominee. Even less so for federal prosecutors. But, the segregation era warped the Senate by setting up the ridiculous filibuster rules, the blue slip policy, and a number of other methods to essentially protect senators from having to walk the plank by voting unlike their House counterparts. As a result, the Senate has rotted. The House has become something that Joe Cannon would like or Thomas Reed but it at least votes and this last term went back to regular procedure except for the Homeland Security bill. I blame the GOP in the Senate for that debacle. Posted by: whig at March 27, 2026 04:22 PM (E4rtv) 178
