Trump, GOP Push "Dahlia's Law" to Block Illegal Aliens from Getting Commercial (Tractor Truck) Drivers Licenses; Democrat Says That the Injuries Suffered by the Child Dahlia by the Third-World Driver Are No Big Deal

Dahlia is one of the lucky ones -- she survived her encounter with Third-World Highway Safety Protocols, albeit with serious injuries.

Many other Americans are not so lucky.

A GOP Senator answered Trump's call to pass Dahlia's law, and introduced it in the Senate.

Sen. Jim Banks is moving swiftly to carry out President Trump's call from the State of the Union, introducing the "Dalilah Law" just one day after the president urged Congress to bar states from issuing commercial driver's licenses to illegal aliens.
Trump used his nationally televised address to press lawmakers on a range of border and public safety measures. Among them was what he said should be a clear federal standard: no state should be permitted to hand out CDLs to individuals in the country unlawfully. The president tied that demand to the case of 6-year-old Dalilah Coleman, whose life was permanently altered after a 2024 crash involving a semi-truck driven by a man who had entered the United States illegally.

Banks formalized that request Wednesday.
The Indiana Republican's bill would restrict CDLs to U.S. citizens, lawful permanent residents, and certain foreign nationals holding valid work visas. It would also require that CDL tests be administered exclusively in English and mandate the revocation of commercial trucking licenses previously issued to illegal aliens or individuals granted Temporary Protected Status, regardless of whether they possess work permits.

By the way, this doesn't really raise any federalism concerns, because the federal government has always had, as it must have, exclusive power to regulate interstate commerce and travel.

If these left-wing third-world states want to issue purely intrastate CDLs, so that third-world terrorists can murder American citizens in their states alone, they can do so.

But the CDLs are granted to give the foreign savages carte blanche to drive 50-ton trucks across the country. Georgia has no say about California's standards for issuing them, and is forbidden by the Constitution from setting up border check-points -- therefore the problem demands a national response.

"Too many people have been hurt. Too many have been killed," Banks said in announcing the legislation. "Americans are paying the price because illegal drivers are being handed commercial driver's licenses like candy and put behind the wheel of 80,000-pound trucks. That stops now. The Dalilah Law makes it clear: If you are here illegally, you do not get a CDL. We need to act, and we need to act now."
According to prior reporting, the truck driver involved in the June 2024 crash had crossed the southern border in 2022 and was later released into the country's interior. He eventually obtained a CDL from the state of California, allowing him to operate a commercial semi-truck. Dalilah, who was five at the time, suffered a traumatic brain injury and was later diagnosed with cerebral palsy. A GoFundMe established to support her long-term treatment has raised nearly $150,000.
Trump argued during his address that language proficiency and legal status are basic safety requirements when operating heavy commercial vehicles. "Many, if not most, illegal aliens do not speak English and cannot read the most basic road signs as to direction, speed, danger, or location," he told lawmakers. "That's why tonight, I'm calling on Congress to pass what we will call the Dalilah Law, barring any state from granting Commercial Driver's Licenses to illegal aliens."

A former congresswoman who prosecuted an impeachment of President Donald Trump dismissed the severe injuries suffered by Dalilah Coleman during a Wednesday panel discussion on CNN.
Trump called for passage of "Dalilah's Law," legislation that would prohibit states from granting commercial driver's licenses (CDLs) to illegal immigrants named after Coleman, during Tuesday's State of the Union address. Former Democratic Rep. Val Demings of Florida dismissed Coleman's injuries from a 2024 accident caused by an illegal immigrant driving a tractor-trailer on "CNN NewsNight" after bringing up the fatal shootings of Alex Pretti and Renee Nicole Good during "Operation Metro Surge" in Minneapolis.
"How do you not mention -- mention that two people died and that -- in that environment?" Demings, who was one of seven House Democrats who prosecuted Trump during his first impeachment, asked. "And the president was one of the most unifying speeches, the president who said, 'Look at the Democrats. Aren't they crazy?' He obviously does not understand that when he won election, he is supposed to represent all people."
"When you go through some of the moments he went through, right, he pointed to a little girl Dalilah, who was almost killed by an illegal alien, miraculously came back," New York Post reporter Lydia Moynihan responded. "She was there with her dad. When you have Democrats who won't stand and applaud her recovery, yeah, I think that's crazy."
Democrats remained seated during a moment in Trump's speech when the president asked if they could agree to put American citizens ahead of illegal immigrants.
"Sadly, people are killed in America every day, sadly, and the majority of them are killed by U.S. citizens. So whether an undocumented -- undocumented immigrant --" Demings said, with Moynihan cutting in with, "I'm saying, think about --"
"Whether it's an undocumented immigrant or a U.S. citizen who is the perpetrator, bottom line is, somebody has died or someone has been seriously injured," Demings said.

So, it's less bribing of DMV clerks and more a cottage industry was created to invent documents without basis in reality.

In many California DMVs, there is industrial scale fraud, with employees freely handing out drivers' licenses to illegal and other types of ineligible people either due to bribery and corruption, or (in some cases) ideological activism. every now and then someone will get caught and make the local news, but none off it ever makes the national news. Overall, combined, the CA DMV fraud makes it nearly effortless for any illegal to get a drivers' license here.

61 There must be laws in Deep Blue states that absolve truck driving schools from liability if their students kill or injure people, damage their truck and other vehicles, damage cargo, and damage roads, bridges, dams, levees, and buildings. Laws passed after school owners paid the Danegeld at the time.

And/or, to get their license after their 'training' students must sign a waiver that absolves the school from all liability for anything a student does while driving a commercial truck for pay.

Otherwise I don't see how the 'schools' could stay in business, and the owners not go bankrupt due to successful damages liability lawsuits.

The latter is the more important piece, I suspect. CDLs already require English. The states handing out these CDLs are doing so with no due diligence or honesty whatsoever. They are already violating the law. Even setting aside the TPS issue, these are people who can't speak or read English and thus cannot legally hold a CDL anyway. Yet, they hold them - because the states issue them without a care.

As they will for TPS, too, regardless of this law. And these states won't be clawing back CDLs issued to TPS individuals, either, because of course they won't.

So what is the punishment for non-compliance? Who in the state governments go to jail, and which cashflows to the states are shut off?

Weeding out illegals CDLs and trucking firms and the fake CDL schools is far easier than weeding them out of something like construction.

The retirement Ram 3500 truck i got to replace one of the Chargers, can easily haul a load that forces me into the class A cdl range of weights. I have to be very cautious of which rv we get weight-wise or I'll have to upgrade to a class B cdl even though I'm not earning $ with it. It's a weight, braking, and knowledge thing about the combined total weight and how different it is to operate versus the normal everyday grocery getter vehicles.

If I have to go through that shit, just to go on an extended retirement vacation, then fook every single wetback piece of shit straight back to wog land unless they do it legal like too.

Welp, some DMV workers that were bribed, most recently in Kentucky are going to prison because of it. And DoT has moved to shut down the diploma CDL mills in a lot of the blue states, cut off certain grants (as to the state governments themselves for highway safety), and so on.

My guess is eventually lawsuits but having shiny new laws that eliminate district court judges discretion on this bullshit is even better to support cases against those states. I think some blue state district judge ruled against suspending CDL licenses of illegals becuz of the unfairness irreparable harm clause in the Constitution. These cases have to be appealed and won.

Things are actually moving far faster than I thought would be possible in one year re deportations and vastly changing the atmosphere for illegals. Self deportations are beginning to hit school enrollments pretty hard now and multiple schools are now scaling back employees or even closing schools starting at the end this year.

Yup. I don't sit next to semis at speed. If I have to wait for opening to get by, I wait behind the trailer in case the trucker needs to make an emergency maneuver. Once the way is clear, I punch it and get past as quickly as I safely can. I don't want to crowd trucks and I don't want to be in the way if he has to dodge left for whatever reason.

Welp, by returning to regular order, it is easy to attach to funding bills going forward as Congress has already started (except for part of DHS) marking up for next FY 2027.

Strictly speaking Griggs is a statutory interpretation case of the Civil Rights Act of 1964. And Scotus, once they have interpreted a statute, do not revisit it (you get into facial versus applied so there is some wiggle room). However, disparate impact seems to work against the 14th Amendment itself by creating all sorts of issues. Just like the Louisiana redistricting case may limit Voting Rights Act applications of majority/minority districts, neither comply with the original understanding of the 14th and 15th Amendments.

Thus Constitution trumps a statute and ancillary court decisions that interpret that statute.

But is going out anyway. Much of what those blue states do is unconstitutional and illegal and slowly the court system is whacking down the Resist judges regardless of what those blue states want. Second, the funds are not there anymore so even places like MN are now tightening belts on Medicaid spending for illegals. None of those states you mention have healthy budgets and illegals make that worse. Three, there will be less voting fraud while Trump is in office due to risks and the coming tsunami of 2020 election fraud being revealed this year. Detroit fraud in 2020 is coming to light, so is Georgia's and Maricopa is probably next.

Take out the urban fraud machines, Dems will find it hard to win outside of their blue states. FWIW, VA election shows an odd surge of absentee ballots again similar to a general election total versus when Youngkin won. My guess is a good chunk of that is fraudulent.

For me, the reason I don't travel alongside semis any more than I have to is because they have huge blind spots along them. Yeah, they have a lot of mirrors (and probably cameras these days) but I still don't like being that close to a vehicle that can squash mine like a bug and not even notice.

It's in fixed worksites, including construction, refinery maintenance and even maritime.

Who's the controlling employer(s) with the authority to correct the hazard or enforce safety standards? The level of control over the site and the contractual duties counts. But it's not necessarily easy to prove or win in Court.

Transportation is different; it seems a company can be sued provided a driver was acting within the scope of their employment. Through principles of vicarious liability, companies are responsible for employee negligence, such as distracted driving, fatigue, or safety violations.

The company may also be directly negligent for negligent hiring, improper training, or failing to maintain the vehicle.

200 The CDL drivers without licenses is certainly bad. But I think the overall quality of drivers, of all ages and demographics in the US has really taken a dive.

Operating a vehicle on the roads with other vehicles and people shouldn't be a given. At least have "a little" training. It'd weed out some of the problem drivers. And poorly maintained vehicles.

Understanding that not every state has the same level of driver's ed (if any) or vehicle inspections (if any.)

But still... it's a national issue.

Pull out, complete the pass, leave space behind you, and move back into the right lane. This isn't difficult.

The whole rule on statutory interpretation by Scotus is that they only interpret a law once facially as to constitutionality. This allows Congress to change the law if needed. Then you get as applied challenges which is where Griggs comes in. Plaintiffs argued in Griggs and won that the Civil Rights Act protections against employment discrimination included barring anything that might result in discrimination whether intentional or not in disparate outcomes for a protected group versus the non protected groups.

Back in the 90's mebbe, Congress then changed the CRA to codify Griggs in the 1991 Civil Rights Act. Thus, you cannot challenge Griggs on statutory grounds but have to go to constitutional that Congress does not have the power under the 14th Amendment to apply disparate impact theory without requiring proof intent to discriminate.

To clarify, I routinely work to get past large trucks, or at least not be in an adjacent lane. Getting past a truck, or a line of trucks, sometimes requires driving next to them for a short while. That's what made her nervous. Did the best I could.
