Compare this judge to the one in New York overseeing the prosecution of Luigi Mangione -- she just threw out two charges against him so that he would not be eligible for the death penalty. By the way, that makes it likely that Luigi Mangione will eventually get off. Prosecutors often use the death penalty as a bargaining chip to secure a plea deal where the killer gets life in prison, rather than death. Prosecutors no longer have this leverage, so the case will go to trial -- where Luigi Mangione will likely get one or two lefties on the jury who will jury-nullify because they're pro-assassination.* Unless the government offers Mangione such a sweetheart deal that he feels compelled to take it. Hate to remind you of that bad news. But the country is coming apart. We cannot remain at peace with fellow "citizens" who believe that they have moral (and even legal) justification to murder us. * I know a hung jury is not an acquittal -- the state can re-file charges -- but at some point, if lefties keep jury nullifying, they'll be forced to offer him a sweetheart deal.

Luigi Mangione may be found innocent, but he won't escape the judgment that is coming to him at the end of his life. And that may come sooner than he realizes because each of these ridiculous rulings moves us closer to a world where Luigi (and folks like him) end up shot in the back of the head by someone who realizes the justice system is irrelevant and justice has to revert to the old ways.

Oh please. Anyone know the last time that NY enacted the Death Sentence? It was freakin 1963. The Death Sentence in NY holds no negotiating power. In fact, it's my understanding that living in Death Row in NY is a much more comfortable experience that someone getting life in prison. You get your own cell and some amenities.
Also, I'd find less blame with the Judge, and more blame on the prosecution for the removal of those charges. The law reads pretty clearly on the burden, which is to show that interstate stalking guarantees violence. Stalking didn't qualify under a supreme court decision as a "crime of violence." I used to worry about this a lot more, but after several years of it not really being an issue, I'm less worried. The actual number of insane Leftists is still very small, even in Blue areas. You have to blame the federal death penalty murder charge for that. As I (and others) explained at the time, the charge requires not just a murder, but that the murder be committed during another separate "crime of violence" as a special aggravating factor. The underlying murder can't be the crime of violence; there has to be another violent crime. There wasn't one. This charge was always a stretch. This homo still faces "normal" murder charges in both federal and state courts. They are enough to get life in prison, but not death penalty. The blockbuster ruling in the case (in the same court order) wasn't dismissal of the murder-plus charge. The blockbuster was that the judge ruled all the items in the backpack were admissible. There were real issues with the backpack search (no warrant) and chain of custody. If the judge really wanted to sabotage the case, she would have thrown all this evidence out.
