27 Only met one friend when bike riding this afternoon. I feed treats to several dogs on my route. Only the Husky was out today. I can't feed him by hand because there is a drainage ditch with water in it between us. I toss the treats up high from about 10' away. He has never missed.

I've always had cats, never a dog, but I like other people's dogs. I buy dog and cat treats every time I go food shopping.

High number of new trolls hitting. I saw this shit all the time when I worked on zoning issues, memaw and papaw want to sell out of Meglamart for handfuls of cash but have to get their property rezoned from residential to commercial for the sale to go through. In most cases, it would dump on their former neighbors in light, noise, and car exhaust for a stop n go or worse.

People have a right to sell property but that does not mean that they have the legal or moral right to get whatever price they want from their property nor force changes in existing law to do it. Never has been true generally and why zoning got instituted at the beginning of the 20th century.

Basically zoning codified centuries of common law that you cannot use your property to the extent that it damages your neighbors.

Our Constitution was founded on negative rights to be left alone but once one engages in commerce, then it can and has been regulated since colonial times for the common benefit.

I played 12 years of football and even more years of baseball, and I have three prominent scars that ALL came while pole vaulting during my 8th grade year.

Two ripped open wounds in my legs from the sharp track cleats during a jump (one ascending, one descending), and one busted open my chin from coming down hard on the metal crossbar after clearing it my a couple of feet. There were a couple of times I came down from 10-11' without hitting the cushioned pit -- once on the cement upon which a standard was sitting.

Back in the days when we didn't even slap a hot iron on the bleeding ... let alone clean the wound or get stitches.

Some of the best colonial sources of US law are actually in the UK as the Board of Trade and King had the right to quash them so colonial officials of the crown had to submit all kinds of reports to the king.

My dissertation was on another area of law altogether, criminal law actually.

A history of one of the original colony's Bill of Rights. To do it right, had to spend about three years researching old law from ancient England back to the Magna Carta and before, canon law, Judaic law (reading the Babylonian Talmud slowly), and colonial law from about 2016-2020. Then Covid hit and my health went to shit and was trying to keep teaching despite mounting physical problems. Couldn't fit in the research among doctor visits and teaching.

After my back surgery coming up, I am going to revisit my work and try to push through and finish. Lots of footnotes along the way. I would actually teach ancient laws now and again upon demand dating back to the origins of canon law, Mosaic law, and items like the Code of Hammurabi. I also used to teach Comparative law which is simply Roman law cubed and squared in most of the Western World that does not speak English.

Chinese and Islamic law I know slightly as an outsider not speaking Chinese or Arabic.

The Jerusalem Talmud is interesting as it focuses more on agrarian issues but the Babylonian is the mainstream of talmudic thought. Mosaic law in the Bible has to be filtered through the lived experiences and rise of rabbinical Judaism in the absence of a central priesthood. Fascinating stuff and you can see where the Judaic influence mingled with Roman law to create canon law which then begat civil law for most of Europe.

I can literally lose myself for hours reading and cross checking references in such matters.

Islamic law is like trying to nail jello to the wall depending on which of the four major schools you favor. I 've read some Ottoman law, primarily on the treatment of minorities and some current Islamic treatises but you really have to speak the language to know much about what is going on there. Ditto in spades for China where you have communism overlaid over older Confucianism and Empire law.

I was 15 in 1970 and sometimes listened to Radio Peking on SW. There was a lot of wild and crazy radio on FM then, too, in the NYC area. WBAI, some college stations, WABC-FM, Alex Bennett, Bob Grant, David Peel, it was kinda nuts, but kinda fun.

259 Thanks for the well wishes. Not being able to sit more than about 15-30 minutes from back pain and read is one of the things I hope this surgery will cure.

So I am taking a break from the law and reading Pope Benedict's three books on Jesus and his life. Benedict was probably the most theological of all the recent popes and very sound compared to his successor. Very readable but reading the new Testament provisions to understand Jesus in multiple levels can limit me to about one or two chapters per night. It will open your eyes before it puts you to sleep. LOL.

I can deal with a Kindle right now easier than a paper book as I can view it at different angles to ease my back.

I found the more I read and try to understand, the more ignorant I feel. My discipline since Covid and lack of concentration since my physical problems worsened has caused a bit of withdrawal from active research for the moment and more to just absorb the background behind what I am trying to explain.

By more fully understanding the roots of something like two witnesses std (Mosaic law) which then was adopted as a standard for treason by the US, the distinction of twelve jurors relating back to the twelve tribes, and so on. I found myself going back and forth to the black letter law in the Bible but then the understandings by the rabbis in the Talmuds or even the Essenes in the Dead Sea Scrolls that can explain how these came about.

Based on a concept of duty for sworn law enforcement but as you said, difficult to explain. Would be an interesting application of law in the criminal sense while probably barred from civil case by qualified immunity doctrine.

Sort of like how the duty to retreat to the wall sotte voce includes 'in perfect safety' as a limitation. One cannot retreat from a bullet fast enough for example.

273 FWIW, I tend to gather information, let it swirl around, before I try to put letters to my thoughts. Copious notes including the naughty writing margin notes in my own books at times, albeit in pencil, and a use of colored flags for important cites.

So my covid years, not productive in a traditional research sense, have been so in deepening my understand of ancient law and how it relates to my particular beginnings in English Common law and the Magna Carta which was then affected by the Glorious Revolution and the colonial experiences to cause a particular old state to determine which rights were important to protect and why in its Bill of Rights.

They may have been considered barbarians, but they believed that no one man should have the power to decide guilt or punishment, instead insisting on a judgment by his peers.

It is an outrage that any NYPD Detective injured in the line of duty should have to worry about being treated at any hospital in the city they protect. As nurses across the city strike over issues like workplace safety, treating Detectives poorly is not how to make hospitals safer.

No one—especially Detectives injured in the line of duty—should face such treatment. The DEA is investigating this matter and will pursue all available remedies to ensure our members are treated with the dignity and respect they have earned.

It says ICE agents are allowed to forcibly enter a person’s home using an administrative warrant if a judge has issued a “final order of removal.” Administrative warrants permit officers and agents to make arrests and are different from judicial warrants, which judges or magistrates sign allowing entry into homes.

Lyons notes in the document that detaining people “in their residences” based solely on administrative warrants is a change from past procedures.

“Although the U.S. Department of Homeland Security (DHS) has not historically relied on administrative warrants alone to arrest aliens subject to final orders of removal in their place of residence, the DHS Office of General Counsel has recently determined that the U.S. Constitution, the Immigration and Nationality Act, and the immigration regulations do not prohibit relying on administrative warrants for this purpose,” the memo reads.

The memo says agents may “arrest and detain aliens” in their places of residence who are subject to final orders of removal issued by immigration judges, the Board of Immigration Appeals, or U.S. district or magistrate judges.
