Supreme Court Stays Left-Wing Rogue Judges' Ruling That Texas Is Not Allowed to Draw Its Own Congressional Maps

Alito stayed the decision, which means, for the moment, the map is back.

The lawless rogue left-wing judges had issued an injunction blocking the implementation of the map -- an injunction being an order granted before a trial, after a mini-hearing and a finding that the moving party is "substantially likely to succeed" at the actual trial* -- which means there is now no ruling before the full trial.

We'll see how it goes from there.


For now, this is good news.

Texas is back to using its 2025 congressional map, at least temporarily, after Supreme Court Justice Samuel Alito granted the state's request to pause a court ruling that would have required using the lines legislators drew in 2021.

The high court has not yet decided what map Texas should use while the court battle over the legality of the map plays out over the coming weeks and months; Friday's ruling is a short-term pause while they make that decision.

Texas Attorney General Ken Paxton celebrated the step as a victory, and said his office would "look forward to continuing to press forward in our case on the merits."

* As the dissenting Judge Smith pointed out, the majority (of two) acknowledged that the law requires a "substantial likelihood" of victory to obtain this extraordinary relief, but then immediately ignored the requirement of "substantial (overwhelming) likelihood" and just spoke of mere likelihood.


Related: Conservatives won another victory at the Supreme Court.

This is complicated: A liberal fired by Trump filed suit arguing he couldn't be fired. The lowly district court judge granted Yet Another Emergency Injunction blocking his firing. The DC Court of Appeals vacated that injunction. The liberal brat appealed to the Supreme Court, who then declined to hear his appeal, letting the appeals court's ruling stand. And their ruling kicked over the lowly (left-wing) district court's Yet Another Emergency Inunction.

Todd Harper, a member of the National Credit Union Administration Board, challenged his removal from that role, filing suit against Treasury Secretary Scott Bessent, President Donald Trump, and other administration officials.

In July, D.C. District Judge Amir Ali granted summary judgment in favor of Harper, but the administration appealed, and the D.C. Circuit Court of Appeals granted a stay of Ali's judgment pending appeal in August. Harper then filed a petition for writ of certiorari with the Supreme Court in September.

And that writ -- a request for a review by the Court -- was declined.

The RedState article notes that a lot of wins are found in these "short orders." People focus on the big rulings, but the tiny little short orders, like just declining to hear this guy whine that he feels entitled to keep his job, are big, too.

The grounds cited by the runaway judges were racial discrimination thus equating Democrats with minority rights to have minority set asides in gerrymandering cases.

Scotus has already heard oral arguments on the VRA giving courts (and state legislatures) the ability to interfere in redistricting to create majority minority districts -if that is struck down, then the lower court did not have the jurisdiction, aka legal right to hear the case, in the first place.

Using that as a standard is not appropriate given that the Founders, for better or worse, set up an impeachment process (which a significant minority felt was likely to be useless btw at the time) to remove federal judges. Like constitutional amendments, they made the bar high for removal which makes removal of judges extremely difficult.

The easiest way to remove them is like what Roosevelt did. He sweetened the retirement packages for judges and several justices opposing him on Scotus and more lower court judges immediately responded by retiring.

Because it takes impeachment to remove and for a constitutional amendment sometimes to kill their rulings.

That being said, if convicted of crimes, then they can be sitting in prison not hearing cases until they resign or are removed by impeachment. That has happened to several judges.

I think you underestimate their motivation and determination. Like Islam, Marxism is a whole-of-society grift. The amount of wealth in play for a victorious clique is literally unimaginable. Even federal judges have checks on their authority -- as you say -- so there is room for improvement for the power-hungry, who dream of a socialist "paradise" (for them) of no limits, just pure Will *Is* Law.

So, anything they can do to move the needle, even just a little bit here and there, is totally worth it. (Insert Terminator quote about relentless pursuit.) Maybe this ruling will be sent back, but another one might get through, or at least delay MAGA enough to give Mordor an edge. Evil never rests, and neither will they until there's a Constitutional amendment banning them and an American Inquisition to root them out.

Read Marbury v. Madison then read his opinion on almost the same content but a different section of the Judiciary Act in Ex Parte Bollman and Ex Parte Swarthout.

Bollman and Swarthout cases was too much for one of the justices, William Johnson and he dissented in these cases and called Marshall out on his playing games with the Judiciary Act.

I saw a theater production of Wicked and I thought they made the point well enough, and not too heavy handed.

I saw this video from this lefty chick who is done with lefty propaganda and over her TDS. She said that J6 was the story she most wanted to be true--but at the time, she knew--even mid-TDS--it wasn't as bad as the Dems were blowing it up to be. But it was still "her team" and pursuing the opposition over "insurrection" was an effective tactic.

So, using the idea out there that there were people who provided no opposition to the J6 narrative that were not convinced it was as bad as was reported, there are probably also people who know it's not "random" anti-Trumpers keep getting these cases.
