I'm not sure that's how it works. At least in the civil world, if you file a claim within the statute of limitations, and the claim later gets dismissed (for whatever reason), you can refile the claim regards if the SoL has run out in the meantime. It is very possible given the current line of Scotus strict separation of powers appointment cases involving independent agencies that a congressional law permitting courts to appoint temporary prosecutors is also unconstitutional.
That is a key factor here because Grassley won't get off his ass and kill the blue slip policy. Thune should end the charade by stripping the Judiciary of blockading such appointments by simply scheduling floor votes of all pending DA nominations without any Judiciary Cmte input. Congressional statute, gave the judiciary the right to fill DA offices when Congress did not permit a president to fill them. The overlapping conflicting law is the executive vacancies statute that permits temporary appointments for 120 days to fill vacancies. This judge decided to favor his own black robed tyrants rather than what the Constitution clearly states, the president is the head of the executive branch and as such major officers, like DAs must be appointed by the president, not filled by judicial busybodies. Muscle to fat ratio. Very lean and muscular types have trouble swimming as the density of muscle tissue higher than water means that they don't float as easy without constantly swimming. Fat is less dense than water so easier to float up to a point.
