NYC Will Imprison Senior Citizen for Defending Himself Against a Mugger
A Queens senior citizen who shot dead a man who tried to rob him will spend four years in prison after admitting to toting an unlicensed revolver -- as his lawyer ripped the city's "draconian" gun laws. Charles Foehner, 67, pleaded guilty to one count of criminal weapons possession Thursday in a deal to end his case more than two years after he fatally shot would-be thief Cody Gonzalez, who charged at him near his Kew Gardens home. The Queens District Attorney's Office chose not to prosecute Foehner, a retired doorman, for Gonzalez's killing after he told cops that he'd defended himself from a mugger who lunged at him late at night holding what looked like a knife -- but which turned out to be a pen. But prosecutors slapped Foehner with a slew of weapons raps for the unlicensed handgun and for an arsenal of illicit handguns, revolvers and rifles inside his home in the quiet neighborhood. Foehner took the plea deal to avoid a trial, where he faced 25 years in prison on gun charges that are not hard to prove, said his attorney Thomas Kenniff after Thursday's hearing in Queens Supreme Court. Kenniff called Foehner a "hero" who was put in an "impossible position" by what he called "draconian" Big Apple gun laws that make it difficult for "law abiding citizens" to obtain permits to carry firearms. "If this was a state and a city that had its affairs in order, Mr Foehner would be getting a plaque, not a prison sentence," Kenniff told reporters on the courthouse steps.A term that's enjoying new popularity -- because it describes the hell that the left is imposing on us -- is "anarchotyranny." The idea is that we live in a tyranny filled with lawlessness (anarchy). Those seem to be opposites, which would make anarchotyranny a contradiction in terms, but you have to remember that only some get tyranny while others get anarchy. If you're a rapist, a mugger, a killer, a drug-dealer, an illegal alien, you get anarchy, with the government staying out of your business and letting you harm your fellow citizens and ply your criminal trade with little government interference. But if you're among the working population with a family and a mortgage and commitments you just can't walk away from, you get the tyranny, the endless laws, the endless demands for you to get a permit to do every single thing that free men used to do freely, and strict and brutal punishment from the state when you ignore a law here and there. Don't you know that only the hardcore criminals get to ignore the laws with impunity? Adam Carolla has been ranting about this for years, although I don't think he used the word "anarchotyranny." (If you know where these clips are, let me know.) He points out that you will be permitted to death if you dare try to add an extension to your house, and it will cost you $50,000 just to get that permit. Meanwhile, illegal aliens can set up shantytown food carts on the street with no inspections and no authorization to block the sidewalks, and the cops will just walk on by. If you want to expand your business, the state wants to stop you. But if homeless people want to block traffic selling flowers car to car, that's fine. No problem.
The left wants to control people, and so they focus on the group of people who actually will obey all (or most) of the laws they pass: the naturally, inherently law-abiding. The people who can't afford to spend six months or a year in jail. Meanwhile, for the criminal class: complete freedom to do whatever they want to do. In the UK, they outlawed guns ages ago, and then outlawed swords and machetes and common knives. For the law-abiding people, at least. For the privileged classes: Anarchy.

It can be "walking stick" crime, because if you're legitimately using a walking stick because you're aging and need assistance while walking, any use of that stick to defend yourself if under attack will likely lead to you being charged with using a "weapon", regardless of the fact you were using it under duress.

1) You punish people who make the city money, that can pay fines and won't give you trouble.
2) You don't punish people that COST the city money. Catching and criminals, trials, and locking them up is expensive. Arresting a 67-year-old man is easy, he won't fight or need special security. plus, you can fine him a bunch of money, which he will actually pay.
You are just a money-making opportunity to the city. That homeless guy is a money losing opportunity for the city.

Follow the money, as always. There's a lot of money and entire cottage industries in permits, expediting, and all the red tape that goes into that. People pay it because they have no choice. It's big, big money to the state and assorted annelids.

Perverse incentives create perverse results.

Been keeping everyone updated on a case happening on my county court about a mile from me. A state trooper is on trial . He stopped a man on the NYS Thruway who had prior legal issues. The guy had his daughter in the car. He refused to compl , pepper spray was used and the guy took off from the stop. The trooper caught up , used a pit move and unfortunately in the accident the little girl was killed. Trooper yesterday was found not guilty of murder and reckless endangerment. Jury still deliberating on manslaughter. Protests last night. Walked past the courthouse earlier and 2-3 protesters with lots of signs. The trooper is being prosecuted by the office of the NYS AG James per NY law

I don't know about NYC, but in Seattle, all the homeless people walk around with weapons in their hands; thick walking sticks, screwdrivers, bats, and other things. Cops leave them alone. But if a normie gets found with a paring knife in their pocket, that's a "dangerous weapon" and they will charge you.

Its more than "knife crime". It can be "walking stick" crime, because if you're legitimately using a walking stick because you're aging and need assistance while walking, any use of that stick to defend yourself if under attack will likely lead to you being charged with using a "weapon", regardless of the fact you were using it under duress.

In the UK, they will retroactively charge you with carrying an offensive weapon if you use anything at hand to defend yourself. Canes, umbrellas, cricket bats, walking sticks, etc. are perfectly legal to carry around with you if you don't use them for violence. But if you're attacked and you use that perfectly legal object to do violence, suddenly it was illegal to carry.

People dread and rail against the prospect of this country breaking up, but I don't, for two reasons:
1.) Nothing can avert it. We can delay it for awhile if we want to (and most still do), but it's coming - we only have a few decades left, maximum. No need to fret about the inevitable.
2.) I look forward to a day when, without regard to creed, color, or faith, all Americans can salute their flags and know they don't fly over Buttfuckifornia, or Buttfuck York, or Buttfuckinois, or Buttfuckesota, or any if these buttfucked up, buttfuckin' places.

I'm not a fan, but I think she'll stay. The DoJ is peppered with women in many deputy positions and senior level slots. Bondi is also one cabinet member not getting a ton of hate from Democrats. Not because she's weak, (she very well may be) but because she doesn't draw attention to herself and operates on the political plane, not the judicial one. Just my opinion.
I figure a lot of vengeful women in the DoJ could do some serious damage if focused on the right people.

All over the country, mostly in big cities, Judges are allowing criminals with big rap sheets out on their own recognizance/probation or other light sentences to re-offend with often dire consequences for their victims such as with Iryna Zarutska in Charlotte or the little baby in Yucaipa CA murdered from a "father" who had already beaten a daughter horribly leaving her bed ridden with a Judge letting him off with only probation for that letting him then murder his little son.

I see this all the time where a local politician runs on some "feel good" thing and gets elected. The pol implements the "feel good" thing and it causes problems. Hey let's not forget the thousands of angry islamists waving knives and machetes around last summer in broad daylight, not a single one of which was arrested - while the Brit police spent months scouring every resource to find and jail even people who *simply watched and failed to protest the native protesters*
Sadly, the UK asymmetrical disarmament is too complete. They could effectively fight back with a number of methods ... except for the masses of angry machete-wielders the government did not disarm. Sooner or later they're going to have a Rwanda or three there. The only thing that could prevent it is a no-holds-barred intervention from the military and they clearly don't have the stomach (or military demographics, now) for that.
