Sefton: sefton at cutjibnewsletter.com | Hmm: GOP Senators Snuck a Provision Into the Shutdown Deal Granting Them the Right to Sue Over "Arctic Frost" Invasions of Privacy/Weaponization of GovernmentThe GOP did something sneaky that is not at the direct expense of their voters? What is going on? What madness is this? Some may say they engaged in self-dealing here, but I think there's plenty of positive public policy here. We need the Deep State exposed, and moreover, exposed to legal process. Sue. Sue like the wind.A new provision was quietly inserted into Congress's shutdown deal as part of a broader appropriations bill late Monday, giving lawmakers the right to sue the federal government over the FBI's "Arctic Frost" surveillance campaign that targeted Republican senators and conservative organizations. Under the new language, senators whose phone records were seized during Special Counsel Jack Smith's probe into the 2020 election can take the government to court -- and claim at least $500,000 per violation. The move comes after revelations that Smith's team, operating under former President Joe Biden's Justice Department, subpoenaed cellphone metadata belonging to GOP senators between January 4 and 7, 2021, as part of the so-called "Arctic Frost" investigation. "It's designed to put real teeth into federal law that prohibits the executive branch from surveilling the Senate," Sen. Ted Cruz (R-TX) told the Daily Caller News Foundation. "Arctic Frost was a grotesque abuse of power. It was Joe Biden's Watergate." Cruz added that the measure is "a common sense provision to ensure that no Department of Justice -- Democrat or Republican -- ever does that again." Cruz, who said last month that AT&T refused to hand over his records but was barred from notifying him due to a court order, is among several senators whose data were secretly subpoenaed. Judge James Boasberg, then chief judge of the D.C. District Court, approved the nondisclosure orders that kept lawmakers in the dark. The new provision would now make such secrecy illegal, requiring service providers to immediately alert a Senate office if its data is requested by federal authorities. Notably, the measure applies retroactively to 2022, meaning those affected by Smith's subpoenas can pursue damages. ... Democrats, however, were quick to protest the late addition. "I'm shocked that a huge change in policy would be dropped into a bill at the last minute, and the first that most senators learn about it is in the press," Sen. Elizabeth Warren (D-MA) complained. "That's not lawmaking at a way that representatives can be informed."Of course. I know the GOP is supposed to be "against lawsuits" but here's how that's worked out in actual reality: The left writes every law to grant a private right of lawsuit to vindicate left-wing fake "rights," and the right never responds in kind. Meaning the real policy is: Liberals can sue for everything, conservatives can sue for nothing. If we're going to be sued for everything, then I want the reciprocal right to sue for everything myself. "Sue everybody!" as noted Legal Whiner Saul Rosenberg advises. And speaking of Ted Cruz -- and speaking of "Judge" Boasberg -- and speaking of impeachable behavior by left-wing rogue "judges" -- Ted Cruz has scheduled impeachment hearings for "rogue judges," including "Judge" Boasberg, who illegally ordered phone companies to not alert the victims of an illegal search that their records were being illegally searched. Senate Judiciary Subcommittee on Federal Courts, Oversight, Agency Action and Federal Rights Chairman Ted Cruz on Monday scheduled a hearing on the possibility of impeaching "rogue" federal judges. The hearing comes after Republicans complained that some judges have intervened with President Donald Trump's executive orders. Several lawmakers have introduced legislation this year that seeks to curb rogue judges, after multiple judges issued nationwide injunctions on some of Trump's agenda, instead of focusing on the people in the specific case.Yeah I know "nothing will happen" but at some point you just need to start taking shots on goal. ![]() I'm making no factual assertions, but this is the face of a man who volunteers to coach youth soccer because he's a fan of energetic ball-play More:

Political moves are rarely done for pure motives (thinking that is how we get stuck with Massie/Rand types). So I'm fine with this if it signals a new trend to actually do something offensive rather than just reacting to whatever retarded stunts the Dims are doing, which is what DC Republicans usually do.

But it does 'screw us over'. It says they can sue the government for $500k a pop - will add up quickly - and uses taxpayer money. Now if they made it where they can sue the judge personally and collect it directly from the judge I could be more on board with it. Either way, what about all the others, not in congress, who were spied on in similar fashion?

Why? 1. American taxpayers on the hook paying already rich Senators 2. Normal rank and file Americans still can't sue so it's the same 2 tier justice system 3. Can’t recall his name, but the guy abusively/illegaly surveilled with the FISA warrant (to give the cabal ability to spy on Trump et al) had his lawsuit dismissed. The massive systematic abuse of FISA, AFAIK, has not been addressed in any way. And no, whatever additional “safeguards” might have been part of the last FISA re-authorization do not impress, as the issue is enforcement, such safeguards are not self-enforcing. I know JackStraw is familiar with it, but more should peruse the unclas version of the FISA court report to DOJ on the issue (and that report didn’t even include all the coup-related outrages IIRC). And every federal judge along with SCOTUS will say...Nah bro, that ain't happening. there is 150 years of case law that says we can't do that.
Oh and you can't make a law that goes back in time to make something that was legal in the past into an illegal act. That's why people who owned machine guns prior to the 1934 NFA were allowed to keep them. Literally, not a single shred of evidence that any senator was involved in Jan 6.
How could a federal judge, based on zero evidence, nonetheless conspire to issue secret subpoenas for sitting senators? It's bizarre. I honestly think January 6 drove certain people...insane in Washington. These are people who, never once in their lives, had felt the least bit threatened by anything. The slightest taste of fear, even over blown, made them go...nuts. Lose all sense of proportion. And the fear just fed on itself - they just kept getting more and more fearful. To a point where they suspected their friends and colleagues of being part of a large plot to kill them all. That is the only thing that makes sense, because none of the data, the actual events. supports this bizarre behavior. Nobody stopped and said, heh, the executive is about to spy on the legislative branch, based on the say so of a prosecutor and a single judge? I liked the part of folks on our side whining "but what about all the other people targeted?!!"
FFS. Do they have $50k to fund the lawsuit? And a high-powered law firm wanting to curry favor? No? But, you know who does? A pissed off Senator. And besides, can you not at least, for once, for God's sake, enjoy the win that it was our side f'ing over the Dems? And think far enough ahead that, with these Senators doing the heavy lifting, the lawsuit, the discovery, that all the other people targeted suddenly will have their sec 1983 "depravation of civil rights under color of law" suit fully prepped and ready? Jeez. Perpetual whiners. "why are we hanging Dems with a new rope? How come we have to buy a new rope?! We have used rope already. My taxes are sure to go up!" The Dems were locked in "Threat mode" a psychological term. The fight-flight-freeze response, orchestrated by areas like the amygdala.
These are people who have never, in their lives, felt this way before. It led to intense feelings of distress and anxiety, and hypervigilance. They are also extreme narcissists. Hence, they are unlikely to decide what they are experiencing is a form of mental illness, but in fact their fear and hypervigilance is a reflection of actual reality. That explains all the insane behavior since Jan 6 - why they threw the book at the rioters, why they constantly overstate and overhype what happened, the impeachment, and the tapping of phones. Literally their brains are searching for grand conspiracies to explain what happened to them. And they believe it is just about to happen again, despite zero evidence. I think it is more than that - it's a form of mental illness, where narcissists were frightened for the first time in their pampered lives. They are unaccustomed to being scared, and think this is somehow unique and unusual, and extreme. It also justifies ANYHTING to avoid happening ever again.
