In a year of preposterous district court decisions, this one takes the cake: Boardman gave a slap on the wrist to someone who planned and attempted the worst sort of political terrorism, it seems, because of her ideological sympathies. The decision is so potentially corrosive to our civic peace that Congress would be right to consider impeachment proceedings against Boardman... What Boardman did in the Roske sentencing is different in kind from simply bending the law to rule against a disfavored party; she seems to have openly excused political violence on ideological grounds. She did this both in her substantive sentencing decisions and in her given justifications at sentencing... At sentencing, Boardman reportedly was concerned about whether Roske would be placed in a women's prison and given hormone replacement. She wondered openly whether Roske's claimed transgender status should affect his sentence, and why, three years after the fact, Roske is actually a threat to the public. She observed, in the end, that she was "heartened that this terrible infraction has helped the Roske family accept their daughter for who she [sic] is." Boardman even speculated that Roske's terrorism was seeded in the challenges he had being transgender in a religious family. The left-wing terrorist became the real victim once he announced he was a "she."...The government is appealing this sentencing. But it will first be reviewed by the left-leaning Fourth Circuit. Here's the problem: If the Fourth Circuit affirms, then the next appeal is, of course, to the Supreme Court. Justice Kavanaugh will be pressured to recuse himself because he was the target of this psychopathic assassin. And the assassin planned to kill two other justices -- Coney-Barrett and Alito, if memory serves. Conservative justices do recuse themselves when they have a conflict. (Left-wing justices do not.) My prediction is the 4th Circuit reverses and remands for consideration more in line with the sentencing guidelines. I'm not a criminal lawyer, but my read on the sentencing guidelines is that the appeals courts treat them much stricter than trial courts, and require a real compelling reason to downwardly depart. It's not uncommon for trial courts to be too lenient and the appeals court saying "nah."

On the other hand, that Justice very much wants to stay alive (presumably). So I think the Justice has a *right*--a duty, even--to be on the panel to decide the criminal's fate, since the Justice's own life--as well as the lives of his fellow Justices--is in the balance. There is no question she satisfied a substantial step. Voluntary withdrawal and self-reporting are grounds for a downward departure or variance, which is what appears to have happened here. It's asking a lot to go lower when the target was also a judge, but 8 years seems steep given the facts and her obvious need for mental help. “Hey, if you have a lucid moment, realize you need mental help, and stop, you might salvage a lot of a normal life,” would save more lives than an unwaverable maximum sentence. With respect to judges, there might be an argument that candidates and performance are improved by convincing judges that extra steps are being taken to keep them safe. But in general, violence against private citizens is just as bad as violence against the state and sentencing should reflect that.

If it reaches the Supreme Court, and Kavanaugh, Alito, and Barrett recuse themselves, I think it would still likely be at worst 5-1 (with DumDum Brown Jackson the only supporter of the district judge). I don't know what the prospects of appealing a sentencing decision actually are though. I think it's far more likely they decline to review, not because they agree with the sentencing or its reasoning (i would expect something along the lines of "we find this sentence to be ridiculously lenient, and the judge is bad and should feel bad, but we won't/can't change it because of partiality/conflict of interest" if not in the denial itself, then in a concurrence), than that they take the case and let it stand. I don't know what the prospects of appealing a sentencing decision actually are though. I think it's far more likely they decline to review, not because they agree with the sentencing or its reasoning (i would expect something along the lines of "we find this sentence to be ridiculously lenient, and the judge is bad and should feel bad, but we won't/can't change it because of partiality/conflict of interest" if not in the denial itself, then in a concurrence), than that they take the case and let it stand.

Best fish I ever had is the ones I catch and cook within a few hours of being caught. Any super fresh fish is better because fish tends to break down rapidly. I make a mean shore lunch. Step one, catch a couple good size walleyes. Step two, filet. 3 get campfire nice and hot with good coals. Step4. get oil hot in cast iron, throw potatoes in. 5. Dip fish in mixture of egg, milk and salt. Coat in bread crumbs mixed with herbs and spices. Cook for about 8 minutes. Enjoy!

If a sentence is within the guidelines, then it is presumptively ok. But either upward or downward departures from that sentence range requires a district judge to put the reasons into the opinion in writing for appellate review if needed. US is appealing the sentence and the large downward departure stated reason appears primarily due sex change which to this point has never been AFAIK allowed as a reason in federal sentencing. Saying your sorry might get you a low end of the range, but not a downward departure. So it appears the judge is trying to introduce a new characteristic for downward departures. It has been awhile but there is a category for various departures based on family/personal reasons---none of those, to my knowledge apply to difficulties a troon might face in prison.
