A Necessary Adjustment

On Friday, President Trump signed a proclamation regarding reforms to the H-1B visa system. It will be in effect for a year and before it expires, the reforms need to be made permanent - and hopefully made more significant. There are two parts to the changes, which are around fees and earnings. The fees are grabbing most of the headlines.

The Proclamation lays out why the changes are being made, and it boils down to a single word: "abuse." The H-1B system is something of an inversion from its intention. It is supposed to a temporary skilled worker program to allow companies to shore up expertise. The phenomenon - described in the Proclamation and in the press over the past couple of decades - of Americans being made to train their cheaper H-1B replacements is entirely counter to the whole idea. The H-1Bs are supposed to make good money training their replacements in the domestic market. As the Proclamation lays out, one reason this doesn't happen is money, so the money is changing.

As of now, new H-1B petitions will now cost $100,000. This will likely be paid by the petitioner (the employer). This is real money, and helps - somewhat - deal with the problem of employers using H-1Bs to compress domestic wages. H-1Bs are supposed to be expensive, and employers know it. They have just been skirting it for decades. "This guy is really good and has a rare skill set we need" does not equal "this guy is cheap" in any job market I have ever seen. The six-figure fee will help remove the incentive to bring in large numbers of average foreigners to replace domestic employees.

That petition fee is grabbing the headlines, but the much more important part of the Proclamation - though much less detailed - is Section 4:

Sec. 4. Amending the Prevailing Wage Levels.
(a) The Secretary of Labor shall initiate a rulemaking to revise the prevailing wage levels to levels consistent with the policy goals of this proclamation consistent with section 212(n) of the INA, 8 U.S.C. 1182(n).

I have no idea what the new H-1B minimum wage is going to be, but I look forward to seeing what Secretary Chavez-DeRemer comes up with. It will certainly be a lot higher than it is now. The H-1B minimum wage is at least $60,000, and up from there based on region and employer. This is the secret to H-1B preference by US firms: they get them for cheaper. The minimum $60k wage is absurd. It has been in place since 1989. Back then, this was about double the median household income in the US. An equivalent figure nowadays would be closer to $170k. This aspect of the proclamation is of far greater importance than the new flat fee, and is crucial to curtailing abuse.

And a much higher H-1B minimum wage is entirely consistent with the point of H-1Bs. H-1Bs are supposed to have highly specialized knowledge and skill. Such people do not work for peanuts, so why are there so many working for less than domestic labor? Cheating. Or, at least, gaming the system. With a legitimate need for real specialized skills, no employer will bat an eyelash at paying a lot of money for an H-1B who can deliver. He's worth it. If the H-1B is just a cheap drone employed at a lower cost than domestic labor, however, the employer will balk and balk bigly at paying him a significant premium over domestic labor. That's the point.

The Proclamation does nothing to address other H-1B issues, like the easy path to permanent residency or citizenship for those who are here - explicitly and legally - on a temporary basis, but this is a very good start and I want to see how the rest of it shakes out. While this action is hopefully just the start of curtailing the abuses of this program, it is already causing some panic in the foreign country that will see the greatest consequences: India. The English-language Hindustan Times has been publishing more than a dozen articles a day in its H1-B section since the 19th. Before that, it was a couple per week. In decrying the unfairness of it all, one fascinating article accidentally says the quiet part out loud:

An HT analysis shows that the new visa fees of $100,000 announced by Trump is more than the median annual salary of a fresh H-1B visa holder and more than 80 per cent of the average annual salary of all H-1B visa holders.

$100k is more than the median salary of a new H-1B, meaning that the median new H-1B is earning less than $100k. Highly-skilled, in-demand technical specialists clustered in high-tech hubs and a bunch of doctors are earning under $100k? Doubtful. If this is the case, they are not highly-skilled and in-demand, or the vast majority are not in the tech hubs. Based on the concentration of H-1Bs in big tech companies, we know the latter isn't true. The former, then, must be. When taken in aggregate, the median salary of all H-1Bs is around $125k - nice money to be sure, but nothing special in the tech hubs like Silicon Valley.

This is why the barely-defined Section 4 is so important. If it's a legitimate need, no employer is going to worry about paying a specialist what he's worth. No employer, however, will overpay a mediocre or even bog-standard foreign worker premium rates. If that is corrected, it is going to curtail a lot of abuse that harms American professionals. Depending on what the adjustments pursuant to Section 4 end up being, it has the potential to do more to reduce the abuse of the H-1B system while permitting its legitimate benefits than reams of new legislation.

Plus...PLUS...the base salary requirements are going through an APA change that will raise it from $60,000 to $150,000.

So, if the $100,000 is amortized over 3 or 6 years (I've heard a few things) instead of just each year, it still represents a massive, massive increase in cost.

Hello,

Thank you for all of the kind wishes and prayers for John last week. They mean so much.

We still don't know what happened. I can't shake the feeling that I failed him. He'd be the first to say that I didn't, but he's not here to say it now.

He was cremated and we had a private remembrance. Over the weekend I took him to Spruce Canyon at Rocky Mountain National Park. He’s now near Stone's Peak. I'm sure that I was supposed to get a permit or something but I really don't give a shit. John certainly wouldn't have. So every year I take a week to go solo backcountry hiking somewhere. This will now be my annual trip.

I saw a few questions about donations in John's name. I think he'd just want us to be supportive of each other. And drink. Especially drink.

I’ll pop in occasionally here. I still think you all are weird but you also turned out to be wonderful when it counted. Thank you.

They would get out in the parking lot for pickup games of cricket, much like American kids playing baseball in the back yard. It was all fun and games until the bowler lobbed a ball through my living room window. Called their landlord and he was down in minutes and confiscated their bat. Much "but suh, we were only...". 59 Acetaminophen is definitely hard on the liver but used occasionally it is a very useful pain reliever , especially for those who can’t tolerate NSAIDs.

What most people don’t know that don’t take them , is a lot of the opiate medications contain acetaminophen which I think part of the reason is to prevent overdose because it’s known that too much acetaminophen can be deadly.

Donald has been pursuing the soft landing approach - it's probably why he waited til after college drop dates for announcing H1-Bs...keeping the foreign students tuition paid for the semester, even as they realize the ease at which they were taking STEM jobs from Americans has now slowed.

Note - Quest (the blood folks) had denied my daughter for every job sight unseen for the last 5 months. Even the lowly lab tech ones. After the announcement yesterday, they contacted her directly about 5 openings. This was a 1st. So, it's not just tech that was probably abusing these to the max. She's not looking or responding to them right now, but might think about it in a year...but it's funny to go from the uber-rejected to now the uber-sought...

And the current fee is about $800, so this represents a massive new cost.

What Trump is doing is changing the incentive structure which forces Congress to change along with it. Like the new H1B policy---suddenly cheap labor H1B lobby has been kneecapped which in turn leads tech and finance to start considering US employees again, etc.

148 The H1B stuff is a good start. Next phase should include lots of disincentives for keeping H1B employees, like
- any company that got one is *not* allowed to apply for the next year's cycle
- any company that wants to extend a H1B has to provide extensive documentation and proof that an American is being trained to replace that H1B, and will be watched like a hawk to make sure that happens
- any extension past three years with no American replacement the fee goes up 10x
- any company that claims they need H1B employees has to provide positive proof that NONE of the applications from US citizens match the job, list the requirements missing, and then show they are training existing employees to meet those missing requirements. Even if they don't HAVE any H1B at the time.

Once every three years. H1B is a three year allowance with one renewal allowed at the three year mark. With the increase in base salary to 150k, that makes H1Bs have to be something like 183k before benefits per year cost to corps. Above the median tech salary in US of 171k so screens out the cheap labor bullshit.

Price floors and price ceilings. Trump just set the price floor for H1Bs above the median salary of tech workers which disincentivizes using H1Bs as a source of cheap labor.

Even if over six years, not applying at renewal (which...no...it's a new petition, but just for the sake of argument), it's a $16,000 per annum cost which combines with the $150,000 salary floor to make it $166,000 per year to hire a new H1-B vs. the minimum of $60,000 plus the $800 fee.

That's still nearly a 3x jump there with the $100,000 fee amortized over six years instead of three.

50 people are involved in writing the laws and rules. The end result reflects 50 different views on exactly what it should say. Just on the example above, what's a "US employer"? Company based in USA? Headquartered here? Incorporated here? Or just any employer that has any operating here at all?

Similarly, what's "employee on their payroll"? Is there something different between an "employee" and someone on the "payroll"? What about contractors who work for the company but aren't technically employees?

They had to escalate the case all the way to the personal office of someone on the Hill. Immigration was part of my responsibility but not the case-work. It was ridiculous. The guy was a middle-aged expert who going to be here for a year. The equipment was state-of-art leading tech of the time. Nothing similar was made in the US.

Result was a letter from the boss and his state colleague to the INS commissioner. For one H-1B that was a slam dunk (he got it). So to see what has become of the program .... amazing. A stark illustration of civic decline and corruption.

IT execs saw this as such a steal they openly declared they could have the Russians write the code twice and it'd still be cheaper than the in-house developers. My last contract job, I worked for an Indian group that does a lot of contracting in the US, a lot of H1Bs but they can't use them where I was at because of ITAR.

So I went though an entire screening by a bunch of people involve in the H1B industry.

They were, to a person, incredibly stupid and arrogant to boot. They had no idea of what an American expected was everyday courtesy.

It was hard to take. I had a swarm of them calling me over a span of two weeks telling me different things to do and wanting me to email them something new so that they could say they were involved in hiring me.

Feeding frenzy.

I actually thought the job was BS until the Indian manager at the actual company called me for an interview.

After having worked 23 years in SAP IT Functional Consulting/Bus.Analyst work, the program needs to go and the H-1B workers need to TRAIN/KNOWLEDGE TRANSFER to American citizens and leave the country.

Then we can take a look at any VERY RARE specialties to get to Mars, or beat China in the AI race.

Also, H-4 needs to end also.
