Revealed: Emails Showed that White House Staffers Scrambled to Find a Justification for Printing Up "Pardons" the "President" Didn't Even Know About

Unfortunately, the one pardon he signed was for Hunter.

But the rest might be challenged. (Though I have no idea how that would work.)

President Biden's sweeping clemency grants during his final days in office caused concern inside the West Wing and Justice Department about how to ensure his wishes were accurately implemented -- and it's unclear whether Biden himself was consulted before thousands of pardons were announced, internal emails obtained exclusively by The Post show.
The messages indicate the 46th president orally approved commutations for inmates jailed for crack cocaine offenses on Jan. 11 -- but his auto-penned signature wasn't affixed to three documents listing about 2,500 recipients until the morning of Jan. 17.
The debate over who exactly to include in the mass pardons and how to modify their sentences came to a head late on the night of Jan. 16.
Then-White House Staff Secretary Stef Feldman, a key gatekeeper of the presidential autopen, wrote to West Wing lawyers she needed evidence Biden had consented before she authorized a mechanical signature on one of the most sweeping acts of clemency in American history.
"I'm going to need email from [Deputy Assistant to the President] Rosa [Po] on original chain confirming P[resident] signs off on the specific documents when they are ready," Feldman wrote to five other Biden aides at 9:16 p.m.
Six minutes later, deputy White House counsel Tyeesha Dixon, one of the email recipients, forwarded the message to Michael Posada, chief of staff to the White House counsel's office.
"Michael, thoughts on how to handle this?" Dixon asked, adding in reference to the documents authorizing clemency: "He doesn't review the warrants."
"Ok talked to Stef," Posada replied to Dixon at 10:06 p.m.

"We will just need something from Rosa once the documents are ready confirming that the 21 people commuted to home confinement are who the president signed off on in the document titled X, and the # individuals listed in document titled Y are those with crack powder disparities who the president intended to commute," he wrote.
"Basically, something from Rosa making clear that the documents accurately reflect his decision. If you can give me a blurb whenever they are ready to suggest to Rosa, I can pass along."
The mass clemency was announced hours later, at 4:59 a.m.

We have no evidence Biden was ever actually consulted -- and some evidence he wasn't. Note the time the "pardons" were announced -- five in the morning.

The exchange took place well outside of Biden's known regular working schedule -- with White House aides leaking to media outlets months earlier that the Democrat was at his best between 10 a.m. and 4 p.m. on any given day.

It's unclear whether Biden actually gave the final go-ahead as Feldman requested Jan. 16, but the emails suggest that aides instead incorporated Po's attestation of what he "intended" to do.

The ex-president's public remarks since then indicate he was not aware that only three documents were required for the roughly 2,500 commutations.
He told the New York Times in July that autopen was used to sign clemency warrants "because there were a lot of them."

In other words: Biden is claiming that "three" clemency warrants is "a lot" and that's why he didn't review each of them.

He clearly is not aware that there were only three warrants he had to review. Each of these warrants set free hundreds of criminals -- and that's his confusion showing. He think that each criminal had his own warrant.

They didn't. They were batch-exonerated.

And Biden is completely unaware of the three (just three!) documents he's supposed to have approved. He thinks there were hundreds of them.

I mean, the path is there, it's just not likely to lead to the overturning of pardons because I don't think that's something SCOTUS wants to deal with. Inertia wins.

Doesn't that "fix" the whole thing without needing to establish a paper trail? I don't see how the legal process to nullify any pardons or prosecute staffers for using the autopen on pardons progresses after such a statement.

I think it would require a constitutional amendment.

The president's power of pardon is plenary and complete in the constitution. Any effort to challenge it now relies on proving that it wasn't him doing it, made more complicated by the accepted use of the autopen.

That is interesting. I would assume that the DoJ would have to arrest one of them and present them to a judge for arraignment. The defendant would then have to invoke the pardon, which the prosecution would have to challenge as invalid. The district court would hold a hearing as to the validity of the pardon. Whichever decision the district judge makes (my guess would be to uphold the validity,) would be appealed and the Circuit Court will uphold the district court and the Supreme Court will punt on the whole escapade because Roberts is weak.

And, yes, I understand there are valid pardons that undo mere political partisanship due to corruption in law enforcement and the DOJ. But, the focus shouldn't be on the individual. It should be on the system.

Alternate to 33 above would be to actually indict and convict one of the White House staffers who ran the autopen, (it sounds like a form of forgery to me.) That still leaves open the question as to which pardons were invalid, but I would think a forged pardon would automatically be null and void just as a forged check would be.

It's not that an autopen was used. It's that Joey Shithead wasn't making the decisions on who to pardon, did not knowingly approve of the decisions that were made by someone else, and had no idea these decisions were made.

During the Mar-a-Lago raid kerfuffle, some of us were pretty quick to point out that the President has the authority to declassify documents just by stating they were no longer classified. My personal belief is that pardons would work the same way, no signature needed.

Obviously I am off on a tangent here, because the issue is that Biden was unaware the pardons were being issued and probably didn't even know the people being pardoned even existed, so he could not have stated he was pardoning them.

Scotus under John Marshall allowed massive corruption to stand where the GA legislature was bribed to give companies state lands to the MS. Yazoo Land Fraud--GA's new government elected after the scandal broke, rescinded the sales as illegal, Scotus disallowed it in Fletcher v. Peck as basically a deal is a deal even if it was corrupt. They claimed it was on the basis that innocent people purchased the land from the companies that bribed the GA government so good faith existed to protect that contract so the titles should stand.

Nope as a matter of law and practice. Possibly a public oral statement in public by the president himself filed on record could suffice for a pardon but the difficulty would be going through the myriad bureaucratic processes on such things as buying a firearm or working in a regulated industry (alcohol etc.) requiring a clean record. How would you prove it? So as a practical matter, pardons and commutations require some sort of documentary evidence that the bureaucrats can use as justification to remove the criminal convictions and the ancillary disabilities/consequences of the crime.

If those seeking commutations sought them without their own misconduct (bribes, etc.) then my guess is Scotus will uphold them as innocent and thus valid communtations and pardons and in a vigorously strong opinion placing the blame solely on the functionaries around Biden junta.

It seems wrong but you have to demonstrate just what laws were broken by the aides and while I haven't researched it, my guess is that there is not such crime as usurping the power of the president. That leaves process crimes--obstruction, lying, in the investigation itself for aides. Possibly bribery either directly or through third parties if that can be established. Any type of quid pro quo of pardons for benefits to the aide brings in the honest work charges. That might be acceptance of non monetary help such as jobs, etc. as well post presidency.

Not "slumming" I was on rotation at the Box for two weeks, and have had to run back and forth my Dad (with Alzheimer's) is either dying or he is not he was hospitalized for 3 weeks with liver cancer markers off the charts, an inflamed gallbladder, and a broken foot. He is also tough as nails and unable to cooperate in his own care. I am glad he is up and ambulatory now, and hoping if/when they yank his gall bladder they will know whether he has liver cancer. a Test that is troubling at 15 was at 387 and rising.

A few years ago the charter school my kids were at was planning a "student led" protest like this after Parkland like this after Parkland. I got wind of it and sent a firm letter, to say the least, to the principal and son's teachers informing them my they were not to move out of their seats when said protest was planned and that I would check with them afterward to make sure or there would be hell to pay for using them in their political stunt. I got a couple other parents to do the same.

The "student led" protest ended up being cancelled. One small victory for sanity. (Note: charter schools are often just as woke or worse than public schools)

That dearth of statutory provisions may be cover for the aides who were involved in the "usurping the power of the president," but I think it is a relatively simple theoretical matter of whether the pardons are valid, if the POTUS did not act upon or approve a subordinates acts upon the pardon that lead to the use of the autopen.

Practically, however, is a minefield, which is why I believe nothing will be done, except Trump publicizing the problem of unauthorized use and pardon grants.

Yep. Good summary of what the Founder's thought. Pardoning and commutation power is designed to be a circuit breaker for the ordinary processes of the law. Thus, the Founders followed the unconstrained power of pardon and commutation given to the kings of England. No magic formula to follow (and due to separation of powers cannot be constrained by Congress or courts) because it is a plenary aka absolute power of the executive.

A few years ago the charter school my kids were at was planning a "student led" protest like this after Parkland like this after Parkland. I got wind of it and sent a firm letter, to say the least, to the principal and son's teachers informing them my they were not to move out of their seats when said protest was planned and that I would check with them afterward to make sure or there would be hell to pay for using them in their political stunt. I got a couple other parents to do the same.

The "student led" protest ended up being cancelled. One small victory for sanity. (Note: charter schools are often just as woke or worse than public schools)

TJM, the pardoning and commutation powers come directly from the royal power in the UK and are interpreted as such. Basically a plenary power unconstrained by Parliament, ministers, or practice. Because the main focus on rights is making it difficult to put people into prison, commensurately, the power of circuit breaker over what the legal machinery wrought, plus the need to quell unrest en masse, meant that kings could simply order it to be so however they wished, speech, orders to underlings aka delegation, etc.

The formalized stuff was needed later more as documentation to the individual that their records had been expunged, not as a constraint on the pardoning power.

Ah, you are arguing that the president cannot delegate. Well, back in the days of regular unrest in Merrie Old England, often the local magistrates would literally issue pardons and other public declarations in the king's name by public proclamations and such.

And it is patently unclear whether the king simply preauthorized his minions with this power or simply delegated them the right to stop mini uprisings without day to day coordination with teh Crown.

But unlike the US limitation on things like general search warrants (with those limitations now more or less defunct with modern technology), they never got around doing that for pardons and commutations. The Founders were more concerned about the justice system rendering injustices to people to keep them locked up or worse rather than limiting release of bad characters back into the public.
