Sefton: sefton at cutjibnewsletter.com | The Morning Rant: Minimalist Edition![]() President Donald Trump's administration has sued multiple states and localities for allegedly violating the Constitution by hindering federal immigration enforcement. These areas, known as sanctuary jurisdictions, have policies or practices that prohibit cooperation with federal authorities in enforcing immigration laws. Trump has ordered the federal government to prepare for defunding these places, but hit a block after multiple jurisdictions filed lawsuits. According to the Trump administration, the policies violate federal law and the Supremacy Clause of the Constitution, which essentially says that states and localities must abide by federal law. States counter that the federal government can't commandeer or force them to use their resources. Those are both rational points, and they compete only partially. But the real question is: Are the states entitled to federal law enforcement funds if they refuse to cooperate with federal law enforcement, and are they entitled to federal education funds if they continue to teach CRT, allow transsexuals to compete in girl's sports, and allow them in girl's locker rooms and bathrooms? Because that is the club with which the federal government can beat California and the other blue states (currently in insurrection!). I look forward to watching California increase its tax rates by 50% to replace lost federal dollars. Then Governor Hair Gel can look presidential by standing up to the ORANGE MAN BAD! And he can run in 2028 on that platform. "I destroyed California's economy to protect rapist wetbacks!" [Crossposted at CutJibNewsletter and X/Twitter]. I see Newscum invited members of his "nonpartisan redistricting commission" to his rally on how to more gerrymander CA.
Now, the irony is the blue states are already heavily gerrymandered so if the rest of the red states follow Texas's lead we could be back to having a more normal distribution of house seats. But the question is are they? Posted by: 18-1 at August 21, 2025 11:05 AM (sKqQm) 10

No doubt the answer to this question depends on the wording of the funding bill. If the law says that Cali shall be given a brazilian dollars then they're gonna get the money. If, as is more likely, the law says that the Secretary may award money to Cali - on the assumption that it's pretty much a rubber stamp - then it can be held back. OTOH, states aren't just not cooperating, they've actively hindering the enforcement of federal law. The answer to that is either to declare them to be in rebellion or just start arresting Governors. I would say that if local/state law enforcement doesn't want to cooperate with ICE, that's one thing. Fine, don't participate, sit it out.
But it's quite another thing for them to actually hinder ICE. That's where I think the Feds could hammer them. But, I'm just a lowly paralegal. Not an attorney. Posted by: Bulg at August 21, 2025 11:07 AM (77rzZ) 16

I don't think it has to be a broad question. It's situational. Without any doubt whatsoever the Federal Government has absolute control over immigration. It just does. Federal enforcement actions centered around that arena are valid, even over the objections of the relevant states.
When it comes to internal issues however, esp 2A (as you mention) or 10A etc issues, state disobedience is understandable if not reasonable. Posted by: WitchDoktor at August 21, 2025 11:08 AM (PzXaK) 26

This gets back to the idea of: can we coexist with these people. The entire point of letting each state do it's own thing was the idea that since movement was free between the states, each state would be evaluated and each would be a lab for what it wanted to do. If that worked either people would move to that state or another state would take up the same, successful policy (probably what the founders intended.)
Instead, we have this nightmare scenario where California imposes it's will on the rest of the country through environmental regulations or health codes regarding ingredients and due to the nature of the market being all one thing gets imposed on everyone. Whether it is successful or not. This is tyranny of the majority in the worst sense. 60 An obvious first step is to cut off Federal highway money to any state that issues driver's licenses to illegal aliens.
Fun fact: driver's licenses for illegal aliens was on the ballot in Oregon in 2014. It was voted down 2-1. The Oregon legislature legalized driver's licenses for illegal aliens in 2019 anyway. Posted by: The ARC of History! We need some red states to makes noises about not honoring Oregon driver's licenses due to the high liklihood of fraud involved in allowing the "undocumented" to obtain them. Could happen here Posted by: LinusVanPelt at August 21, 2025 11:25 AM (Dywz5) That was always the Dem strategy, in a sense. The party apparatchik are elderly leftists, whose power base is grounded in far-left territories like SF. They always got the large majority of Dems to run as centrists, so when they inevitably got elected the apparatchiks would leverage the 'centrist' numbers to put forth far-left policies - like Obamacare. The difference now is that when Biden cheated his way into power off the back of the COVID lockdowns, they (and the GOPe) thought that Trumpism was vanquished and could now rule untrammeled - the masks can now come off. When Texas tried to unilaterally wall the border and control illegal immigration, they were shot down because that is specifically the province of the federal government. Sanctuary cities and states do essentially the same thing, but claim a moral high ground and ignore the supremacy of the federal government on this issue just because. One wrote that James exceeded her legal authority in bringing the suit, saying that if any of Trump’s lenders felt cheated, they could have sued him themselves, and none did. No, and it goes beyond that, too.
For example: Medical (Medicare/Medicaid; CHIP; extreme Special Education costs, PT/OT, psychological assistance and related medications provided in some regions; "luxuries" such as dental and eye glass that many citizens pay out-of-pocket for without assistance). WIC covering family members beyond the young. Housing (heavy subsidies and then 'investors' snap up entry level/starter home/senior properties). Public Transportation; see PA's out-of-hand SEPTA system from which funds are also steered to into AMTRAK). Many food warehouses, distribution centers, etc. It's not necessity but a free-for-all and 'careers' in collections in some areas of some states. State Insurance costs increasing - homeowners, vehicular, worker's compensation, disability. State workers salaries, many of which are very substantial. State Legislature salaries. (See PA in both cases.) Of course, there's more but as long the the Federal government foots the bills in whole or part & improper redistricting takes place, costs will NEVER be reigned in. A local jurisdiction saying, "We're not going to expend resources to help the feds," is fine, I think, legally and constitutionally. Cities are not extensions of the federal government.
However, it's when they start giving benefits to illegal immigrants that I think is where there are actual legal problems. Posted by: TheJamesMadison I beg to differ, sirrah. Posted by: Gen. William Tecumseh Sherman at August 21, 2025 11:57 AM (mlg/3) 236

What amounts to obstruction, though?
Refusing to honor an ICE detainer, is that obstruction? I'm not sure it is. -------- Perhaps not, but its a dick move. And I wish that we were willing to go both-sides-of-the-fence with our dialogues with the American public. Let the President lead with bombast and contempt, but we also need some more logically toned members of the administration pointing out that if you're elected by a city, county, or state to a position of "law enforcement" and you're notified by the Feds that they have a pending "law enforcement" concern for an individual, its really a dick move--both to the Feds and to the *constituents that elected you*--to respond by ignoring the Federal request. I'd rather there not be the power, but Republicans refusing to use the power has just gotten us to the point where Democrats exclusively use it.
We're not going to improve the situation by sitting back and waiting for Democrats to regain their good sense. Will we get back to the powers being reduced through tit for tat? I don't know. I suspect not. I also know that we won't get back to the powers being reduced by letting Democrats run around with handguns. Posted by: TheJamesMadison, searching for thrills with John Frankenheimer at August 21, 2025 11:53 AM (GBKbO) The Dems brilliantly used political jiu-jitsu against the Republicans, by playing to their 'conservative' billing. While the Dems could be as activist as they liked (as is their wont), at the same time the bulled the Reps into not using activism to roll back the Dem gains, forcing them to use 'conservative' methods to roll them back instead - which never work. Dems used 'stare decisis' and the fear of radical activism against Reps, to great success. The great triumph of Trump is that he broke that failing mindset. If you want to MAGA, you need to cut the Gordian Knot with a sword, not unravel it fiber by fiber. Posted by: Darrell Harris at August 21, 2025 12:04 PM (fDCYj) 265

Trump's plan is pretty clear:
1) Stop the inflow (done) 2) Deport the criminals (working on it) 3) Make being illegal in the U.S. untenable. 4) Make going home easy. My guesstimate is in six months, Trump has deported 200,000 and will likely deport 500,000 by the end of this year. Drop in the bucket of the 20 million Biden let in. BUT. my guess is about 2 million will self deport - they can't make money, can't risk going out. Can't get benefits. But that assumes there isn't a "preference cascade" - in a year, when illegals have burned through their savings, and people get tired of supporting them, you'll see a tidal wave of self-deportation. You could see 15 million leave. One last tiny bit - Trump needs an EO that says, if you haven't been convicted of a crime, don't have a deportation order, and leave voluntarily, and speak fluent English, you'll be readmitted LEGALLY after six months under an expedited system. And announce a tax on remittances. Oh, and 100% confiscate all assets for anyone you arrest for being here illegally. You'll get every illegal out the door in no time. He could solve this thing in four years. Posted by: El Mariachi - Attorney at Law at August 21, 2025 01:28 PM (gDhA9) 288
