Appeals Court Overrules Partisan Operative "Judge" Boasberg, Rebukes Him For "Overstepping His Authority" When He Presumed to Hold Trump In Criminal Contempt

🚨BREAKING: The United States Court of Appeals for the District of Columbia just vacated radical activist Judge Boasberg's order holding the Trump admin in criminal contempt for deporting illegals using the Illegal Alien Enemies Act.

Boasberg embarassed. Deportations march on.

Two Trump judges overturned Boasberg's attempt to arrest Trump officials. One Obama judge dissented (of course).

The Trump judges found that Boasberg lacked authority to continue his judicial witchhunt. They also found him wrong on the legal merits. Boasberg is claiming that his ambiguous order should be read in a certain way, and by that reading, Trump officials acted in contempt. The judges on the Appeals panel found that the abiguous ruling could be read either of two different ways, and by one reading, the Trump Administration obeyed the order.

They also note that Boasberg is attempting to conjure a contempt charge out of the facts of a confusing and quickly-changing situation where the facts were unclear (as was his corrupt ruling).

The 2-1 ruling in President Donald Trump's favor will likely go to the full court for review, or be appealed directly to the Supreme Court

The U.S. Court of Appeals for the D.C. Circuit ruled 2-1 Friday that U.S. District Judge James Boasberg cannot move forward with possible contempt proceedings against the Trump administration.

The case involves the administration's alleged violation of an emergency court order blocking the administration from using a 1798 law to summarily deport hundreds of Venezuelan migrants to El Salvador -- the latest in an evolving, high-stakes court clash that has played out for months in various courts.

Judges Gregory Katsas and Neomi Rao, two Trump appointees on the majority-Democrat bench, sided with the Trump administration Friday in blocking Boasberg's contempt motion from moving forward.

Judge Nina Pillard, an Obama appointee, dissented.

"The district court here was placed in an enormously difficult position," Katsas said Friday, writing for the majority.

"Faced with an emergency situation, it had to digest and rule upon novel and complex issues within a matter of hours. In that context, the court quite understandably issued a written order that contained some ambiguity."

"Regardless, the government's initial implementation of the proclamation clearly and indisputably was not criminal."

The long-awaited ruling comes months after Boasberg ruled that the court had found probable cause to move on criminal contempt proceedings after he issued a late-night temporary restraining order on March 15 blocking the Trump administration's use of the Alien Enemies Act to summarily deport certain migrants to El Salvador.

Boasberg had also ordered all migrants to be "immediately returned" to U.S. soil, which did not happen.

Despite the order, hundreds of migrants were deported to the Salvadorian prison, CECOT, in March, where they remained until late last month, when they were sent from the prison in El Salvador to Venezuela, as part of the prisoner exchange.

Although the opinion does not state this explicitly, the gist seems to be: Boasberg, you rushed to involve yourself in this matter without bothering to fully appreciate the facts or the law, and you wrote a sloppy, rushed opinion which was open to multiple interpretations. You can't pick and choose which parts of your ruling are "real" and you can't claim that your sloppy, ambiguous opinion only had one interpretation. It has multiple fair interpretations, and you probably could have cleaned it up to be enforceable if you weren't in such a mad partisan rush to Get Trump.

yeah I was just reading the opinion about that. He gives conflicting orders, one of which is verbal and cannot be enforced as a TRO because they must be written, and then hasl Trump guess which order is the "real" one.

I figure it should be almost routine, probably 2 or 3 every few years. At least until they get their head out of their ass. Congress has abdicated their duty in myriad ways, and this is one of them. The judicial branch itself should guard zealously their reputation and trust.

Boasberg made these ruling WITHOUT having anyone in the Trump administration in court, at all, mere hours after they were filed with the court. He then made excuses that the Trump Administration would not follow court orders anyway, despite having no basis for his belief. Then he acted on his baseless belief again and again in litigation over which he was presiding. He pushed the compliance hearing BEFORE the hearing on the administrations motion to vacate. A huge no-no.

His ambiguous ruling could have been clarified if the Trump administration was even allowed in the courtroom when it was made. He would have made his ruling, and then the Trump admin would have asked questions to clarify it or provided information that would clarify it. It all could have been avoided, and the results are all on his decisions.

The Supreme court VACATED his TRO - meaning the order doesn't exist, legally. Despite that, Boasberg says the administration is in contempt of the order. It's insane.

needs to be removed from the bench, pronto. Or at least blacklisted from any sort of cases involving the trump administration.

The Texas Governor does not have the power to vacate legislative seats for any reason. Never has. What he CAN do (and is beginning to do) is to file a motion with a district judge for that judge to issue a ruling that the seat has been vacated - we'll see how good his judge shopping skills are. Could be done quickly, or could take 6 months if the Judge doesn't want to play. That would most likely be appealed, of course.

I know of one person who had scar tissue from birth. While he was very smart, his Apgar score was initially low...and some unknown tiny burst blood vessels. Then a grand mal seizure in college from the scar tissue. He had no issues as an infant or child.
