Supreme Court Okays Trump's Restructuring of the Department of Education, Clearing the Way for 1,400 Firings

In a significant victory for the Trump administration, the Supreme Court ruled in favor of President Donald Trump's push to overhaul the Department of Education, allowing the termination of nearly 1,400 federal employees. The decision clears the way for Trump's long-promised effort to rein in what many conservatives see as a bloated, unaccountable bureaucracy that pushes left-wing agendas.

In an unsigned decision, the Supreme Court temporarily set aside a lower court's ruling that had stopped President Trump's plan from taking effect. This means the plan can proceed for now, even as the legal battle over it continues. Three liberal justices opposed the order, and the court halted an order from U.S. District Judge Myong Joun in Boston, who had blocked the layoffs and challenged the overall plan. Judge Joun warned that the layoffs "will likely cripple the department."
However, a federal appeals court declined to pause his order while the administration pursued its appeal.
Justice Sonia Sotomayor argued that the majority effectively gave Trump the authority to undo laws passed by Congress simply by dismissing the employees responsible for enforcing them.

Sotomayor's dissent: The Supreme Court must impose a no-firing rule on federal bureaucrats, forever. Once a Democrat hires them, they can never be let go.

On Friday, State Department "workers" applauded each other as they were escorted from the building.

Note that Trump is mostly just rolling back Biden's hiring bonanza.

1) It sure looks like she basically copied the brief of the plaintiffs; the first 11 of the 19 pages are merely a recitation of the factual stance and history of the suit. Much of the rest of the dissent repeats that.
2) There's one cite to the Constitution; the Take Care Clause. Zero cites to any caselaw discussing that clause. For good reason.
They have to avoid the key holding of the seminal case: Unless Congress specifically directed the Executive how to act, with no discretion, then the courts have no authority to review. Which also includes not spending the money.
3) She, once again, whines about granting Trump emergency relief. Contra her own eagerness to grant emergency relief against Trump.
4) That the 6-3 majority, once again, does not write an opinion, is to me another in a long line of " we're getting real tired of this shit."
5) reading between the lines of "why" the majority didn't is the glaring, "because you wrote a shit-ass ruling, with multiple jurisdictional, precedential, procedural and constitutional defects--fix it." Which Soto tries to band-aid.

I was laid off one time as a RN. From a great job created for me, paying very well with bonuses, on my youngest son's 10th birthday. It was done sort of semi-nicely, and the reason was not mine because MD's and ARNP's were also laid off with me due to finances of the leader going kaput. I had a few tears in my car as I drove home. Mostly because we had just signed a contract to build a new house. However, being a redneck who rarely cries, I got it together for my baby's birthday and they saw no tears at all. I drew unemployment for that summer where we hit the beach and I self taught myself watercolors. I then got a new job and life went on to better things (eventually, to much better jobs).

I cannot believe, or, rather, yeah, I do believe the drama as they are all about wailing, tears, snot and drama. Get it together! I'd be at the end of the clappers slapping them and telling them to man up! Twits!

176 As I've been noting from the beginning, when the left stated this New, Improved and Novel reading of the Take Care Clause, what they are arguing is that the Executive is a subservient branch of the Legislative, not a co-equal part of the government.

Their view is that the Executive must "take care" that the laws passed by Congress be followed as they enacted--not just the letter but the spirit.
Not a Chief Executive, but a Chief Administrator.

But that' not at all what "take care" means in the Constitutional context.
It means, roughly, that when the President acts, he must act according to and within the Constitution and the statutes.
No more.
But that also includes "not acting."
Because, unless the law is "the President must do this specific thing in this specific way--and no other thing and in no other way" then Congress has given the Executive the discretion to act and, pretty much anything he does will then be within the Take Care Clause.

Our problem is many government employees feel they are an entity unto themselves, and not subject to the chain of command.

Even so, if our leaders are not willing to utilize the tools available we will have serious problems. Only rarely has the McCarren rule been invoked afaik.

A fed worker, every day, when he got off work, would head out to the highway, set the cruise control and stay in the left lane.
And refused to move or adjust speed.
Millions of manhours in delays, thousands and thousands frustrated and angered.
And he did not give a fuck

Look at the railroad employees on all three regional commuter rails.

Infuriating. There's some kind of New Deal era federal railroad fund that all of the conductors on Metro North and LIRR (and I'm sure NJ Transit) draw funds from when they retire as "disabled" from work-related back problems some hack doctor will say they have.

There was a crackdown a few years ago after the NYPost took pictures of some of these disabled railroadmen golfing with their employee discounts at public golf courses.

But still...
