Supreme Court Okays Trump's Restructuring of the Department of Education, Clearing the Way for 1,400 Firings

In a significant victory for the Trump administration, the Supreme Court ruled in favor of President Donald Trump's push to overhaul the Department of Education, allowing the termination of nearly 1,400 federal employees. The decision clears the way for Trump's long-promised effort to rein in what many conservatives see as a bloated, unaccountable bureaucracy that pushes left-wing agendas.

In an unsigned decision, the Supreme Court temporarily set aside a lower court's ruling that had stopped President Trump's plan from taking effect. This means the plan can proceed for now, even as the legal battle over it continues. Three liberal justices opposed the order, and the court halted an order from U.S. District Judge Myong Joun in Boston, who had blocked the layoffs and challenged the overall plan. Judge Joun warned that the layoffs "will likely cripple the department."

However, a federal appeals court declined to pause his order while the administration pursued its appeal.

Justice Sonia Sotomayor argued that the majority effectively gave Trump the authority to undo laws passed by Congress simply by dismissing the employees responsible for enforcing them.


Sotomayor's dissent: The Supreme Court must impose a no-firing rule on federal bureaucrats, forever. Once a Democrat hires them, they can never be let go.

Note that Trump is mostly just rolling back Biden's hiring bonanza.

Mostly because we had just signed a contract to build a new house. However, being a redneck who rarely cries, I got it together for my baby's birthday and they saw no tears at all. I drew unemployment for that summer where we hit the beach and I self taught myself watercolors. I then got a new job and life went on to better things (eventually, to much better jobs).

Our problem is many government employees feel they are an entity unto themselves, and not subject to the chain of command.

Even so, if our leaders are not willing to utilize the tools available we will have serious problems. Only rarely has the McCarren rule been invoked afaik.

Another was (I think fire dept.) they would go on disability as well and get FULL triple salary for life. No injury required since the bosses signed off on everything.

Look at the railroad employees on all three regional commuter rails.

Infuriating. There's some kind of New Deal era federal railroad fund that all of the conductors on Metro North and LIRR (and I'm sure NJ Transit) draw funds from when they retire as "disabled" from work-related back problems some hack doctor will say they have.

There was a crackdown a few years ago after the NYPost took pictures of some of these disabled railroadmen golfing with their employee discounts at public golf courses.

But still...

Now that public sector jobs are paid better, it's only fair that they have less job security than the public sector. I propose that every year, 5% or so of the government staff should be fired based on a random lottery.

A dodge I heard in CA was to retire, do the triple dip to get a huge pension then get rehired as a consultant to do the same job for even more money, plus pension.
