The Morning Rant: Minimalist Edition

Anyone who trusts the government to respect his privacy and his rights is a fool. And all governments (federal, state, local) are the same...an insatiable desire for power and control and -- this is the big one -- knowledge of our innermost secrets, or how many garbage cans we fill each week. It doesn't matter; they want it all. Every bit of data that describes us!

Medical records and toll records and what we buy and banking data and how any people live in our homes and who we call and what websites do we frequent and....

They can build a complete record of our lives with enough of that data, and the vast majority of it isn't anyone's business but our own!

However, when the federal government funds a welfare program, it is entirely reasonable that they have access to at least some of that data about the recipients, because that is our money, and the federal government had better be damned diligent in minimizing misuse and outright theft.

Why? Because if you take a handout from the government, you lose privacy. Sorry, but that is just the way it is. I have no idea why the expectation of privacy extends to those who are willing to give up their autonomy and accept assistance from the public.

Trump knocks down barriers around personal data, raising alarm

On May 6, the U.S. Department of Agriculture asked states to hand over the data of 42 million people receiving SNAP benefits, including their names, dates of birth, social security numbers and addresses. This request is currently paused amid legal challenges.

Sorry, but I just don't give a sh*t that some SNAP recipient is concerned with his privacy. If you want privacy, pay for your own groceries.

Of course the reality is probably different. I'll bet those SNAP recipients don't much care, and this is simply the ACLU and other leftist organizations using lawfare to attack the Trump administration.

But it does expose the larger point that in most cases the government has no need for most of the data they accumulate about us, and in many cases it flies in the face of our constitutionally protected rights. Collection of weapons purchase data is an affront to the 2nd Amendment, yet the federal government and the blue states are busily building a massive database of legal gun owners.

I wonder why? Whatever could they do with that information?

That figure might be low. Just look at all that DOGE uncovered on the Federal level. I wouldn't be surprised if more than half of all Federal dollars circulate thru a couple of dozen grift filters and wind up back into "insiders" pockets rather than doing anything for those paying taxes.

The Senate writing its own rules is in the Constitution. The officer in charge of making sure the Senate keeps to those rules is a creation of those rules. The Parliamentarian is that creation.

But, ultimately, in the rules itself, it says that the president of the Senate (the VP) can overrule her.

48 Until the courts give up the second party doctrine (where any information given to a second party, regardless of whether the person considers it 'private') then the 4th Amendment itself does little.

SNAP recipients, for example, share their data with the government explicitly in return for benefits. This information as to purchases also is shared with card processors, the grocers (and other merchants), etc. Then you have the ubiquitous store cameras that can now link with identifier databases as to the person, traffic cameras with built in license plate readers that can track the SNAP recipient on the road, etc.

So the whole chain of information is not constitutionally protected as a yet by the 4th and retains on the the shreds left by privacy statutes that are designed to prevent disclosure to people outside the government. Those have explicit exceptions dealing with 'investigations', 'compilations of data without individual identifiers', the need for specific caseworkers, supervisors, etc. to work with the data, linkage with other government databases to establish identity, and so on.

Adopt Franklin's doctrine on secrets: two can keep a secret if one of them is dead.

60 To continue, just as the older trespass theory of 4th Amendment violations was destroyed by the telephone, the current Katz standard of reasonable expectation of privacy has been shredded by the third party doctrine and modern communications/computer tech/etc.

That is entirely leaving out the hoovering of data worldwide by the NSA into a database that is searchable and apparently permanent with no exit since it was spun up.

Computers, tech in modern cars and tvs, cell phones, cloud storage, and courts have all combined to eviscerate privacy and the 4th Amendment regarding the seizure of such information requiring probable cause, a nullity.

Not quite. Any decision can be appealed to the Chair (aka VP/President of the Senate or President pro tem (including designates sitting in the chair). Normally that would take 60 votes, I think (rusty on Senate rules) for that but the nuclear option is simply to overrule the parliamentarian by a simple majority vote (nuclear option). The Parliamentarian can and has been removed before (I think from foggy memory this was done once in the Bush years but cannot be sure).

First, however, comes a Byrd bath where legislation can be tweaked and resubmitted language to the Parliamentarian for passage. In some cases, submission of additional information is sufficient indicating that the primary focus of the legislation is taxing and spending rather than policy focused. The Byrd rule is the rare germaneness requirement in a Senate that is allergic to such limits in the rules generally. The House is much more strict on germaneness of bill provisions.

On tap today is to diagnose why the low oil pressure light is on in the missus' car, fix the vacuum cleaner beater bar that is not turning, plug the holes at both ends of the roof's peak with hardware cloth in order to keep out birds seeking to nest there and, finally, to get a scheduled time to bring my car into the shop for some needed repairs and replacements.

All completed -- before noon! -- and I even got to play ICE Agent by evicting the English Sparrow squatters that had built a nest at one end of the roof's peak. One of them startled me by flying the coop as I was extracting the nest, piece by piece, with a wire hanger, but I endeavored to persevere.

Isn't that (the low oil pressure) just a function of reading a code from an OBD-II scanner?

The funny thing is that increasingly the Internet, as we know it, is dying. Many major commentary places like X, Disqus, Reddit, etc. are now filled with bots commenting. Even a 'news' is increasingly being turned into AI monstrosities.

In a sideline, courts involved in a lawsuit citing infringement has mandated that ALL search query results be retained regardless of whether the submitter wants to delete them. Essentially those queries are considered 'evidence' in the copyright infringement trial as to how the AI model is used.

So, want to build in plausible deniability, create an Elric 'bot' that posts in your style using queries of a home stationed AI model like Deep Seek. In the case of bad statements, you can simply blame the bot for it. News agencies certainly will with misshapen AI content when sued for malpractice.

I also think, that bot and information rot are going to be a serious headache for those trying to monitor what is going on as the line between bot and human becomes thin.

It appears that the higher the testosterone level, the shorter the life span. This applies to men vs. women, of course, but also Asians<whites<blacks in testosterone level and the inverse for life span. Blacks mature earlier, have more muscle mass (especially of the short twitch variety) and die younger. I have no data for East Africans vs West Africans, nor for West Africans vs. African American (who are almost entirely west African), but those would be instructive points of comparison. I don't know what work has been done on this, but I have no doubt that the usual "that's racist" clowns have hindered the research.

They do, probably, unless the federal agency has to get the information form the state agency they contracted with to administer the program.

But it's a different federal agency than whoever is requesting the information, so somebody at the USDA has to compile a report, then send it over to the requester.

Everyone in the federal government doesn't have access to every other federal department's databases.

Because for most purposes, everybody doesn't need access to all of the other databases in existence.

If you were to look at just my income, and note I am not married, I am pretty poor. Which is very different from my income 3 years ago when I bought my business and stopped consulting, or 5 years ago when I was a VP. I would qualify for food stamps for my daughter and me- not the full benefit amount, but a partial amount based on the chart I just read on the website. But this doesn’t reflect my lifestyle, though, because I live with someone who makes very good money. But again, we aren’t married, so it isn’t mine. I just benefit from it with my house, which also isn’t mine, etc.

Natural resentment of having their own pockets drained at gunpoint by people who simply wish not to work. Unfortunately, those down on their immediate luck get splashed with the same bucket of mud as those who are lazy ass grifters sucking on the public teat and pretending that is their 'job'.

Analysis of the full package of benefits a few years ago in the state of PA of housing, medical care, SNAP, direct cash payments, etc. was something like 60k per year. Some undoubtedly had valid reasons why they could not work at all and used such benefits as a bridge to get back on their feet.

But for a lot of others, it is clear that any paid work would simply reduce their benefits--often then you get people working for cash off the books plus getting welfare benefits. Sometimes, they simply choose not to work.
