Supreme Court Orders Maine to Restore Speaking and Voting Rights to State Congresswoman, Who Was Illegally Barred from the Statehouse for Stating That a Transgender "Athlete" Is In Fact Transgender

The Democrats demanded that this elected representative, who was elected by voters to represent their point-of-view and priorities in state government, apologize for speaking the truth before they'd consider permitting her to represent her voters again.

Seven Supreme Court Justices ordered an end to this illegal deprivation of representation. Sotomayor and Jackson, of course, dissented.

The Supreme Court restored Representative Laurel Libby's voice in the Maine Statehouse on Tuesday, letting the Republican lawmaker avoid apologizing to a transgender athlete she attacked in a social media post.

Without explanation, the high court granted Libby's emergency appeal in an apparent 7-2 ruling. Justices Sonia Sotomayor and Ketanji Brown Jackson dissented.

Jackson suggested that her colleagues had acted prematurely, intervening in a case without critical and exigent circumstances.

"Denying emergency relief in a case that does not satisfy the usual certiorari factors also avoids creating perverse incentives to seek our intervention prematurely," Jackson, a Joe Biden appointee, wrote in her solo dissent. "Why would any applicant who thinks the lower courts are mistaken wait for those courts' final word on any issue if real-time error correction via our emergency docket is readily available?"

Libby was censured for a Facebook post complaining that the winner of a high school track meet was transgender, unable to participate in debate or vote under a centuries-old rule of the Maine House. The Legislature said she had to apologize to the transgender athlete to regain her privileges.

Libby turned to the courts instead, asking the justices to intervene so her constituents could have their voice heard in the Legislature.

"The Constitution does not tolerate respondents' unprecedented punishment for Libby's speech on a debated issue of exceptional importance," Libby wrote.

Maine says Libby agreed to the House rules for how the body would govern. According to the statehouse, any member found to be in breach of its rules may not participate in floor debates or votes until they have remedied their breach.

Libby's colleagues said she must apologize for her conduct.

Correct. There was a part in "Burmese Days" when the local savages rioted and surrounded the European Club where the British community had taken refuge. When the savages called out for blood for the "murder" of one of their own, Mr. Macgregor, Colonial Commissioner, tells the other Euros, who were unsure of what to do, that it was suicide not to face down the savages and tells the rioters to go home before the police are called and the shooting begins. Much hilarity ensues.

Never, ever apologize to the democrat savages.

Expert comic timing. My favorite episode revolves around him. Out of accounting work, Norm exploits his skill as an interior decorator. ("I've always had a great eye for line, and I always know where to put the ottoman.")
Ultimately he has to let his new clients -- who only want German mechanics, French chefs, and gay decorators -- think he's gay . . . and he tells them Sam is his lover.

At the end, Cliff and the other patrons say sorrowfully, "Norm, we're your friends. You could have told us!" "Guys, I'm STRAIGHT!" "We don't care about that. You can get stuff wholesale!"

The Chevron defense was a precedent set by the Courts in the first place, and did NOT go back and retroactively affect any old Regulations, just new ones.

The only thing Chevron changed was that the Judge would listen to the Govs interpretation of a Rule, and decide if it was valid, instead of just accepting their interpretation.

I have not been able to find a single Rule, that has been overturned, since the Chevron defense was no longer valid, due to that precedent no longer being in use.

And actually... Chevron gave more power to Judges, as they were now the ones who got to decide what a Rule was for, and did not have to 'listen' to the Executive Branch's interpretation of said rule.

It's portrayed as a BIG WIN for the Right... but in essence it gave more power to the Judiciary.

Actually, that's not what Chevron did. Chevron gave the executive free reign to interpret statute any way it wanted in writing regulation. It didn't need to go through courts. It, more than anything else, is responsible for the Imperial presidency.

And Trump has been using Loper as justification to rip out regulations without the APA required notices. It's part of his April 9 EO, Directing the Repeal of Unlawful Regulations.

So, the practical reality is that new regulations get more slowly added because they can be challenged in court, while the removal of regulations is faster because it's out of alignment with Loper.

But yes. Huge loss. Secret loss.

237 I have not been able to find a single Rule, that has been overturned, since the Chevron defense was no longer valid, due to that precedent no longer being in use.

The ruling did not make the previous rulings vanish, it prevents future rulings from using that as a basis. They have to be challenged in order for it to be applied.

314 278 Danson ruined CSI for me. I watched that for years and really enjoyed it but it just lost its way totally when William Petersen left.

By the way, I strongly recommend the 80s Friedkin movie To Live And Die In LA, Petersen's first big role.

Kino has a...history with Friedkin (responding to their emails at all, apparently). And Friedkin had a history with jiggering with visuals.

It was so bad on one release (I think it was Killer Joe or Jade) that Kino just canceled the whole thing and swore to never work with him again.

And then Friedkin died.

And then scooped up whatever they could, got sign off from the DP instead of Friedkin's corpse, and got things out the door faster and, from what I've read, more in line with the 35mm print than Friedkin would have done.

Again, I know people dislike the fact she's critical of Israel, and is not shy from pointing out what she believes are flaws in the points of view of American Jews.

But the extent to which people make up shit about her, and then let the internet go crazy with believing it, is classic bullshit lefty woke bullshit bullshittery.

I don't agree with everything she says, and frankly I would prefer she not focus as much of her attention on going after the American Jews who came after her. But it's her life, she's free to do what she wants.

But the lying liars who make up shit she said, just because they don't like her, are exponentially worse.

350 Back on OT for a second...

The precedent Maine was setting was that a narrow majority could simply disqualify legislators for violating "rules" that had nothing with procedure and everything to do with policy debates.

For those keeping score at home, the Popular Front in Spain achieved a very narrow majority in the early 1936 elections, but then began demanding re-votes in certain districts due to alleged corruption and ended up with a 2/3 majority.

Nothing is new.

356 Then most well-constructed movie ever made was Dead of Night, from 1945.

You literally have to watch every frame, especially the first few minutes and then the final few minutes, to grok what is happening, but when you do...OMG, devastating.

The episodes within the film (people recount things that have happened to them) were almost all extremely influential, with each episode almost becoming an entire movie genre unto itself, with many movies based on them, most of which were also made into multiple Twilight Zone and Outer Limits plots as well.

The only "weak" episode wa the ridiculous "Golfers' Tale," but the guys who starred in that scene were the most poplar comedy duo in the UK in that era, so back then it was the most popular aspect of the movie, despite it later being seen at the film's one big flaw.

But overall, definitely one of the top ten horror films ever made, and definitely the most well-contructed.

386 The only "weak" episode wa the ridiculous "Golfers' Tale," but the guys who starred in that scene were the most poplar comedy duo in the UK in that era, so back then it was the most popular aspect of the movie, despite it later being seen at the film's one big flaw.

But overall, definitely one of the top ten horror films ever made, and definitely the most well-contructed.

394 Unfortunately some movies do not live up to the hype. For example I heard about how wonderful and hilarious Holy Grail was from Monty Python and it was very underwhelming finally seeing it. I mean it was funny but not nearly as gut busting to me as people claimed.

Its very tough to get modern people to comprehend how awesomely great Citizen Kane was at the time, because all the innovations and wonders that it introduced are just standard now and it seems like kind of a maudlin and slow movie now.

Its like how Matrix changed cinema and blew people away with the incredible visuals and now everyone uses this stuff.

455 451 One thing is I don't watch movies to feel bad after they are over. There are a few exceptions. I thought the Human Stain was a piece of art but the most depressing movie I've ever seen.

The Cooler which I watched a few nights ago is like watching a car wreck but with a happy ending.

I love it when a movie makes me feel sad.

458 407 402 TJM, re-watched the Burt Lancaster flick The Swimmer on TCM not too long ago. It's a very odd movie, but the first time I saw it, I was laid up with a bum leg and I could identify with Lancaster's character up to a point. Rewatching it, I still think it's an interesting flick. What's your opinion?

Never seen it.

I've seen it and was not that impressed. You keep watching the movie hoping to find something but you don't. But its okay and the neighbors never complain about Burt swimming in their pools.

459 The 70s were big on movies with miserable, depressing endings. I think that's part of why Star Wars was so enormously popular.

461 The better you know the original Frankenstein films, the funnier Young Frankenstein gets; most of it is from 2 and 3. The hermit scene with Gene Hackman is almost word for word from the original, with just a few extra twists to make it even funnier. Brooks and Wilder realized how much dark humor was already written into the originals, and mined it well. Cloris Leachman, for instance, is doing a hilarious take on Una O'Connor.

464 36 is a lot of trannies participating in women's college sports. I bet none of them are fully transitioned and all have a dick and balls.

465 448 Doctor Zhivago was one of those movies where the secondary characters were more interesting than the main ones. Alec Guiness, Rod Steiger, and Tom Courtenay were brilliant, and they weren't even on screen that much. Loved AG's role in that movie. Kind of the narrator, in a way.

So, Julie Christie or Geraldine Chaplin?
Posted by: Bulg

I guess I should have added; Julie Christie was the most beautiful woman in the world. I'm not knocking her or Shariff. They were very good. Great overall casting in Dr. Zhivago.

I'm sure there's something there, but I was only commenting on the more recent comment.

If I'm going to engage with someone, I'd prefer to start with an easy layup, and then work back. If necessary.

But I doubt this person is interested in a rational argument.

Caddyshack was apparently very ad-libbed, not scripted.

And the amount of cocaine on set was enormous.

I question the ability of 1870s Jews to plant Brontosaurus bones in the rocks of Montana and Wyoming before the Dino Hunters found them.

That Moon photo proves the earth is flat, too....

I stumbled across Flat Earthers on X a while back, and couldn't believe it. They are quite entertaining. All space is fake according to them. Also gravity doesn't exist.
