Supreme Court Reverses Lower Hawaiian Judge's Order to Re-Hire the Federal Layabouts Trump Fired

A wise man once said "Winning."

The headline is misleading. The Court did not rule on the final merits. Rather, it stayed yet another "emergency injunctive relief" order from a Hawaiian judge, in which the judge, yet again, said "Before we even hear the merits of this lawsuit, we're going to just go ahead and assume you're going to win at trial and we're going to order the government to re-hire you until the actual trial."

The Supreme Court stayed that order, which means the federal "workers" are fired until some trial concludes that they must have Federal Jobs for Life.


The Supreme Court has halted an order by a superannuated, Clinton-appointed San Francisco judge that would have required the Trump administration to reinstate some 16,000 probationary employees it had fired from the Pentagon, the Treasury, and the Agriculture, Energy, Veterans Affairs, and Interior Departments.

The order places the reinstatement on hiatus until the Supreme Court has a chance to rule on the issue, but things look grim for the Resistance. The vote was 6-2, with only hardened anti-Trumpers Sotomayor and Jackson voting to sustain the judge's order.

Nine "non-profit" organizations sued to reinstate the "workers." Note that the workers themselves didn't sue.

I love that the "non-profits'" suit was thrown out for, get this, lack of standing.


This case originated in March when the Office of Personnel Management issued an order directing agencies to terminate workers in term or probationary status. Somehow, this case ended up in San Francisco, which only has the most tenuous connection to any of the agencies named in the suit; see Federal Judge Orders Trump to Rehire Thousands of Fired Federal Workers -- RedState. One might suspect that judge shopping was going on.

You know, guys like Earl Warren, David Souter and John Roberts.

It would be nice if we picked judges who DID believe in judicial activism, but unfortunately the failure theater department of the Deep State does not approve.

Occasionally some sneak in, like Thomas or Scalia (as long as drugs weren't involved! If drugs were involved, he was Earl Warren 2.0). But very rarely.

I think she is reliable on social issues, and problematic otherwise. So if you get her in front of a ruling on, say, trans bathrooms, you get a decent decision. You get her on some economic or diplomatic thing and its a coinflip.

There was a rumor that at least one of the judges was intimidated by the BLM riots and feared the anger of lefties, how true that is I cannot say. But its definitely true that leftist rallies and riots and such are not aimed at voters. They just piss voters off. They're aimed at frightening politicians and people in power.

Been a long time, all the way back to the progressive era.

Wickard v. Filburn was pretty awful and led to a lot of this and that was decades before Roe.

Ending the Lochner era of contracts was a progressive move from the court that also opened the door to a lot of problems.

Just to clarify: In the ruling about the El Salvadoran gang member, the case was not about whether Trump could deport him. It was about the jurisdiction. The guy was from Texas, so the case should have been brought in Texas, not D.C. And it might still be brought in Texas, get the same "No deport" result, then appealed to SCOTUS and granted cert. If that happens, THEN we'll know how she feels about the deportation order.

I'm not in support of this reasoning, but it's a combination of civil service laws and how spending on certain things are derived from bills passed by Congress and signed into law.

Ultimately, to really put this to bed, Congress needs to formally strip the funding on much of this to end it and it needs to be passed into law.

My understanding is a lot more firings are being held off for this reason.

For the most part, she was someone without an established record as a judge which makes them into a loose cannon on the bench. Souter was similar even though he was a NH Sup. Ct. judge when appointed and Sandra Day O'Conner was back in her time. Powell before her.

The GOP got into the habit of trying to find stealth candidates before the filibuster on judicial nominees was killed (likewise on appts to Cabinet etc.). These often blew up as unpleasant surprises going back to Eisenhower and Earl Warren/Brennan at the very least.

Roberts is another such judge with a very short record.

Pleasant surprises were Byron White (JFK), William Rehnquist (no background as judge), and Clarence Thomas (scanty legal background).

Notably, Byron White is about the only 'defective' Dem appointed judge since the 60's. None have moved right since then.

Stand your ground and "I felt threatened" are not magic incantations. A person grabbing your backpack or touching you are not lethal threats that give you free rein to unleash hell.

SYG just means you don't have a duty to retreat from a lethal threat before being able to defend yourself. It doesn't mean you get to respond to a unquestionably non-lethal threat with lethal violence.

Someone being mildly aggressive is not "being the aggressor" that can then be killed with impunity.

Jurisdiction is something that every lawyer is taught at the very basic level as key for winning appellate decisions. Same as justiciability (standing, mootness, political question, etc. )

Difference is jurisdiction is in control of Congress via its statutes and justiciability is an inherent power of the courts. Boasberg confused the two and conflated removal case with the APA when existing AEA jurisprudence already held decades ago that the proper remedy was habeas instead of his idiotic (legally speaking) attempt to argue it was a rulemaking case.

Judges should never be advocates and far too many lawyers elevated to high court ignore that (almost all of them leftists).

Thanks for your hate. I don't think I earned it, but you do you. Just as in the private sector, there are those who do real work that matters and those who sandbag. I disliked the sandbaggers not just because they wasted taxpayer dollars but because they made my job harder. I had no say in how those folks were paid or for how long. I performed professionally, helped others do the same, and I believe I served the military mission in a way I could be proud of my accomplishments.

Yeah I think the true beef with Roberts and the Squish justices is that Trump is making them hurry to do the right thing, not that they want to block him. The Dems have appointed activists instead of judges for decades now and this is the rotten fruit.

Ironically, Earl Warren set the std. for dealing with recalcitrant lower court judges opposing desegregation. Then again, Scotus routinely addressed about double the cases that our current court does. That is one of the few shitty things done that Rehnquist started as Chief Justice.

Part of it was avoiding bad rulings by the Rehnquist court defectors but Roberts really had less of an excuse.

That's pretty much it in a nutshell.

I was recently thinking about how blacks have isolated themselves with all the protection, anger, etc. Remember back in the 70s and 80s when you could joke with coworkers?

Hispanics have taken that place. They have a sense of humor about them, and you can joke with them and they'll joke back. And when it happens it's neat to remember how it wasn't mean-spirited but just goofing off. Men always have that threat of violence so it never goes too far (and that's another conversation re: Strong and Independent language knowing there are sex-based societal protections), but just fun teasing and often self-deprecation.

It's weird to remember how fun the world used to be.

Just to clarify: In the ruling about the El Salvadoran gang member, the case was not about whether Trump could deport him. It was about the jurisdiction. The guy was from Texas, so the case should have been brought in Texas, not D.C. And it might still be brought in Texas, get the same "No deport" result, then appealed to SCOTUS and granted cert. If that happens, THEN we'll know how she feels about the deportation order.

Due to due process and federal laws on employment, you have to dismiss all probationary employees or none of them for firing. If you pick and choose, then each employee gets to claim due process violations in their individual case.

Better to fire them all than fight large numbers of discrimination, unlawful discharges due to whistleblower status, and all other things.

You can rehire later based on needs rather than fight a massive number of court cases the other way.
