But here's what I do care about: 1, Big Pharma does not advertise on television to influence consumers, who cannot of course just buy the medications themselves. (It can tell consumers to suggest the drug to a doctor, but there are other ways to market to doctors, and of course Big Pharma does that too.) Big Pharma advertises on television to influence the media, because the media would die without their trillions in advertising dolars.

Basically, it's because broadcast TV/airwaves are "public property". Now, banning ads in print and other private media would be a big 1st Amendment thing.
Less 1st Amendment protection applies to what the courts have dubbed "commercial speech", but that's a complicated thing well beyond my limited understanding.
But banning Pharma ads on the public airwaves, yep, that can be done.

We killed our TV two decades ago, and I had no idea how bad it had become:
I was on a rowing machine for an hour at the gym last Saturday afternoon -- and instead of the usual Fox News or NewsMax channel on a television in front of me (no audio, but closed caption) -- some leftist trash channel called News Nation was broadcasting the "Bernie and Donkey Chompers Commie Rally from Tucson.
Anyway, whenever they went to a commercial break -- it was literally a block of like seven or eight straight commercials for various pharmaceutical products from Big Pharma.

I'll need to think about this one. While it's true that I'd love to see the media auger in, it's also problematic for the government to have the power to block such advertising. Sure, tobacco ads are banned, and that's probably a good thing, except it's never just the one thing with government. First it's tobacco and alcohol, then it's guns, and before you know it, it's "misinformation". Like I said, I need to think about it.

There's certainly room for argument there, but cigarette ads have been gone from the tube for a long time.
Alcohol ads are still present, but the actors aren't allowed to actually drink any of it on camera. You'll see them pouring it out by the supertanker load, but never drinking it.
So there's some precedent there.
In general, "commercial speech" has fewer First Amendment protections than normal speech, or so the courts have held.

I think it's something we should care about. Big Pharma plays a biggg role in the Deep State.

But beyond that, fuck big pharma. They were complicit in killing how many millions of people through opiates at this point? Covid shots? Unending vaccines? Statins and other drugs that have more side effects (for which you need additional drugs) then benefits? SSRI's? Anxiety meds? ADHD meds in children? Puberty blockers?

Medicare doesn't pay for prescription drugs as such. You have to buy a separate plan from a private insurer for that. Medicaid essentially won't pay for anything that has a generic alternative, unless the doc is willing to jump through hoops to show that it's "medically necessary".

Basically, it's because broadcast TV/airwaves are "public property". Now, banning ads in print and other private media would be a big 1st Amendment thing.
Less 1st Amendment protection applies to what the courts have dubbed "commercial speech", but that's a complicated thing well beyond my limited understanding.
But banning Pharma ads on the public airwaves, yep, that can be done.

Yep. TV and Radio broadcasts accept limitations on their speech aka in the public interest in return for having a license to broadcast on a certain frequency. Cable, internet, etc. operate under different standards such as obscenity and indecency regs. but not required to be in the public interest.

I'm not so sure about that. I would bet patients mentioning "what about that drug I saw on TV" generates a sizeable minority of sales. Add to that the doctor prescribing something and the patient saying "oh, I think I saw an ad for that, sure I'll try it" and I would bet you get to over 50% of sales.

Medicare doesn't pay for prescription drugs as such. You have to buy a separate plan from a private insurer for that. Medicaid essentially won't pay for anything that has a generic alternative, unless the doc is willing to jump through hoops to show that it's "medically necessary".

have a friend that's a doctor, say she's constantly annoyed at being asked by patients to prescribe name brand drugs that are way more expensive.
She can refuse, but ultimately this is a business and if someone wants a $20 pill that's maybe 1% better than the 10 cent pill, she's not in the cost containment business.

Big Pharma is one piece of the Deep State. They make their billions by getting people addicted to drugs and getting the insurance companies and government to pay for it.
Spend some time reading about the Sackler family, for example. Their contributions to American society have been untold millions of people become addicted to first OxyContin then street opiates.
They OBVIOUSLY knew that opiates were addictive, as does everyone else on this planet, but were able to buy off the FDA and the big doctors groups to say OxyContin was not addictive, despite all evidence to the contrary.
Then they purposely targeted "blue collar" areas in the country with marketing of their drug (read: white working class places like West Virginia, northern Florida and New England), creating millions of addicts.
Then when it became impossible to ignore that opiates were, in fact, still addictive, the helped the DEA throw doctors in jail and cut off the opiate supplies. Which led to people getting onstreet drugs.

I don't suppose it could ever fly, but banning pharma ads on news shows would be the sweet spot for me as I'm not wild about pharma only buying off docs to push their pills with sweet vacation packages wrapped around seminars about the advantages of the new drugs for marketing. A real good reason to ban the ads is because the costs of buying the ads are passed on to the consumer either from insurance premiums, out of pocket expense, or tax dollars from medicaid/medicare. If the drug is any good your doctor should be bringing it to you, not you wandering in based on something you saw on TV that might cause a fatal infection of said taint.
I mean, these companies buy Super Bowl ads and March Madness ads. Those aren't cheap.

Given I take some of those drugs (for inflammatory arthritis), I agree. Basically they put the soothing words of the warning in the background of people having fun in the sun. Visuals overcome the vocalization as is the intent.
In my case, the doc can give me what the PBM allows with its formulary of drugs covered.

Not really. Lighten up Francis. There has long been requirements on advertisements on TV and radio for obscenity, liquor, tobacco, and other limitations.
Even way back at the Founding, courts and judges did not permit anything goes on advertising and that became more and more true as time went on. Slander and libel laws for example. False claims by merchants--actionable, and so on.
When it comes to broadcast media--they take the license on the requirement that they use the public airwaves to the public interest as defined by regulators. See the Red Lion v. FCC decision regarding equal time for example. Thus, showing obscene or even indecent content on broadcast can be limited by regulators and so can ads on products that do not serve the public interest.
Old tv ads, for example, had actors in white coats playing doc and smoking up a storm. Banned eventually. Etc.

to work in Pharma it's only certain agencies. they gatekeep the work from generalist agencies. that's now it didn't used to be like that. it's SUCH a cash cow that say, our (very historic) agency does only a fraction of the $$ that some pop up Pharma marketing agency does.
the Pharma advertising thing is dirty. it needs to GO. it will be healthier for my industry and for the healthcare industry AND for the media industry.
what we've had for a while now has been an insane racket. the Pharma cos are controlling the media and they even have the ad agencies as basically an offshoot, not really independent from them either

But regarding the 1A. Courts have held all down the line and the framers themselves intended, political speech and news are the most protected category aka core rights and as a result are least regulated under strict scrutiny.
Speech aimed at selling shit may be regulated using a relaxed standard of rational basis just like business in general can be without invoking the takings clause of the 5th.

It's funny, I don't know who on earth goes out drinking in California. One of my young friends used to be a big party girl, and I was shocked at how much she dropped on beers at a cheap bar on an average drinking night. $60-$80, and that was a few years ago.

You would be wrong. Pharma ads were not allowed until the 90's for example. Tobacco banned in the 70's. Advertising is not the same as core free speech despite what you put out and has never been treated as such. One day, read up your state's DTPA laws. You would be amazed at what can and cannot be allowed when selling goods.
Essentially, the Constitution itself guarantees negative rights as in you cannot be put into prison for what you say (even there if speech is an element of a crime otherwise you go to prison) but it does not allow you to use a bullhorn to scream your truths along the roads. Time, place, and manner restrictions of speech mean even core political speech and assembly can be regulated.

Hah, there is an abortion tie-in to the commercial speech 1st Amendment protection. Before 1975, the courts had held that commercial speech had no 1st amendment protection at all. The states could regulate advertising to their hearts content.
But then, some outfit in NY started advertising abortion services in Virginia. This was in 1975. At the time, Virginia banned any abortion advertising.
And then, the Supreme Court ruled Virginia had to allow it... cause "some 1st Amendment" applies.

Also if you have a front loader washing machine, you have to take extra care of it or it'll develop a mold issue. Check your dryer to make sure it's lint free and running well. If your clothes are still a bit damp after a dry cycle, they will start to smell musty.

Yes, the first thing when analyzing something like this is to realize the big divide between print media and broadcast media. The latter using the public airwaves.
You don't have a right to broadcast over the public airwaves. You have to be licensed. The federal govt has all sorts of power over this from the get go.
You do have a write to speak and publish your opinions. You can print up a newsletter or manifesto or whatever. That is fully protected speech. But you don't have a right to operate a pirate transmitter and broadcast that manifesto over the public RF frequencies.

Actually it does not and has never quite done so when the purpose is to sell goods. Political speech and news require a compelling government interest to regulate and any such regulation must be narrowly tailored to meet that compelling govt interest. Selling ads fall under commercial speech which is in Central Hudson v. PSC.
"First, in order for the commercial speech to be considered protected speech under the First Amendment, the speech must concern lawful activity and the speech must not be misleading.
If this step is met and the commercial speech is considered speech, then the court will use steps 2-4 below to determine whether the government regulation is constitutional
Second, the alleged governmental interest in regulating the speech must be substantial
Third, the regulation must directly advance the governmental interest asserted
Fourth, the regulation must not be more extensive than is necessary to serve the interested expressed in step 3"

It wasn't washing the clothes per se it was taking all your dirty clothes and laundry shit, walking five flights to the basement, hoping a machine was open, starting a load, wait for that to finish, wait for someone to take their shit out of the dryer so you can start drying (which could take a long time) and then start the rest of your laundry. Pain in the mfing ass.

While we are on this topic, it is high time that cable and sat TV be regarded the same as broadcast TV. Ultimately, there is some sort of "licence" or operating authority under which a cable or sat provider operates. I can't just up and go stringing wires on utility poles to operate Peon's El-cheapo Cable. I would have to buy the right from the utility, and the utility is licensed by the city or the State to erect those poles and deliver power upon them.
