Here is the answer to this fake judge's question about his "powers" on ordering flight paths:
Sean Davis @seanmdav The Supreme Court explicitly ruled in the 1948 Ludecke v. Watkins case that Alien Enemy Act removals by the president are non-justiciable. Here are some key excerpts from the ruling, lest anyone think the SCOTUS opinion was in any way unclear: “The Alien Enemy Act precludes judicial review of the removal order.” That line is literally the first sentence of the SCOTUS holding. “The very nature of the President's power to order the removal of all enemy aliens rejects the notion that courts may pass judgment upon the exercise of his discretion.” “[E]very judge before whom the question has since come has held that the statute barred judicial review.” “A war power of the President not subject to judicial review is not transmuted into a judicially reviewable action because the President chooses to have that power exercised within narrower limits than Congress authorized.” “These are matters of political judgment for which judges have neither technical competence nor official responsibility.” Posted by: Jay in PA at March 18, 2025 12:28 PM (i7Q7S) 126

Honestly disturbed the shit out of me - if this is what are willing to say to people openly, what are you willing to support even if you don't get your own hands dirty. Horrific. Israel broke the ceasefire. It was Israel's government that failed to uphold the agreement when it didn't complete the promised withdrawal of IDF forces from the Gaza Strip in recent weeks, particularly from the Philadelphi route along the Gaza-Egypt border. Israel never really entered the 2nd phase of negotiations. They stopped humanitarian aid for 16 days and just sent more than 200 planes to murder Gazans. So here we are, "genocide Donald" and if you demonstrate you will be arrested and possibly kicked out of the country Netanyahu getting to the task of removing 2 million from Gaza asap. He’ll move fast on ethnic cleansing so it’s finished before Traitor is out of office in 2028. He knows he won’t get any better supporter than Traitor so the crime has to be executed quickly. Posted by: Auspex That was Roberts trying to do his homage to CJ Marshall. But, the issue is that everyone knew where Marshall stood on a case, he didn't do the passive aggressive shit of cobbling on his own 'saving' via an unbriefed 'taxing power' to save the unconstitutional Obamacare. One of the key is that the dissenting justices did not even change their opinion to deal with Robert's last minute treachery. They issued their opinion as is and Roberts concurred in part and sided with the liberals on the court using the tax issue for the other part. Nasty backstabbing critter. They figure they can roll things up enough they can start a multi national hostile reaction against Israel and the US. They might get Armageddon out of it. I thought this was going to happen during Trump I. Now it still may not happen, but that's what they are aiming for. Russia is exhausted and not looking to open another front in ME. The admin has paid out some of the $2 billion, but only what it has decided is in alignment with its priorities. Probationary employees haven't been hired back. The vast majority of what's being covered and ordered is simply not happening. The administration is doing either malicious compliance, outright not complying, or getting appeals processes started as soon as possible so they don't have any orders to comply with while the appeals process plays out. Most of the legal maneuverings right now amount to little more than noise without much affect on admin actions. And there's the endgame that they're racing towards of overturning Humphrey's Executor, which is definitely going to be on SCOTUS' docket come summer. Actual question... What can Roberts do besides say the order is invalid? He can't fire the Judge. He can't bitch slap him... Under Fed Rules of Civil Litigation, the case must go through the slow 'process' unless the Supremes do an Emergency order... and even then all it can do is tell the Judge to rescind THAT order... I don't even think Roberts can pull that Judge off the case... there is no process to do that which I have ever heard of (short of impeachment). At some point, Trump will take the position that the lower federal courts are NOT co-equal with the executive. Only the Supreme Court is. The other federal courts are all Congress-created and can piss up a rope.
Most people don't know this, but the ONLY court set up by the Constitution is the Supreme Court. The other lower courts were set up later by Congress. The argument will go that the only co-equal court is the SC -- the only one the Constitution says is co-equal. I think this is coming. We'll see. Actual question... What can Roberts do besides say the order is invalid? He can't fire the Judge. He can't bitch slap him...
Posted by: Romeo13 ------- Roberts is the supervisor aka rides the DC Circuit. As supervisor, he can immediately put a stay on the lower judge's TRO and subsequently refer the action to Scotus. From previous published opinions, we know four justices are already wanting to curb these ridiculous TROs and nationwide injunctions by district judges and all it takes is Roberts to put on his big boy panties and sign on. ACB will probably do so if he does. Roberts is resisting because a lot of those DC asshole judges are friends and very possibly would hurt the business interests of his wife who is legal headhunter for the elite DC law establishment. He is a fcking coward, a manipulative Chief Justice, and unimpressive legal mind. BTW, the reason Congress abdicated the rules of procedure is that much of it is technical and a lot relies on constitutional decisions that Congress cannot legally address via statute. TJM, I like your optimism on this but I can't help remembering that Trump was found guilty of sexual assault and ordered to pay obvious liar Carroll millions. Or found guilty of 37 felonies for a bookkeeping error and told to put up 450 million to appeal. Why were these obvious miscarriages of Justice not overturned by appellate courts? There were so many egregious errors during trial. The same with the J6 trials. The FACE act trials. These judges are so consumed with their personal bias that they make these rulings and then NOTHING is done. Trump had to pardon the J6ers for,TJM to get Justice.

No. Roberts isn't stupid. He can very clearly see that this shit is seriously fucked up and it's wrecking the prestige of the court system. People are questioning their judgement and honesty. He can see that. But he does not want to deal with it. He wants lower courts that aren't staffed with lunatics to do their job with honesty, integrity, and respect for the constitution. Which is what every court and judge should be doing. He wants someone else to curb stomp this bullshit so the Supreme Court doesn't have to get involved. I would rate Alito and Thomas at the top via experience and legal acumen. Gorsuch is getting there albeit idiosyncratic on some issues but far better than his mentor Kennedy. Kavanaugh is a smarter insider judge as he had to hone his craft on a hostile DC circuit far longer than Robert's brief stay there. ACB and Roberts are the ones with scant judicial and legal experience and for that reason the most amenable to keeping to whatever appears to be the winning side socially rather than legally.
