Obama Judges Decides She's President Now and Will Choose Who Works for the President;
Poll: People Want Musk to Keep Cutting Spending, CNN Poll Finds

Here's Obama judge Beryl Howell, who just insurrected and assumed the powers of the President and ordered Trump to re-hire someone he'd fired.

She looks as you'd imagine she would. They always do.

The Guardian:

The framers of the US constitution "made clear that no one in our system of government was meant to be king -- the President included -- and not just in name only", the judge Beryl A Howell, wrote in the ruling.

Howell presided over the hearing held on Wednesday on a motion for summary judgment in the District of Columbia. "The President does not have the authority to terminate members of the National Labor Relations Board at will, and his attempt to fire plaintiff from her position on the Board was a blatant violation of the law," she wrote.

"A president who touts an image of himself as a 'king' or a 'dictator,' perhaps as his vision of effective leadership, fundamentally misapprehends the role under Article II of the US Constitution," wrote Howell.

Article II of the US Constitution outlines the executive powers and responsibilities of the president. Howell continued, "in our constitutional order, the president is tasked to be a conscientious custodian of the law, albeit an energetic one, to take care of effectuating his enumerated duties, including the laws enacted by the Congress and as interpreted by the Judiciary".

Wilcox filed the lawsuit early last month, alleging her removal was a "blatant violation" of the National Labor Relations Act, which stipulates that members of the board can only be removed for negligence or misconduct. Her removal left the board with only two members, lacking the quorum of at least three members required to rule on cases.

"I'm ready to get back to work," said Wilcox after the hearing in a speech outside the courthouse today. "It's not just about me, but I'm glad to be the face of this fight."

How is it that leftwing judges keep getting "randomly assigned" to lawsuits against Trump?

Trump might have an ace up his sleeve. If I understand this right, and I might not, there's a law on the books requiring people who sue the government seeking an injunction to put up a bond to cover the cost of the government for defending against the lawsuit. If I understand right -- and again, I might not -- while this is the law, it has not been enforced in a long time.

Trump says he will start enforcing it: Put up the money before you get your partisan lawsuit in front of another Obama judge.

Major win for President Trump:

The DC Circuit stays Obama DC Judge Amy Berman Jackson's order reinstating the Special Counsel against President Trump’s will.

The judges had better start reading the results of the last election*, or else they're going to give Trump the pretext to go full Andrew Jackson and ignore their rulings, asking them, "How many divisions does the Supreme Court control?"

Meanwhile, Trump prepares to defund the Department of Education.

Donald Trump is expected to sign an executive order, perhaps as early as today, that will abolish the Department of Education.

The Federal News Network reported that in a draft of a memo, "The department is preparing to notify its employees that President Donald Trump will sign an executive order, entitled, 'Eliminating the Department of Education.'" Education Department staff are working to prepare for the agency's dismantling, including reassigning its functions to other agencies.

The Department of Education was created in 1980 as a government efficiency effort. Education programs were spread throughout the federal government, touching almost every department and many agencies. It was thought that bringing all the education programs together under one roof would save money.

Today, the Department of Education has a budget of $268 billion, and its original mission has been completely warped. It's time the behemoth is slain.

It's not clear if the president has the authority to demolish the department. It was created and funded by Congress, and the courts will not look kindly on Trump's unilateral attempt to get rid of it.

One measure Trump can take is to instruct Education Secretary Linda McMahon to dismantle the agency from within. Reassigning staff and resources is well within the secretary's power. How far she can take it remains to be seen.

The American people support Trump's efforts to fire unneeded government workers. Despite the left's and the media's (But I Repeat Myself, as usual) attempts to demonize Elon Musk (as their efforts to demonize Trump already failed), the public specifically wants Musk to continue cutting:


Allen Lichtman, the idiot nobody fool who you hear about every four years only because his stupid "Keys" system for predicting the outcome of presidential elections, the man who guaranteed a Kamala Harris win and then embarrassed himself in appearance after appearance insisting that he was somehow right in this prediction, shows what a cringe hack he is by perpetrating the leftwing basket-case delusion that Trump voters are all "regretting" our votes.

Per actual poll information, and anecdotal observation, we're all deliriously happy with our votes, including people like me, who didn't like Trump's lack of focus in the first term and wanted someone who could better execute the Trump policy platform.

But he claims all sorts of hard-core Republican Trump voters are coming to him behind the scenes to tell them how much they regret their votes.

Weird that Trump has an over-50% approval rate in this divided country, and yet all the Republicans Lichtmann claims he knows all disapprove of Trump.

You'd almost imagine he was just making it up because he's an unhinged partisan who seems to have some serious personality defects and maybe some mental issues.


* There's an old saying, "judges read the election results," to explain why judges execute flips in their rulings based on public sentiment and voting results. The #Resistance judges of course are too dug in to change, but other judges -- like the treacherous Amy Coney Barret -- had better start consulting the election results if she wants to maintain the Supreme Court's extra-constitutional power to overrule the other branches of government. It's a fabricated non-right and non-power of the courts, and that fabricated non-right and non-power can be easily taken away.

This is a widespread Dem op on twitter and is failing terribly because no one believes conservatives would ever talk to the lunatics who are spreading it.

Because they obviously have conservative friends, they try to make it a family member.

The larger question is what the point of it is. Conservatives are not herd animals like liberals. In fact, they are used to be outnumbered and ostracized.

All kinds of caselaw on the subject. If whig's around, he can probably expound on it. But yes, as you can imagine, every aspect of firing government employees has been litigated extensively.

My basic takeaway as someone who doesn't specialize in this kind of thing: it's very difficult to fire an employee of the federal government, they usually have a lot of protections, and are usually supposed to get some kind of due process.

And that's without any union protection (which this lady wouldnt have), which adds a whole other layer.

The NLRB broad has been there far longer than her appointment allows. It's a 5 year appointment. The fact that she is still there is malfeasance. Add to that her insubordination and she was fired for cause by her BOSS. This judge needs some wall to wall therapy.

Not strictly true. The employment provisions are designed to protect employees from each other. The Chief Executive can fire anyone he chooses, which is why you see so few Dems willing personally fight it.

The last time, flight test 7, they had some fuel/LOX leak in the "attic". It was faster than could be vented, fuel/ox pressure built up enough inside to get in the explosive range and something lit it off and BOOM.

They determined is was some resonance vibrations that got out of hand (shades of Saturn V POGO) and sprung the leaks in the feed lines.

So, they changed some stuff in that design for this test. I'm going to guess those changes may have had something do with this failure.

It's a preliminary stage to genetically modifying Asian elephants to have wool, and eventually release them into Siberia to once again have herds - sustainable, of course - of wooly mammoths roaming the tundra.

And there was some sop to Glerbrl Werming by saying it also relates to retrieving heat-adaptive genes that organisms may have lost.

I think all they did was identify common genes in mice and mammoth that are related to hair growth, and turn on the gene in mice that had been negated in the mice.

So it has more to do with studying the gene difference between elephant and mammoth and trying to figure out which ones they have to fiddle with to turn an elephant into a mammoth.

Average high school has maybe 1,500 students. We pay maybe $30 k per student. That means a high school needs about $50 million a year to stay in business. That is 5% return on investing 1 billion $. That money can create 268 highs schools per year with a full endowment covering all costs. Use state matching, and you get 536 per year.

With that money covered, the states can use the saving to endow other high schools. And so on.

In 20 years, every high school could be fully funded by endowments. As more get endowed, the process can spread to grade schools, private schools, etc.
