Is The Second Amendment The Red-Headed Stepchild Of The Trump Administration?

It was gratifying to see some official recognition by the Trump administration of the damage done to our natural, God-given right of self defense by the Biden/Obama junta. The fanaticism on display at the ATF and the Justice Department during the last four years was unprecedented in American history. They shifted the perspective almost completely with the explicit assumption that gun dealers are criminals, and gun collectors are functionally equivalent to arms dealers selling guns to children in the ghetto. Their harassment of regular Americans exercising their rights was sadly accepted by a compliant media, though any enforcement of rational gun laws was met with hysterical opprobrium because of the inconvenient truth that America is a safe country...except for the blue inner cities.

Protecting Second Amendment Rights
Executive Order

By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered:

Section 1. Purpose. The Second Amendment is an indispensable safeguard of security and liberty. It has preserved the right of the American people to protect ourselves, our families, and our freedoms since the founding of our great Nation. Because it is foundational to maintaining all other rights held by Americans, the right to keep and bear arms must not be infringed.

Sec. 2. Plan of Action. (a) Within 30 days of the date of this order, the Attorney General shall examine all orders, regulations, guidance, plans, international agreements, and other actions of executive departments and agencies (agencies) to assess any ongoing infringements of the Second Amendment rights of our citizens, and present a proposed plan of action to the President, through the Domestic Policy Advisor, to protect the Second Amendment rights of all Americans.
(b) In developing such proposed plan of action, the Attorney General shall review, at a minimum:
(i) All Presidential and agencies' actions from January 2021 through January 2025 that purport to promote safety but may have impinged on the Second Amendment rights of law-abiding citizens;
(ii) Rules promulgated by the Department of Justice, including by the Bureau of Alcohol, Tobacco, Firearms, and Explosives, from January 2021 through January 2025 pertaining to firearms and/or Federal firearms licensees;
(iii) Agencies' plans, orders, and actions regarding the so-called "enhanced regulatory enforcement policy" pertaining to firearms and/or Federal firearms licensees;
(iv) Reports and related documents issued by the White House Office of Gun Violence Prevention;
(v) The positions taken by the United States in any and all ongoing and potential litigation that affects or could affect the ability of Americans to exercise their Second Amendment rights;
(vi) Agencies' classifications of firearms and ammunition; and
(vii) The processing of applications to make, manufacture, transfer, or export firearms.

Sec. 3. Implementation. Upon submission of the proposed plan of action described in section 2 of this order, the Attorney General shall work with the Domestic Policy Advisor to finalize the plan of action and establish a process for implementation.

Sec. 4. General Provisions. (a) Nothing in this order shall be construed to impair or otherwise affect:
(i) the authority granted by law to an executive department, agency, or the head thereof; or
(ii) the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
(b) This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
(c) This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

But... This executive order is long on rolling back the worst excesses of the drooling idiot, and suspiciously short of any substantive recognition of the reality of the 2nd Amendment.

Status Quo Ante Biden is a nice place to start, but our gun rights were not being defended vigorously by the administration even before Biden: Magazine restrictions, scary gun bans, purchase limits, harassment of honest dealers and collectors, nitpicking regulations obviously designed as de facto bans, restrictions on shooting on public land, and on and on and on.

For America to return to some semblance of true freedom, the 2nd Amendment has to be respected as the simple declarative statement that it is. Until that happens, our rights will be under attack, even by the Trump administration. Yes, they are broadly pro-freedom and pro-gun rights, but the the vast regulatory state that has been created to limit our rights will never respect those rights, because their very existence is predicated on restricting those rights. A leopard cannot change his spots, and the ATF cannot suddenly recognize the absurdity of its very function.

Will Donald Trump and Pam Bondi appreciate the opportunity to change the paradigm of American freedom and allow us to return to the first principles of America?

I'm not sure. Bondi is no friend of the 2nd Amendment, and Donald Trump is mildly pro gun, but without the appreciation of its importance that we need!

We shall see....

My small town upbringing formal Civics class lessons on the Constitution were simple - it was written in simple English not 'legalese' because it made for all men and is the foundation for any law to be written after.
Lesson the Amd 1st - it says "Congress" because it applies to the Congress.
Lesson the Amd 2nd - it does not specify Congress because it prohibits the federal, state, and anyfvckinbody from infringing.

25 The ATF for one needs to be reigned in, its war on bump stocks - needed by handicapped gun owners - needs to be ended. Reciprocity of gun permits between states needs to be as ubiquitous as it is for driver licenses, a moved resident can be required to reapply locally - with the default being, yes, you can - but the days of a legal permit holder committing a felony if they drive thru another jurisdiction with an otherwise legal gun needs to stop.

Oh, and I wish he would address with an EO states that require a firearm with a normal sized magazine to be half empty or goto jail.

I believe most of the most pressing concerns are various state law issues, which are beyond the scope of any EO. I would like to see the ATF folded into the FBI, but even there Kash needs to take over there and clean some more house first.

Think of invading Europe in 1944. You’d like to hit everyplace all at once, but you can’t. Trump has already done more than I thought he possibly could.

Agreed. We've gotten into the habit (in 3 weeks!) of thinking this administration is without limits on its capacity to address things, but they are not supermen. They need to do triage, and there are, at the moment, bigger fish to fry.

Our gun rights are better than they were when I was a kid and they continue to keep getting better. We have 29 States that have constitutional carry and reciprocity with multiple other States if you need to travel and have a permit. When I was a lad if you carried a gun for protection you were breaking multiple State and federal laws. If you were one of the lucky few to be able to get a permit to carry it was generally only good in your county of residence.


SCOTUS nuked the anti gun movement when they ruled that the 2nd amendment was an individual right. The nra and some other gun rights groups did not want that case going to SCOTUS because it could have gone the other way but here we are, a favorable ruling on something that should have never been in question.


It's a baby step process and we continue to make progress.

Yes, this is laying that groundwork but Trump has to first get his appointees in place.

He's moving faster than I ever dreamed, and this EO is packed with goodies. There is no other action he can take at this point, but having DOJ reverse itself in prosecutions and tank court cases by admitting that NFA is unconstitutional would be a massive win.

Passing a law is nice, but as the Dems proved, unwinding legal precedent is a lot harder.

I think you are underestimating how many jobs exist in the DC region that are not in some way impacted by government spending. The region didn't just coincidentally grow when government started ballooning in size. I bet many of those 75k were past retirement , already have enough to grab govt pension, and were just collecting massive paychecks. They already have second and even third retirement properties.

I have been assured many times here that Feds get outrageous retirements so money shouldn't be a problem. Also, if you have 2nd and 3rd properties, you would sell those first instead of selling your home at a loss.
