U.S. District Judge John Bates agreed to grant a temporary restraining order sought by the group Doctors for America, which argued that its members used the websites when treating patients and conducting research. The nonprofit organization said that the removal of the webpages by the Department of Health and Human Services and its components violated federal law. Bates found that the challengers were likely to succeed in their claims that the Department Health and Human Services, CDC and FDA acted unlawfully when they stripped medical information from public-facing websites. "It bears emphasizing who ultimately bears the harm of defendants' actions: everyday Americans, and most acutely, underprivileged Americans, seeking healthcare," he wrote. Citing declarations from two doctors filed in the case, Bates said if they "cannot provide these individuals the care they need (and deserve) within the scheduled and often limited time frame, there is a chance that some individuals will not receive treatment, including for severe, life-threatening conditions. The public thus has a strong interest in avoiding these serious injuries to the public health." His order directs the agencies to restore earlier versions of their websites by 11:59 p.m. Tuesday. I don't think the Dems believe any of this will work. I think the real goal is to try to buy some time for them to regroup and make a plan. Trump is deep inside their OODA loop, and they are completely lost.
In sports terms, this a team out of time outs committing a flagrant penalty to stop the clock. The coach will whine to the refts while the players get to catch their breath and the assistants try to draw up a play.
And given the attitude and experience of Trump's crew, I expect investigations to be launched as to why judges ordered illegal payments to be made.

As you may recall, it emerged during the FISA warrant portion of the Trump-Russia scandal that the judges, who are supervised by the Chief Justice, had never read the applications. Roberts apparently did nothing to rectify that. There's no reason to believe his sorry as would do anything now. Also, how many times has Thomas urged the USSC to step in on these universal injunctions originating in Hawaii or Rhode Island? Again, crickets. This may be absurd enough to wake him up but I doubt it.

This business were some tiny little podunk federal district judge can issue orders affecting the whole country, and about the executive branch powers is ridiculous.
I mean, some little judge named Master Bates being able to order POTUS to do or not do something about the internal affairs of the Executive Branch is laughable.
Understanding the 60 votes in the Senate, there should be a damned law that limits the jurisdiction of these district courts. Questions like this should go right to the Supreme Court, or at least an appellate court (Article III specifies SC original jurisdiction, and Congress can't change that, Marbury v. Madison also had to do with that).
A question of where POTUS is violating the law or Constitution in running the Executive branch should not be something a podunk judge has anything to say over.

People are tried ex-parte, which is against due process rights. So, it effectively erodes the due process rights of citizens the more standard it becomes.
It's the lack of gravity behind their use of this "exception" that is the real problem.
Also, it's a problem that know-it-all judges aren't taking a hint from the people about the kind of "vigor" they want in an executive, so they feel they can intervene every 5 minutes based on manufactured "danger".
It needs to be looked at from an opportunity cost and not just "we can do it".

How is SCOTUS co-equal to the President? The Constitution grants very narrow original jurisdiction to the Supreme Court.
Its appellate jurisdiction, size, composition are all set by Congress. Congress could unilaterally defang SCOTUS and reduce it to original jurisdiction only.
The President has numerous Constitutional duties that cannot be circumscribed by Congress.
The only thing co-equal about SCOTUS and the President is both can be unilaterally impeached and removed from office by Congress, and that said impeachments/removals cannot be challenged in any court.

There's no reason to attribute any motive other than cowardice and clock-watching to Roberts. He is the personification of the Republican Party. Trump should not only defy the orders he should announce he is doing so and criticize Roberts for not taking up the universal injunction issue after it was widely abused and other justices wanted to deal with it.
