Ratcliffe has already held a cabinet level position, years in Congress which always seems to help, US Attorney, etc.. He's sort of a textbook nominee.
Hegseth is anything but and there is no bigger pot of money in DC than in defense. A whole lotta graft at stake with someone who won't play ball and Hegseth has been pretty vocal that he won't.

Birthright citizenship is a creation of policy which can and should be ended by executive action. An Act of Congress to follow, then SCOTUS can uphold.
Also, SCOTUS can and does reverse its opinions when they are proven bad. e.g. sodomy, Chevron doctrine.

It's all BS. The executive order focuses on the “subject to the jurisdiction thereof” phrase. Dating back to 1898, at least, the 14th has always referred to babies born here, regardless of the citizenship status of their parents, except for foreign diplomats and/or children born of foreign military occupyiing US territory.
Every now and then SCOTUS actually does the right thing. In this instance I hope they either:
1.) Refuse to hear the case. Or
2.) Uphold birthright citizenship.
But, of course, I'm worried.
I know what Clarence and Alito will do! Unlike Roe V Wade, this has inherent constitutional support. Also overturning birthright citizenship will create an upheaval. So from a practical standpoint, Roberts will likely uphold birthright citizenship, simply because overturning it would be chaotic.

Well, the GOP has introduced legislation to deal with so-called birthright citizenship for illegal aliens progeny.
This is going to go before the SCOTUS and the probable outcome is them saying that congress can legislate in this area and then congress will legislate, as it should be.
No constitutional amendment should be necessary, the constitution literally says that congress has authority over citizenship, immigration and naturalization.
Will a law pass, perhaps, but at long last, it seems the GOP is grokking what time it is.

The problem is that the Amendment clearly said “all persons born” and then excluded 2 categories, native Americans and those not subject to the jurisdiction. Once courts ruled that even illegal aliens were subject to the jurisdiction, the next step was inevitable.
And the real problem is that all of the President’s and Congress’s have ignored this issue for 100 years, when they should have done something about it long ago.

This is the way. Deport the parents, and the anchor baby has to go with them. If the anchor babies/citizens want to come back when they're 18, they can do so. It's perfect, because the argument will be that the child has a right to be here now, so you offer a compromise. The parents can be deported, and the child can be given up for adoption to an American family. Let's see how many of those people actually care about their own children as anything other than a meal ticket.

I simply do not understand why the jurisdiction nonsense has been construed to mean that an illegal alien crossing the border dropping a baby on this side of the border means that baby is a US citizen, it's absurd, patently absurd.
The guy who wrote the amendment expressly said the amendment had nothing to do with the status aliens.

since you apparently have read about the 14th and the guy who wrote it. Did he mention why freemen /slaves weren't mentioned specifically in the Amendment if it was specific to them?

The framers had a thing about using the word 'slave' under the assumption it would quickly fade away. I imagine subsequent amendments follow that practice.

Even I would oppose that, because I believe we have already gone much too far down the Imperial Presidency Road, and I want to see Congress perform its intended duties.

So no, people have interpreted the amendment this way, but that is all it is - looking at the actual history, it was never meant to convey birthright citizenship.

yes and ...no. The Supreme Court’s Wong Kim Ark decision from 1898 stated that the person in question was a U.S. citizen...but his parents, despite being foreign citizens, resided here legally. They said the term “subject to the jurisdiction thereof” was the deciding factor. The children of illegals are not here legally, hence not subject to "the jurisdiction thereof." The children of H1B visa holders would be citizens.
In the 1950s, the U.S. expelled around 1 million Mexicans here illegally, and their children, born here. No one claimed the children born here were citizens.
