A Hawaiian judge, from Washington, halted Trump's executive order ending birthright citizenship.

Don't worry, this was inevitable and necessary. There is a (weak) Supreme Court precedent that the 14th Amendment recognizes birthright citizenship; the Supreme Court would have to overturn that "precedent" before this new understanding could take hold.

I think the Court will unfortunately uphold the prior precedent, because Roberts and Coney-Barrett are establishment liberals. Kavanaugh and Gorsuch are weak, too.

But we'll see.

Pete Hegseth "advanced to a final vote," which will take place tomorrow. I assume this means the Senate voted to close debate, that is, they stopped any filibuster.

Murkowski and Collins voted against him. McConnell didn't, but bear in mind, this is just a vote to have a final vote. McConnell may say -- probably will say -- "I voted for cloture because a nominee deserves a vote, and now I'm voting against him.


Sen. Lisa Murkowski announced Thursday that she would vote against confirming Pete Hegseth to lead the Pentagon, becoming the first Republican to oppose one of President Donald Trump's Cabinet picks.

Maine GOP Sen. Susan Collins also voted against Hegseth.

The Alaska Republican’s decision comes ahead of a crucial test vote to advance Hegseth’s nomination toward confirmation, according to the Associated Press.

The Senate voted 51-49 to advance Hegseth's nominiation. The final vote will take place Jan. 24.

The Los Angeles Times reported that if Acosta refuses to accept the midnight shift, "he may exit the network," according to figures familiar with his thinking.

Birthright citizenship is a creation of policy which can and should be ended by executive action. An Act of Congress to follow, then SCOTUS can uphold.

Also, SCOTUS can and does reverse its opinions when they are proven bad. e.g. sodomy, Chevron doctrine.

If SCOTUS fucks this one up it'll be another Dred Scott. We'll be in another civil war, a hot one, not like the cold civil war we're in now.

It's all BS. The executive order focuses on the “subject to the jurisdiction thereof” phrase. Every now and then SCOTUS actually does the right thing. In this instance I hope they either:

1.) Refuse to hear the case. Or

2.) Uphold birthright citizenship.

But, of course, I'm worried.

I know what Clarence and Alito will do! Unlike Roe V Wade, this has inherent constitutional support. Also overturning birthright citizenship will create an upheaval. So from a practical standpoint, Roberts will likely uphold birthright citizenship, simply because overturning it would be chaotic.

The problem is that the Amendment clearly said “all persons born” and then excluded 2 categories, native Americans and those not subject to the jurisdiction. Once courts ruled that even illegal aliens were subject to the jurisdiction, the next step was inevitable.

This is the way. Deport the parents, and the anchor baby has to go with them. If the anchor babies/citizens want to come back when they're 18, they can do so. It's perfect, because the argument will be that the child has a right to be here now, so you offer a compromise. The parents can be deported, and the child can be given up for adoption to an American family. Let's see how many of those people actually care about their own children as anything other than a meal ticket.

381 I take issue with the idea that the 14th was just for slaves; there were also a great number of Europeans here who never went through any immigration or naturalization - they just moved over and made their way to the plains, easy to do without much interference before the 1890’s. The constitution of the state of Oregon, as originally written, forbade banks to operate within the state - there were a number of reasons for this, but as a result early Oregon statehood had banks that acted more like high value pawn shops.

Ambassadors who have children in the U.S. - their children are NOT U.S. citizens. Despite being born here.

So no, people have interpreted the amendment this way, but that is all it is - looking at the actual history, it was never meant to convey birthright citizenship.

yes and ...no. The Supreme Court’s Wong Kim Ark decision from 1898 stated that the person in question was a U.S. citizen...but his parents, despite being foreign citizens, resided here legally. They said the term “subject to the jurisdiction thereof” was the deciding factor. The children of illegals are not here legally, hence not subject to "the jurisdiction thereof." The children of H1B visa holders would be citizens.

In the 1950s, the U.S. expelled around 1 million Mexicans here illegally, and their children, born here. No one claimed the children born here were citizens.
