Julie Kelly: Insurrectionist Judge Refuses to Honor Trump's Pardon of Two J6ers

This is outrageous: One of the Trump-hating judges who gleefully sentenced J6ers to prison for "parading in a public place" is now refusing to honor Trump's pardons of J6ers."

DC JUDGES ACTING REALLY BADLY:

Hoy sh*t. This gem from former chief judge Beryl Howell, an unabashed Trump hater, who denied part of new DC US atty motion to dismiss J6 indictment following Pres Trump's pardon. She calls the president's pardon proclamation "flatly wrong."

When you see someone claiming these proceedings were fair and impartial, present this tirade to them.

Long past time to impeach this desperate, bitter hag.

"The only reason provided for this instruction, as set out in the [President's] Proclamation's introduction, is the assertion that this action 'ends a grave national injustice that has been perpetrated upon the American people over the last four years and begins a process of national reconciliation.

No 'national injustice' occurred here, just as no outcome-determinative election fraud occurred in the 2020 presidential election. No "process of national reconciliation" can begin when poor losers, whose preferred candidate loses an election, are glorified for disrupting a constitutionally mandated proceeding in Congress and doing so with impunity. That merely raises the dangerous specter of future lawless conduct by other poor losers and undermines the rule of law.

Yet, this presidential pronouncement of a 'national injustice' is the sole justification provided in the government's motion to dismiss the pending indictment.

Having presided over scores of criminal cases charging defendants for their criminal conduct both outside and inside the U.S. Capitol Building on January 6, 2021, which charges were fully supported by evidence in the form of extensive videotapes and photographs, admissions by defendants in the course of plea hearings and in testimony at trials, and the testimony of law enforcement officers and congressional staff present at the Capitol on that day, this Court cannot let stand the revisionist myth relayed in this presidential pronouncement.

The prosecutions in this case and others charging defendants for their criminal conduct at the U.S. Capitol on January 6, 2021, present no injustice, but instead reflect the diligent work of conscientious public servants, including prosecutors and law enforcement officials, and dedicated defense attorneys, to defend our democracy and rights and preserve our long tradition of peaceful transfers of power--which, until January 6, 2021, served as a model to the world--all while affording those charged every protection guaranteed by our Constitution and the criminal justice system.

As to these two defendants specifically, both admitted their criminal conduct under oath, after consultation with their attorneys, and pursuant to plea agreements to which they agreed. Bluntly put, the assertion offered in the presidential pronouncement for the pending motion to dismiss is flatly wrong."

She dismissed without prejudice instead of with prejudice as DOJ asked.

That means that a later DOJ can revive the charges. She's simply blowing off the pardon.

This is insurrection.

Put this rancid insurrecting leftist in the cell that used to hold a J6er.

Howell was one of the judges rubber-stamping every motion by illegal prosecutor Jack Smith.

So was Tanya Chutkin, who is also ranting about the pardons.

Politico reports on the judicial insurrection:

Howell, who presided over several secret proceedings in special counsel Jack Smith's criminal cases against Trump -- issuing key rulings that required some of his top aides to testify to a grand jury -- was not the only judge Wednesday to defend the Jan. 6 prosecutions.

U.S. District Judge Tanya Chutkan -- who was slated to preside over Trump's own criminal prosecution for seeking to subvert the 2020 election before his 2024 victory ended the case -- said Trump's mass pardons "cannot whitewash the blood, feces, and terror that the mob left in its wake."

"It cannot repair the jagged breach in America's sacred tradition of peacefully transitioning power," Chutkan wrote in an order connected to a Jan. 6 felony case. "In hundreds of cases like this one over the past four years, judges in this district have administered justice without fear or favor. The historical record established by those proceedings must stand, unmoved by political winds, as a testament and as a warning."

U.S. District Judge Colleen Kollar-Kotelly said Trump's action could never change the "immutable" record of violence and heroism of law enforcement, which will remain enshrined in court records.

"Dismissal of charges, pardons after convictions, and commutations of sentences will not change the truth of what happened on January 6, 2021," Kollar-Kotelly wrote in a six-page order dismissing charges against Dominic Box, whom she had previously convicted of two felony counts for his role in the riot.

"What occurred that day is preserved for the future through thousands of contemporaneous videos, transcripts of trials, jury verdicts, and judicial opinions analyzing and recounting the evidence through a neutral lens," Kollar-Kotelly wrote. "Those records are immutable and represent the truth, no matter how the events of January 6 are described by those charged or their allies."

Impeach.

1. Can the president wave immunity for executive employees? Since immunity is a penumbra invented by the judicial branch, I don't think the rules are written down anywhere.

2. He wouldn't be able to do that with judiciary employees, even if he could with executive employees.

3. Lawbreaking shouldn't be covered under immunities, so it shouldn't be necessary anyway.

43 She's not blowing off the pardon. She's blowing off the DOJ's motion to dismiss with prejudice. There was bound to be some messiness with these. Trump could have issued a pardon to everyone. But instead he issued pardons to those convicted and instructed the DOJ to seek dismissals with prejudice of all cases that were not yet concluded. Judges have to actually grant those. They are not automatic. So, Trump will likely have to issue a second round of pardons for anyone who did not receive a dismissal with prejudice. That is the safest root for these J6 defendants. Otherwise, another DOJ could go back and try to bring charges again.

Trump issued pardons for thing people were actualy convicted for. Biden gave blanket pardons for everything within a 10 year period. He only qualifed it as "non-violent" crimes.

The cure is a writ of mandamus to the judge involved from a higher court. But, in this case, the higher court is the Obama dominated DC Court of Appeals. That is why these 'judges' are behaving this way, they figure they are covered.

The Wizard of Scotus, aka Roberts, has cert jurisdiction of the writ of mandamus only from the lower court which means resolution has to go through the DC Circuit of Appeals first.

The persons were still facing charges for Jan 6 in that court (and thus could be held for trial, etc.). The judge refused to recognize their pardon (which bars future prosecution) and instead dismissed their case with no prejudice (which means a future DOJ could resurrect it and there are collateral consequences such as gun purchases, etc. that could be affected from her refusal to recognize these people can no longer be charged for Jan 6 period. The decision has been made far above her miserable little court room by a force majeure--a presidential pardon which stops all federal attempts to resurrect a dead case.

Easy enough to destroy their little jurisdiction by statute and move them into the Maryland district.

There is also curiously enough a Scotus precedent, Stuart v. Laird, that allowed Jefferson and the Democrats to eliminate new judgeships and reinstall Justices to have to ride the circuit to hear cases. Marshall court, on an appeal, recognized congressional control over jurisdiction is plenary and thus Congress with the President can create or eliminate courts as necessary.

Sort of like a RIF for judges. Never been used since then.

House impeaches, Senate removes. Funny enough, the Senate does minor impeachments other than the president via a committee which reports out to the whole Senate.

Changed the rule in the 30's and one impeached judge, Walter Nixon, challenged his removal by such means. he claimed he had a right to a full trial before the Senate. Scotus said nope and that was that.

But, an impeachment inquiry launched in the house removes all barriers to do an anal probing of any impeached person that they want to do. Tax records, lawyer client privilege, etc. are all available even if the information was considered protected before impeachment.

Impeachment is not considered a criminal process so all information is fair game and all witnesses can be compelled to show up and provide evidence.

- jurisdictional stripping

Federal courts (except SCOTUS) were established by Congress, who can restructure them at will. Most of SCOTUS’ power is granted by Congress.

Congress prior to the 1960's or early 70's, I forget, had the power to run DC as its own fiefdom. After the riots in DC, Congress created home rule but still retains the constitutional power to remove it at any time or even over a specific policy not to its liking. It is the federal district in the Constitution, not the city of Washington, Georgetown, Alexandria until the 1840's, etc.
