Demented Tyrant Biden Now Presumes to Change the Constitiution By His Kingly Pronouncement, Adding an Amendment to the Constitution Via a Tweet

The Equal Rights Amendment or ERA had a provision requiring the amendment to pass, or not pass, by 1982. It did not pass.

Some states have since ratified it. But others have reversed their initial ratification.

The left takes the position that the states which reversed their ratification had no power to do so, and that once you ratify, it's forever. Strangely, they do not take the position that the states that refused to ratify it are stuck with their non-ratification forever.

It's all immaterial anyway, as the ERA amendment process expired forty-two years ago. To pass it, people would have to submit a new amendment.

Biden just announced that he was using his Kingly Authority to recognize the amendment as "ratified."

He made this pronouncement two days before he's to be booted out of office, and via a Twitter post.

I always consider presidencies to be defined by two different baskets:

One, the basket of general Goods which everyone accepts are good, like managing the economy well and keeping the peace (or winning wars). It's hard to put eggs in this basket. This is the basket that makes presidents great, or failed.

The other basket is just all the partisan shit a president can do, like invoking or canceling the Mexico City policy. I'm not saying these partisan initiatives aren't important. I'm saying they're relatively easy. They take no effort it they're just executive orders, and legislation is easy enough if you control the Congress.

Biden obviously is a huge failure. He drove the economy into the ground, locked people in their homes for a year, mandated a dangerous experimental non-vaccine, set the government to prosecuting citizens for their political beliefs, and set the government to censoring citizens and making them afraid to speak their minds.

He also botched the Afghanistan withdrawal, resulting in 13 servicemen's deaths and countless Afghan allies left to be killed by the Taliban, and his senile weakness provoked two wars, one begun by his political donor Putin, the other one by Hamas, who knew Biden was too weak to defy the Michigan Arab vote.

So he is a failure by the real measure -- he has nothing in the basket of general goods.

But he's a vain, egotistical and extremely stupid man who craves a legacy.

So what does he do as the lights fade on his miserable usurped presidency?

He just starts shitting out partisan declarations, declaring an amendment shall be Deemed Passed on his authority, or rewriting Title IX to not protect women, or once again usurping the power of Congress to make the laws, declaring that people don't have to pay back student loans because he says so.

All of this to generate some kind of "legacy" for himself. The rest of the country will continue to hate him and rank him among the worst presidents in US history, but he wants to at least create a base on the far, far left who will recognize him, favorably, as the most extremist leftwing president the country ever had.

Where's the proof that he did this? We all know that he doesn't run his social media account, but this action is attributed to him, his desires.

This social media ploy is unimportant. It's already dead and doesn't matter, but it extends to everything else happening in his name over the past few weeks and the next few days: Is he doing them?

His signature is the symbol of his authority as president of the United States...but is he signing anything? We have video of him a few days ago not even knowing where to sign something. Who thinks he's actually signing hundreds of pardons and EOs right now?

If he's not signing them, are they legal? If his staff is just throwing stuff under the Autopen, does that carry the same weight as the man himself signing with his own hand?

In 2024, the left put up Kamala Harris, YAS SLAY KWEEN, who ended up with 6 million fewer votes than Biden while Trump got 3 million more votes than in 2020.

One of the awful problems that Scotus sometimes has is when the political bodies of Congress and executive branch officials refuse for political reasons to do what is right. In, Fletcher v. Peck, Marshall's opinion said, regardless of the documented wholesale corruption of Georgia's government in granting land to speculators that bribed them, that a deal was a deal. They justified it that allowing a subsequent Georgia government's reversal of those land grants would impose harm on individuals buying the land in good faith.

See something similar in the Cherokee cases, the Guarantee clause, segregation (eventually even ratifying it via a court case), the Trump decisions, and the evisceration by the executive branch of the 4th amendment via warrantless general searches under the rubric of national security.

Ideally, Justice should be done though the Heavens may fall but rarely true.

Close enough, language came from the Magna Carta, but Framers changed that to the modern version--due process.

Law of the land had specific reference to Norman kings promising to follow the existing system of English rights and privileges.

The other Norman kings treated it as boilerplate and then did what they wanted but for practical reasons followed a lot of old Anglo Saxon law. King John, though, a horrible ruler in almost everything he did, ignored even a pretense of existing law. He would openly take bribes from both parties to decide cases in their favor and then decide as he wished for example. Imposed all sorts of requirements on barons, appointed foreigners to misrule on his behalf, and bankrupted the country to regain lost lands in France.

For fun, fed. district court judge opined a state could rescind amendment ratification prior to overall 3/4's approval occurred. Idaho rescinded its ratification (followed formally by four other states) just before the ERA revised deadline was up. Was sued by ERA supporters and thus the district court decision came about.

Was headed to Scotus but the failure of the ERA to get 3/4s of states to ratify before the deadline (even with Idaho's initial ratification), meant the case was moot.

I'll defend late Voyager a good bit, but Ronald D. Moore had a good little story about joining the writers' room briefly.

He was a major player in writing late TNG, and as that wound down, he got hired to be part of Voyager several years into its run.

He lasted about a month, his frustration stemming from a highlighted moment where he asked one of the others in the writers' room, someone who'd been there for years, "So, who is B'elana Torres?"

All Moore got in response was a shrug.

Registrar of National Archives disagrees as the legal custodian of such things (or did previously) so it would be like some hick court using it to overturn some state law over abortion or troon rights is my guess. Then an appellate court will probably strike it down, if not then Scotus.

Caselaw itself was settled in the 30s as to Congress setting time limits on ratification.

Scotus, against Dred Justice Roberts wishes, would do far better with the whole legal resistance by simply Granting Cert, Vacating the lower court ruling, and Remanding to the lower court to fix its mess. Aka GVR. Used it a lot in segregation era to stop using the courts to massively resist desegregation. No reason really to opine on settled law in this case.

Founders actually disagreed over whether to even put impeachment in the Constitution as the convention actually occurred during a famous English impeachment trial that ended up in failure to impeach. It was put into the Constitution as a last ditch effort to remove a tyrant but many at the Convention, based on the British experience with it, scoffed at it being employed successfully. Clinton precedent pretty much made it a slap on the wrist and the Dems doing it twice to Trump have devalued it further.

More fun is considering why Kamala and the Dems did not invoke the 25th Amendment to remove ole Puddin Brain. She would have become prezzie just as Al Gore might have if he signaled to Dems his support for removal of Bill Clinton.

Probably wrong, since it was put up in 72. Someone in a state legislature who was 25 would be 78 now. If you counted states voting later up to 1982...and some states did deratifications even later just to keep it off the edge of ratification.
