I believe this is the gist: Young alleges that after CNN's defamatory hit-piece, he was unable to secure work for a number of years. CNN's lawyer David Axelrod called him a "liar" repeatedly in court, brandishing a piece of paper which he claimed was a "smoking gun" representing Young signing an employment contract. But it turns out that Axelrod lied utterly about what this paper was. It was not proof that Young had secured a job. In fact, it was just a form Young signed to keep his security clearance. And Young just found out that his security clearance had been ended -- possibly due to CNN's hit-piece. Young's lawyer moved to allow evidence to this effect, including a witness who would confirm Young's security clearance was canceled. David Axelrod objected to this evidence, leading the judge -- exasperated by Axelrod's lies -- to blast him. Fox: It looks like CNN should start limbering up its check-writing fingers. That's not all the bad news. From John Sexton, CNN will also have to explain texts from its own editors expressing their profound discomfort with airing this smear-job made WITHOUT EVIDENCE: So CNN's editors themselves say this was a bad-faith hit-job and malicious intent.

I think CNN is playing this out for the appeal. Any lawyer for CNN can't possibly look at this and not think settlement is the best option. CNN is getting crushed at trial. But I think CNN's strategy is to win on appeal, regardless what happens at trial.
There are many defamation cases against media companies that win at trial, only to be reversed on appeal. The appellate judges tend to view the Sullivan case as guaranteeing an almost unlimited immunity for media companies to say whatever they want. Sullivan should be overruled. That doesn't seem right. I once had a security clearance. It was not renewed because the project I had it for had ended and management did not want to pay for its renewal. Now that I think about it, that makes it even weirder. All that hyperbole and emotion--that's the kind of garbage you do in front of a jury. If you're playing to a judge by doing that, that's just insane.
--- CNN was waving the paper in front of the jury, calling the plaintiff a liar, implying to the jury that the paper he was holding was proof he was lying. That the paper was proof he had been employed. Then, after the plaintiff had rested (can call no more witnesses, can only cross-examine the witnesses CNN calls), CNN provided a copy of the paper. Which was actually proof of the opposite of what CNN said it said. But what it means needs to be explained to the jury and the doc admitted. Plaintiff wanted to re-open their case, to put on a witness to testify about the doc. CNN then objected, saying it hadn't been admitted and plaintiff had rested--basically pulling a fast one trying to prevent the jury from seeing the actual doc. That's why the judge is pissed--CNN has broken several ethical, procedural and discovery rules here. Then lied to the court, denying they called the plaintiff a liar. Despite this, CNN put up an expert witness that testified that Young could still get a job in his field. (This probably ended up backfiring on them, since their expert witness conceded that if he doesn't have it he is "dead in the water" as far as getting another job.) 3 - CNN's lawyer lied about how they got the document, because he didn't want the judge and Young's team to know about the subpoena, since CNN was, at the same time, arguing (successfully) that Young's lawyer couldn't use that type of subpoena to get documents. 86 I think CNN is playing this out for the appeal. Any lawyer for CNN can't possibly look at this and not think settlement is the best option. CNN is getting crushed at trial. But I think CNN's strategy is to win on appeal, regardless what happens at trial.
There are many defamation cases against media companies that win at trial, only to be reversed on appeal. The appellate judges tend to view the Sullivan case as guaranteeing an almost unlimited immunity for media companies to say whatever they want. Sullivan should be overruled. There are many defamation cases against media companies that win at trial, only to be reversed on appeal. The appellate judges tend to view the Sullivan case as guaranteeing an almost unlimited immunity for media companies to say whatever they want.

Just found out recently that a teen in my life was hit on by a teacher at school. Teen is straight so deflected the attempt, but didn't tell anyone. The teacher has now been suddenly suspended and pulled from teaching at the school, but they won't say why. I can guess why the teacher was suspended. A lot of those appellate media cases like Westmoreland v. CBS were in the era where there was not IM and email and journalists were regarded as having more professional standing and standards. A manager LOLing in an email about a story having problems is de facto evidence of reckless disregard of the truth or malice. And it was not just one internal document but multiple ones. The courtroom trick was also a stupid one to try as it cast aside the mantle of innocence by CNN. The premise is if your lawyers lie in court and mislead the judge, then what else is CNN capable of. About the same effect as moving a perp's body outside to halfway inside a home to claim self defense. In case my wording was confusing: the teen wouldn't have given into the teacher if they were also gay. They know it's wrong and gross for any teacher to hit on them. Assuming the next 4 years run smoothly and things are good in 2028, Vance will be the nominee easily. If it’s a shitshow 4 years it’s probably moot who is the nominee since a Dem will win.

A friend of mine who helped fight a few of those types of fires back in the 70's told me that many victims of some of those fires were never found.
