Congress Certifies Trump's Huge, Luxurious, Crushing Victory

Craig Sicknick, still lying about how his brother died (he died of a stroke, it had nothing to do with January 6th), called for an insurrection over the weekend, demanding Congress refuse to certify Trump's election.

Which is, literally, what they claim made Trump an insurrectionist.

This isn't hypocrisy, it's their attempt to assert a hierarchy whereby they are elevated to a new aristocratic rank and have unlimited power to impose rules on the lower orders while being free of those rules.

And the public has rejected it, hard.

Doesn't appear to be true. From a brief perusal of the Federal Oil and Gas Royalty Act and the earlier, 1953 Outer Continental Shelf Lands Act, the language of those laws makes it clear that the Secretary of Interior has the power to promulgate regulations, not the president. That would make Biden's EOs vulnerable in court as violating the APA (Administrative Practices Act) which regulates how rulemaking is to be done.

States also have the statutory standing to sue right now for an injunction to stop Biden's actions which I rate as probable for Texas, LA, and Alabama among other states.

From a brief perusal of the Federal Oil and Gas Royalty Act and the earlier, 1953 Outer Continental Shelf Lands Act, the language of those laws makes it clear that the Secretary of Interior has the power to promulgate regulations, not the president. That would make Biden's EOs vulnerable in court as violating the APA (Administrative Practices Act) which regulates how rulemaking is to be done.

States also have the statutory standing to sue right now for an injunction to stop Biden's actions which I rate as probable for Texas, LA, and Alabama among other states.

Chevron/Looper dealt with interpretation of law by agencies, not statutory authority given to an agency by Congress. Those statutes I mentioned give explicit power to the Secretary of the Interior and unless Scotus is willing to chuck out the APA (very unlikely) or the concept of administrative rulemaking altogether, Chevron/Looper have little to do with interpreting those statutes by court.

News media gets law facts wrong frequently so it is possible that Biden used a National Monuments designation or some other source where the president has statutory power to make a semi permanent declaration which has really not be adjudicated much. Think there was a case during the first Trump administration where he rolled back something Obama claimed as a national monument but haven't frankly followed the case.

The DACA case was not really reported correctly when it went to Scotus. Trump had the power to do it said the court but did not follow the proper procedural guidelines when he tried to reverse it.

Dept of Homeland Security sandbagged Trump by not doing its proper due diligence on the reversal which led Scotus to take the easy out.

If a friendly oil and gas state like Texas decided to sue in federal court to negate the Biden ban, Trump could choose to settle the lawsuit by siding with Texas that the prior administration's act was illegal. Pay the Texas AG for filing it as well.

There is also the Recission Act passed during the Gingrich era in Congress that allows Congress to strike down an administrative rule by a vote which the president can then sign or veto as law. Doing it this way would present a permanent bar on doing that particular rule without a new law granting that power in the future (ceterus paribus assuming the left was interested in following the law).

The good news is assuming the 2030 count is legit, red states will clean up. I’ve seen projections as high as a net 15 seat swing between blue and red states. That’s like getting North Carolina for free.

Citizens can band together and sue. Several years ago, a large county in the LA metroplex was sued under the MVRA (Motor Voter) for not purging its voting records and hundreds of thousands of registrations had to be removed under federal court order.

Citizen groups are given explicit standing to do the purging via court lawsuits as are the state itself.

I actually just skimmed the Judge Gleeson decision (AK Dist Court) and it was not appealed. But that does not make it binding precedent in areas outside of the 9th Circuit. It was LCV v. Trump case that everyone is breathlessly applying in the media without reading the primary source. There was also no action by Congress to rescind the rule under the Recission Act.

What the court reasoned is that two sections of the statute at issue had to be read separately and that since the statute did not explicitly grant presidential ability to rescind a regulation in Section 12 that overrode the countervailing Section 8 implying otherwise.

Case authority cited was weak in the opinion because most eo precedent holds that one president can bind but another remove and that one president cannot bind another in the future (also see Congress for that particular jurisprudence).
