Which is more than standard civil-suit negligence. Yeah, the distinctions between "recklessness" and "criminal negligence" are thin and nebulous. The jury reported they were deadlocked on the top charge. On a motion from prosecutors, the judge dismissed manslaughter as a charge. I assume their idea is that they will clear the top charge so that the jury can compromise on the less-serious charge. But.... to be honest, I think the jury members who believe in the right to self-defense could have been pressured to accept the lesser charge to avoid the more serious charge. By dismissing the most serious charge, the defenders of self-defense (and simple reason) can no stick to their guns and refuse to convict on the lesser charge, too. The manslaughter charge is now gone, forever. If it had gone to verdict, and the jury was still deadlocked, then the Soros prosecutors could have re-tried that charge. But having dismissed it, it is now dismissed with prejudice, extinguished. (There's some rule that once a jury is empaneled, the charge cannot be dismissed without prejudice. That keeps prosecutors from continually charging, then dismissing, then re-filing charges against someone to keep in in court forever without resolution.) The jury has been dismissed and will reconvene on Monday. This is certainly good news for Perry, but if the jury deadlocks again on the second charge, then Alvin Bragg and his murderer's row of racist prosecutors will just charge him with that crime again. In Trump's first month, he should charge the DOJ with conducting an investigation into Bragg's DA office for discriminatory prosecution based on race. She has admitted she gives black defendants very light charges because they've had "hard lives." Video below.

Apparently, the NYC cops could not keep the CEO killer from hopping on a bus out of town...and I'm not even sure they know which bus. I just don;t understandhow these prosecutors get away with doing things so blatantly illegal. There seem to be no judicial oversight. A lot of commenters are saying that by doing this, they are coercing the Jury. The rule was if they could not find Penny guilty on the first charge, they could not then go to the second one. So, they wiped the first one forcing the Jury into a compromise situation. They even told the jury before they began deliberations that if they found him guilty, he would probably get a light sentence. Again prejudicing the jury which ia also illegal and grounds for a mistrial.

There is little restraint on this except for ethics which these bastards don't even have. One of the only cases I remember where an appeals court struck down duplicitous charges was for a guy who robbed a poker game. The prosecutors charged him with six different counts for each of the players he robbed; the appeals court said this was a continuous and unified crime and he should be charged with one count of robbery. The idea is that, since we have degrees of a crime, the Lesser Degrees can be considered if the facts of the case don't align with the Maximum Charged. Hence Lesser Included Charges. Which it completely unfair, imo. If you aren't charged at the specific degree, you should not be able to be convicted of that crime. The Burden to meet the Requirements for a Charge are on The State. That was something I noticed during the Laken Riley trial. They had charged the scumbag with several counts of felony murder (ie death resulting from a felony committed by the defendant), in addition to the actual murder charge. The judge found him guilty on all counts, but there was something about the felony murder being "vacated as a matter of law". I agree with you Ace - dismissing the top charge makes conviction on the 2nd charge *less* likely. If I were a juror who held out for not guilty on the top charge, I'd still be holding out and going for a hung verdict on the 2nd charge. The prosecution just admitted that they had no confidence in their top charge and were wasting the jury's time with it, why trust them at all?

I think it's been said upthread that if a case is dismissed after a jury has been seated, then it is treated as an acquittal and charges are dismissed with prejudice, ie cannot be refiled under double jeopardy rules. I think it's been said upthread that if a case is dismissed after a jury has been seated, then it is treated as an acquittal and charges are dismissed with prejudice, ie cannot be refiled under double jeopardy rules.

Now, after the jury could not find Penny guilty of recklessness after four days — and how disturbing it is that one or more jurors were apparently in favor of doing so — the judge is letting Bragg remove the recklessness count from the case. It will go down as an acquittal for Penny on that charge, so he is no longer facing a potential 15-year prison term. For the jury, however, it makes the hard work of the last four days pointless.

Blah Blah says living in the Upper Eastside is pretty tough nowadays. Not only is it hard to get Thai food at 4 a.m. on Mondays, but the traffic is so bad that it is very difficult for us to catch our Wednesday flight to Miami Beach to stay at our 3rd vacation home.
