The Supreme Court of the United States will hear oral arguments Tuesday in VanDerStock v. Garland, a case focused on the ATF’s unilateral action to redefine what constitutes a “firearm.” The case revolves around ATF Final Rule 2021-05F, which placed new controls on gun parts kits and firearms which Democrats describe as “ghost guns.” A central part of this rule was redefining what the word “firearm” meant so as to designate “partially completed pistol frames” and other gun parts as “firearms.”
Here's a good definition of a gun: If it can fire, it's a gun. If it can't fire, it's not a gun. What these bureaucrats are aiming for is the definition of every part of a weapon as the weapon itself, so if you need a $1 firing-pin spring or a $2 grip screw you will have to purchase it through an FFL and file a 4473. My experience with gun owners is that they are law-abiding folk. But it is arrant nonsense such as this that drives people to decide that next time they'll just buy from friends or build their own. And the ingenuity of the American gun enthusiast knows no bounds. They will stay ahead of the ATF...legally or murkily. Of course if the ATF really cared about so-called "gun violence," they would go after guns possessed by convicted felons. You know...in the inner cities...where the Democrat voting strongholds carefully protect those felons. But they do not care about bad guys using guns to commit crimes. They care about expanding their vast database of legal gun owners, and they care about the ultimate goal of their masters...confiscation of all guns in America. Well...except for those felons' guns...those are okay.

This is a direct fault of congress not doing their job. It is their job to craft laws that apply to the country but they have refused to do so and have abdicated that responsibility to the deep state.
When they write a law these days they insert a bunch of language such as "the secretary shall determine" and "the secretary may".
It's a cop out but they keep doing it because nothing bad ever happens to to hem.

One of the characteristics of blue areas is that they constantly demand new gun laws, while refusing to enforce the gun laws currently on the books.
If you want to see crime plummet in this country - make it an automatic prison sentence upon conviction to be a felon in possession of a firearm, or to use a firearm in commission of a violent felony.

Of course, I don't have anything like that, but how on earth do these people think they could even confiscate weapons that are without serial numbers, old weapons, self-made weapons, and stolen one? Expecting every owner just to turn them in?

I do not own any guns. Hubbymayhem does own a shotgun but he bought it so long ago that there probably isn't any record of the purchase any more. We are storing several guns for my dad. Pappymayhem wanted one of every type of gun. He didn't manage to collect all of them before he passed and couldn't take them with him. But we have them because we don't want to face the wrath of the spirit of Pappymayhem. So even though there are several guns in my house there are no records of those weapons with my or Hubbymayhem name involved. Also, he had a fuck ton of ammo for all of his guns.

I don't think they'll even need Loper. As the lower court (or the plaintiffs, I can't recall) pointed out, in the statute the ATF is relying on, Congress defined "firearm" in a way that doesn't include the ATF's current definition. It also used the terms "parts" and "firearms" in a manner that makes clear that they meant different things. Normal rules of statutory construction should make this a slam dunk. But having Loper in their pocket doesn't hurt, either. Either way, I expect 6-3 in our favor, with the usual idiots dissenting on the feelz.
Now, we'll see if SCOTUS follows through on actually trying to enforce Loper.

First thing I would do, is to peel-off the "Firearms" from ATF, and make it a Help Desk division of the Civilian Marksmanship Program.
First order of business, would be rounding up all those BILLIONS of rounds of ammo that every damn agency down to the groundhog keepers have in the armories they ought not have.
Have to work out a way to put all that ammo on the market, without causing a catastrophic price collapse to the ammo factories, given today's costs of materials, ramped up productions, and etc.

The 2nd Amendment is literally the most straight forward and clear of all of the amendments with a fairly good foundation of why the framers put it in the constitution and yet, here we are with a case that should never have had to been brought in the first place.

Note that California law classifies ALL Glocks as "unsafe handguns" because they do not have a compliant chamber load indicator, lack a magazine disconnect mechanism, and until our lawsuit caused California to repeal the requirement, of course lacked microstamping.
The only reason we can still buy Gen 3s is because they are grandfathered in, but they are still "unsafe handguns". We can't buy more modern Glocks new in gun stores (just secondhand from exempt cops, or from those who moved here with them from other states).
She supported the Unsafe Handgun Act and expanded it such that microstamping began to be enforced in 2013. So why does she own an "unsafe handgun"?

The 2nd Amendment is literally the most straight forward and clear of all of the amendments with a fairly good foundation of why the framers put it in the constitution and yet, here we are with a case that should never have had to been brought in the first place.
I can't wait to see what sort of reasoning the three female leftist dipshits on the court vomit out.

Don't waste precious court time anymore on the massive resistance that blue states are doing. Simply vacate the lower court ruling and remand--repeat as necessary. In the seg. era, Scotus lost patience with the massive resistance to Brown and simply bitchslapped the lower courts over and over again using little energy to do it.

The first clauses explicates the reason, the 2nd offers the remedy.

Eliminate that whole first clause and just leave this: "The right of the people to keep and bear arms shall not be infringed."
I would support a Constitutional Amendment that eliminated that previous clause, which is the source of the "confusion" among people who cannot read plain English.

As a woman who owns 3 Glocks including a purple one, I would highly recommend them. However, I do not believe Harris actually owns one. She probably knows Glocks because a lot of LEOs carry them and it was the first thing that came to mind. All her answers seem to be just the first thing that comes to mind.

I think when Glocks where demonized as "plastic guns," able to fool airport screeners (in the days before TSA) and other metal detectors they became ubiquitous with "hand gun" or "pistol."
I don't own one, but a couple of my handguns have polymer frames. The old Ruger P89 however is a tank. If I were to holster it I'd probably need a couple extra straps since it weighs about 20lbs.

There are no magic constitutional bullets via the amendment process as no real changes have occurred since Prohibition was rolled back. All the subsequent amendments were technical and limited in nature. I doubt you could even get that sort of amendment passed and ratified nowadays.
We are not a united people culturally and politically anymore on a lot of key issues which means that federalism is critical to a peaceful resolution of policy. But that runs directly counter to the nat gov attempts to centralize as a good empire does.

Ask a follow up. Do you think guns should be registered? I’d bet of the 73% a significant number maybe even a majority would say yes.

Nope. When you actually drill down into polling which you have not bothered to look at.
Registration support has vanished among most gun owners (about half of the population more or less as a household and leaving off non response bias). Mixed among the rest of them because many of them think of the form 4473 as registration. Some believe so because they live in a state where registration is required. Others confuse it with concealed carry permits.
A better proxy that avoids semantics is whether one supports stricter or looser gunlaws--about 50-50 and slight ups or downs affected by events. School shootings, stricter gains a bit, massive terrorism like 9/11 or 10/7, looser gains.
That is about the same static proposition as abortion but the distribution varies by state probably.

I was thinking on this yesterday, during Covid I passed the Asch test (compliance with the majority in spite of observed facts) and the Milgram experiment (compliance with authority figures in the face of doing harm) but I failed the Stanford Prison Experiment (playing the roles assgined because those were the rules)
I think that compliance only goes so far in the face of continual stress and threats, though.

Margaret Mead studies in Polynesia are also bad bullshit. The Polynesians basically lied to her for their own amusement about their practices.

Plus, a lot of foreign guns are basically CZ75 derivatives. Like my Evil Joo Israeli police trade-in Jericho 941F, great SA trigger, extremely accurate and reliable. I like to think that some Israeli cop once used it to shoot a mohammedan terrorist in the face.

I just bought an AR15 "kit gun," but it didn't include a receiver, without which it is useless. Purchasing a receiver to make the gun functional requires the same background check process as buying a complete gun, because the receiver is a controlled part with the gun's serial number.
Recently. some woman on Substack demanded that abortions should be as easy to get as guns. I agree fully. They need to fill out background information just like a gun purchaser does through the ATF. We need an ATF for people like her to do background checks on Abortions, Transsexual organ removal, and Feminist man-hatred.
