The Morning Rant: Minimalist Edition

They can't define "woman," but they have no problem defining and redefining and torturing and twisting the plain language of the 2nd Amendment into tens of thousands of pages of impenetrable text designed to do one thing...harass law-abiding Americans and, when they hit the jackpot, throw some of them in jail.

The ATF is the very definition of the Deep State, with its career apparatchiks trying desperately to please the rabid gun haters who seem always to have the upper hand in the administration. Their labyrinthine regulatory structures are frankly impossible to satisfy, and the hundreds of prosecutions for ridiculous violations, and the many FFL licenses summarily revoked are testaments to the real goal...the destruction of our God-given, natural right to self defense against evil.

And the reason? Because they know that they are the evil, and in a just world the people of the United States would be coming after them, hammer and tongs, for the vile and underhanded violations of our rights.

Supreme Court Hears Oral Arguments in Case Centered on ATF's Redefinition of a 'Firearm'

The Supreme Court of the United States will hear oral arguments Tuesday in VanDerStock v. Garland, a case focused on the ATF’s unilateral action to redefine what constitutes a “firearm.”

The case revolves around ATF Final Rule 2021-05F, which placed new controls on gun parts kits and firearms which Democrats describe as “ghost guns.”

A central part of this rule was redefining what the word “firearm” meant so as to designate “partially completed pistol frames” and other gun parts as “firearms.”


Here's a good definition of a gun: If it can fire, it's a gun. If it can't fire, it's not a gun. What these bureaucrats are aiming for is the definition of every part of a weapon as the weapon itself, so if you need a $1 firing-pin spring or a $2 grip screw you will have to purchase it through an FFL and file a 4473.

My experience with gun owners is that they are law-abiding folk. But it is arrant nonsense such as this that drives people to decide that next time they'll just buy from friends or build their own. And the ingenuity of the American gun enthusiast knows no bounds. They will stay ahead of the ATF...legally or murkily.

Of course if the ATF really cared about so-called "gun violence," they would go after guns possessed by convicted felons. You know...in the inner cities...where the Democrat voting strongholds carefully protect those felons. But they do not care about bad guys using guns to commit crimes. They care about expanding their vast database of legal gun owners, and they care about the ultimate goal of their masters...confiscation of all guns in America.

Well...except for those felons' guns...those are okay.

They did that because of Chevron, which has now been overturned.

It's still open season to see if the courts can be wrangled into actually complying with Loper, but the actual caselaw now pushes for this sort of vague language to be functionally unworkable.

47 I do not own any guns. Hubbymayhem does own a shotgun but he bought it so long ago that there probably isn't any record of the purchase any more. We are storing several guns for my dad. Pappymayhem wanted one of every type of gun. He didn't manage to collect all of them before he passed and couldn't take them with him. But we have them because we don't want to face the wrath of the spirit of Pappymayhem. So even though there are several guns in my house there are no records of those weapons with my or Hubbymayhem name involved. Also, he had a fuck ton of ammo for all of his guns.

I don't think they'll even need Loper. As the lower court (or the plaintiffs, I can't recall) pointed out, in the statute the ATF is relying on, Congress defined "firearm" in a way that doesn't include the ATF's current definition. It also used the terms "parts" and "firearms" in a manner that makes clear that they meant different things. Normal rules of statutory construction should make this a slam dunk. But having Loper in their pocket doesn't hurt, either. Either way, I expect 6-3 in our favor, with the usual idiots dissenting on the feelz.

68 First thing I would do, is to peel-off the "Firearms" from ATF, and make it a Help Desk division of the Civilian Marksmanship Program.

First order of business, would be rounding up all those BILLIONS of rounds of ammo that every damn agency down to the groundhog keepers have in the armories they ought not have.

Have to work out a way to put all that ammo on the market, without causing a catastrophic price collapse to the ammo factories, given today's costs of materials, ramped up productions, and etc.

But, all that ammo does need to be OUT of government hands.

Part of the problem is our language has changed since the 1700's. Back then the term "a well regulated militia" was understood to mean a well equipped body of local men for the defense of themselves and the community they lived in. Also subject to call up by the State for the purpose of war, insurrection, etc.


The vast majority of the population today believes the 2nd amendment and the term a "well regulated militia" applies to the National Guard, something that would not exist for another hundred years after the constitution was ratified.

The move should be that the Court emulate its behavior against segregationist states. Grant cert, vacate the lower court ruling, and remand to the court with direction to do their homework on Bruen and Looper.

Don't waste precious court time anymore on the massive resistance that blue states are doing. Simply vacate the lower court ruling and remand--repeat as necessary. I didn't do WY because it was obviously a weird outlier with the Dem population seemingly going down by 2/3, except we know that a bunch (and it does seem like it may have been 2/3 of them) switching party regs to vote for Liz Cheney in the closed Republican primary.

I don't own one, but a couple of my handguns have polymer frames. The old Ruger P89 however is a tank. If I were to holster it I'd probably need a couple extra straps since it weighs about 20lbs.

It says Republicans outnumber Democrats for the first time...ever. Once, they had the parties tied in 2004.

Reps have a 3 percentage point edge on Dems this year.

Is not going to happen. Even the 1st Amendment is under attack by Dems and it can't be clearer than "Congress can make no law......."

Pragmatism means giving up beautiful loser propositions and doing the hard work politically on the ground and in society.

There are no magic constitutional bullets via the amendment process as no real changes have occurred since Prohibition was rolled back. All the subsequent amendments were technical and limited in nature. I doubt you could even get that sort of amendment passed and ratified nowadays.

We are not a united people culturally and politically anymore on a lot of key issues which means that federalism is critical to a peaceful resolution of policy. But that runs directly counter to the nat gov attempts to centralize as a good empire does.

I think that compliance only goes so far in the face of continual stress and threats, though.

Nope. When you actually drill down into polling which you have not bothered to look at.

Registration support has vanished among most gun owners (about half of the population more or less as a household and leaving off non response bias). Mixed among the rest of them because many of them think of the form 4473 as registration. Some believe so because they live in a state where registration is required. Others confuse it with concealed carry permits.

A better proxy that avoids semantics is whether one supports stricter or looser gunlaws--about 50-50 and slight ups or downs affected by events. School shootings, stricter gains a bit, massive terrorism like 9/11 or 10/7, looser gains.

That is about the same static proposition as abortion but the distribution varies by state probably.

Serious problems and dubious if not actual malicious editing of data has destroyed the myth of validity of Milgram and the Stanford Prison experiments post hoc. The paid sample in Milgram by and large did not believe they were shocking real people and the investigator in the Stanford Prison study was coaching the bad guys. Milgram probably coached some too for his best filmed reactions and the participants got paid to do it.

Margaret Mead studies in Polynesia are also bad bullshit. The Polynesians basically lied to her for their own amusement about their practices.
