They keep claiming "this isn't about politics" but they give themselves away at every turn.The reporting from the New York Times make it sound like James got little sympathy from the judges. It's always dangerous to read too much into the Socratic questioning used by jurists in appellate hearings, but the pull quotes offered by the NYT sound pretty encouraging for Trump. The report describes Judge Peter Moulton as the most supportive of James' presentation, but even Moulton marveled at the size of Judge Arthur Engoron's award for a case without any losses or victims:

A lot of states (if not all) have these very broad "civil fraud" statutes on the books that give a light-years worth of leeway to state AGs to bring actions. Many actually do not require a showing of actual concrete harm.
These statutes were all basically dormant -- as they should be -- unless a true fraud was committed that hurt a lot of people. Ace, your title says that the "NY Court of Appeals" is hearing the case. It's the Appellate Division that's hearing the case. The NY Court of Appeals is the state's highest court and one level above the Appellate Division. The case could eventually get to the Court of Appeals.

This was common from the Renaissance straight through to the modern period. People would pay the government for office and then profit off it by forcing people to pay them to be allowed to do whatever business they wanted to do. Now occasionally someone would get a little too greedy and the king would have to remove his head but for the most part it was just how business was done.
