7 Morning and evening to all the insomaniacals, working late or rising early!

Ever since this time yesterday my throat has been a little scratchy, not getting worse but not improving either. Naturally I wonder if I might be coming down with something. I'm taking it easy, also taking more D3 and zinc, and slept (mirabile dictu) a little later this morning.

Temp of 64 F., no wind, humidity is up (of course). A shame I'm not up to working out.

10 You can hate Tik Tok all you like. There is nothing in the Constitution that allows the US Congress to ban it or force Bytedance to sell it.

And China has no such Constitution, so the fact that it is banned in China is 100% irrelevant.

12 Judgment on the pleadings as to cross-defendants' first affirmative defense of failure to state a cause of action by my cross-complaint against seller's broker to indemnify the seller for defense costs when buyer sued over something that should have been avoided but broker was negligent. That what you wanted to know?

Posted by: SFGoth at April 24, 2024 05:02 AM (KAi1n)

13 While on the surface, it would seem that Tik Tok has a arugement, it really doesn't.

Bytedance is not an American company, Congress has in the past forbidden non American companies (or putting restrictions on them) from operating in the US. This is old law, upheld repeatedly.

Sucks to be ByteDance.

(Side note, it's either promting the common weal or national defense this falls under, depending on the arugements. This is well within Congress' authority to forbid non American (citizens) people/companies from operating or owning American assets.)

14 Darn it, I hesitate to post, finally decide to and the Tech thread comes up. I'm a bit of a neurotic mess this time of night as Bailey is again puking.

Odd experience today. Went to see Randy to give him towing bill, covered by insurance. He always had his big dog Wrigley there, part yellow lab he looked just like our Bailey, about the same age, but a bit bigger. Maybe topped out at 120 lbs vs Bailey at 102.

As Bailey has been failing I wondered if I would see Wrigley. No Wrigley so I asked Randy, he said Wrigley died Feb 11, then looked at the calendar, said no, was determined to figure out the exact day. Finally said it was Feb 16, it was important to him to get the exact date right to tell me.

I gave him my sympathies and told him Bailey was on her way out, just turned 14 on Apr 14. Big ole labs just don't live as long as smaller breeds.

As I drove away from the insurance agency the song that came on was "Forever Young". I thought of Bailey as a pup and almost teared up at her current decrepit state.

We finally decided Sun to have her put down and the appt is Thurs, this intervening time is bittersweet.

Oh, but don't forget the ever-popular, endlessly useful "Elastic Clause." Allowing government overreach since 1789. And there's all those pesky penumbras, not to mention emanations.

China does have a constitution by the way, they just conveniently ignore it until it's useful. Sound familiar.

This is part of the problem with the whole "WE'RE AT WAR!!! IT'S WARTIME!!! WAR!!!" silliness since 2001 where we're still at war and kids in college have grown up in a world where the U.S. was constantly "at war."

It's nonsense and no one believes it.

And now here we are with an "ally" actively engaging in war against us and our youth, and it's not war it's freedom. Because one doesn't mean anything any longer and the other means less and less every day.

25 My heart goes out to you Farmer - show Bailey in every way you can how much all of you love her, and when it's time - this may sound harsh, but it will mean something - if you can, be in the room with her. Hold her head and body as comfortingly as you can. I've had vets tell me it makes it so much more of a calm and peaceful experience for a beloved pet to have the one they love the most there with them.

Again, I don't mean for it to sound harsh, and please don't take offense, but it will make a positive difference for Bailey, and for you.
