ACLU Fires Asian Lawyer For Using "Racially Harmful" Language to Complain About Black Boss. She Didn't Say Anything Racist; the ACLU Contends That Simply Criticizing a Black Boss Is Inherently "Harmful" Because It Caused "Hurt Feelings" Among Other Blacks

No backtracking; you said what you said. "Racism" now means simply "failure to sufficiently praise a privileged minority."


The ACLU has fired an Asian employee, Kate Oh, for what it describes as creating "racial harm" through her critiques of Black supervisors, inciting a complex legal and ethical debate over workplace dynamics and free speech.

Key Details:

The ACLU claims that Kate Oh, a Korean American lawyer, used language in complaints that perpetuated racist stereotypes against her Black supervisors.

Oh's interactions, including describing a discussion as "chastising" and expressing fear of a Black male superior, were used as examples of alleged anti-Black animus.

She complained about him "chastising" -- criticizing -- an Asian woman. That's not racist. When she complained of the criticism, that was racist. Because he's higher on the Oppression Pyramid of Privilege.


The case has escalated to an unfair-labor-practice trial, with the National Labor Relations Board accusing the ACLU of retaliating against Oh for her complaints about workplace conditions.

That is actually a welcome development. Considering that airline seats are now 17 inches wide, which translates to a 34 inch waist, and the space between the seats is 3 inches less than the hip to knee measurement.

Having someone recline and put all of their weight on my knees means I have to spend the flight standing in the back.

Ehh, not really. It turns out that commercial aviation isn't particularly profitable. If the airlines aren't defended with special rules (e.g., prior to deregulation) or protected with subsidies if not state-owned (national airlines), competition turns into a race to the bottom on service and goodies. The market has dictated that this is acceptable, because the tickets keep selling.

So adding an extra row or two to the cabin - even if it means no more reclining seats - is well worth it. The money has to be made up somewhere and competition is fierce. If you can't increase the cost of the ticket without being crowded out by the airline that didn't, you find a way to sell more tickets (or provide fewer services, like drinks and complimentary baggage).

I am tall too. When the seat in front of me is NOT reclined, my knees touch it. So, if they recline, they are putting their weight onto them. I had one flight where a euro trash complained to the stewardess that when he kept slamming his seat back into me, he could feel my knees in his back.

I informed him and the stewardess that if he did it again, I would break his nose at a minimum. They moved him to the back of the plane.

I've had many female bosses, and I've only had good experiences. But I'm a guy.

At the risk of painting with too broad a brush, I think women struggle with female bosses because y'all hate each other. Maybe it's because women inherently see other women as competition, and men and women do not have the same dynamic?

Was it otherwise good? My kitchen is actually great - big, well laid-out, plenty of workspace, etc. - but it is, as they say on HGTV, "dated." Basic countertops, brown cabinets, linoleum floor. It looks like it was probably last renovated in the early to mid 90s. It's all functional and in great condition.

Some sociopath in Europe invented a vertical airplane "seat" that's basically a bicycle saddle mounted to a floor-to-ceiling pole. Increases passenger density by some ridiculous amount.

Even Ryanair looked at that and said, "no, not even we can get away with this." But give it 5-10 years and something like it will be available if not commonplace for short-haul flights of under 3 hours.

He'd stand outside the door of his office and do all kinds of gesticulations so that everyone could see him doing it. I had to ask...so I went up to him and nodded, "What's up?" He actually stopped, held up a hand to say he couldn't be interrupted and continued. Eventually, he came over to my office and explained, that the exercises were to keep from getting carpal tunnel. God help me, I laughed. He frowned as by response and walked off in a huff (a literal huff). I don't think he spoke to me one time after that until he was fired for stealing something or other.

All states, except Montana, are At Will. This is not the same as right to work, which means you have a choice as to whether you join a union or not, and this has other complexities I won’t go into.

If you belong to a union, you are a contract employee. The right to work status means jack taco to you. While most companies, except really dumb ones, will retain the right to hire and fire, you still need to meet just cause standards in order to discipline, to include termination.

Note in an at will employment situation, you can fire for any reason, but you cannot fire for the wrong reasons, discrimination being one of those wrong reasons.

I watched race relations improve for most of my life (some setbacks, of course, like the Rodney King riot, but the trend was upward) until The First Post-Racial President made sowing racial division a cornerstone of his administration and particularly within his Education department.

I think Barack acted as a catalyst, made it policy. But the building blocks were there to be put together beforehand by someone who wanted to build this monstrosity. A big part, I think, is the ceaseless excusing and apologizing for the antisocial behavior of certain groups. Note, for example, how certain behavior by whites makes them trash, but no comparable group of black trash is acknowledged to exist. The mainstreaming of rap music and its gangster ethos was a watershed. It took a while to metastasize, but it was always cancer. Apologetic comparisons to rock music are like comparisons between the Bible and Koran on violence.

I grew up in a mixed-race community. It was a small town, so there weren't separate black and white neighborhoods, but the churches (except for the Catholic Church) were pretty segregated.

And when there was a school dance, the announcement always specified that both "white music" and "black music" would be played.

I don’t know that I am playing, but maybe I am and need to think more on this topic. I am no snowflake, I am pretty tough. I don’t think it’s racist to call out clear cultural issues that should be talked about. I don’t struggle with seeing how ridiculous the oppression Olympics have gotten, it sadly has negated acts of true discrimination and that just sucks. I do have a problem with tactual racism and discrimination, no matter the direction. Luckily, I don’t think I am the rare bird who harbors these feelings, though there are people doing their damndest to make that not so.

What the ACLU is forgetting is that since she was ostensibly complaining about a harassing workplace first, they have the burden of proof in showing her workplace was not harassing, and have proven it by firing her.

Yes there is a hierarchy. But there is also timing, and retaliation. ACLU is wrong on both. They will pay, haven't got a prayer of getting off on this one, unless the left is ready to wipe out 30 years of case law on the books.
