Posted by: Zombie Johnnie CochranMcAfee was asked a few days ago if he would adjust his ruling based on the fact that a Jesse Jackson/Rainbow PUSH acolyte suddenly filed to run against him. (He had previously been unopposed.) McAfee said no, he had already drafted his ruling. Megyn Kelly (well, her friend) pointed out that this meant that McAfee had decided to allow Fani Willis to stay on the case. Otherwise, he wouldn't attempt to defend his decision by saying he had already made the decision before he was pressured from the left and black identiarians. Throughout this entire case, he has refused to allow in evidence of Fani Willis' and Nathan Wade's serial perjury. All so he could claim, as he does in this corrupt, cowardly ruling, that there is no actual conflict of interest, merely an appearance of conflict of interest. And having claimed there is only the appearance of a conflict of interest, McAfee now rules that all that is required to cure the appearance of a conflict is to clean up the appearance: Either Fani Willis can step aside and take her whole office with her, and leave the case to be run (or dropped) by a state agency, or she can just fire Sweetdick. Of course she will choose the latter, and simply appoint some other identitarian hack to run the case and make $250 per hour to persecute the left's chief political enemy. This is a disgrace.
More specifically, Defendant Roman alleges that the District Attorney and SADA Wade traveled together on multiple vacations with Wade covering many of the associated expenses. (Roman Doc. 61 at 5-6). Defendant Roman later supplemented his motion with receipts from some of these travels. (Roman Doc. 70, Ex. B). The State responded with an affidavit, arguing that the District Attorney had not received any financial benefit through her relationship with Wade, and that their personal travel expenses were "roughly divided equally." (State's Opposition, Roman"Possible." Don't worry, he'll soon say there is no conflict of interest.
Doc. 65, Ex. A). As alleged, the claims presented a possible financial conflict of interest for the District Attorney.
More importantly, the defense motions and the State's response created a conflict in the evidence that could only be resolved through an evidentiary hearing, and one that could not simply be ignored without endangering a criminally accused's constitutional right to procedural due process. After receiving two and a half days of testimony, during which the Defendants were provided an opportunity to subpoena and introduce whatever relevant and material evidence theyYou repeatedly blocked their attempts to introduce evidence into the record, and allowed Terrence Bradley to brazenly perjure himself to cover the conflict up.

Alternatively, SADA Wade can withdraw, allowing the District Attorney, the Defendants, and the public to move forward without his presence or remuneration distracting from and potentially compromising the merits of this case.

Ace, I have a different view. I think this is good news. We were never gonna get Gaping Spelunker thrown off the case. That was always a fantasy given Fulton county machine politics. The most we could ever hope for is what we got: she has to get rid of Powercock.
That's a victory. Don't let the perfect be the enemy of the good. Whoever else she gets to prosecute this dumpster fire has to start almost from scratch, which will set this back a long ways. We're playing mostly for delay at this point.
Plus, IIRC no other lawyer wanted to touch this steaming pile of shit in the first place. Now that the case has already been fucked in the ass, any other lawyer will be even less likely to take over someone else's sloppy seconds.
The judge also dismissed some of the claims. That's also important. The stench was too overwhelming even for him.
Let's take the W when we get it.

Lotsa posts and comments before today about how the judge was gonna look the other way on the whole entire thing. Nobody had any confidence that the judge would do the right thing. I sure didn't.
I also think people are underestimating the impact of getting rid of the actual lawyer trying the case. That will set the case further back than getting rid of Fani, who had no role in the day-to-day prodecution of the case. Anyone in Fulton county could take over her role in 24 hours. That's not true of Wade.

I get the feeling all this will be irrelevant when the financial crisis starts in earnest. It’s pretty much end game.
1) last year we had twice as much debt as GDP in 2023 and 2024 won’t be any better and probably much worse as we are adding maybe $3 trillion in debt this year.
2) The Feds have to roll over $10 trillion in bonds this year from lower interest rates to higher interest rates with a possible failure of a bond offering.
3) everyone’s 401ks are leveraged to the extreme by the investment houses yet people are pulling money out in increasing rates to cover ordinary living expenses. The entire retirement system could collapse as inflation is not subsiding and the cash just isn’t there for a run on retirement accounts.
It’s pretty much game over at this point and we all know that the politicians will do everything to protect their big donors over everyone else. We have crossed the threshold where there are no levers to pull to fix things.

Any new lawyer coming on will have to start from scratch in terms of learning the case, preparing to try it, etc. It's a big job that takes time. How long has this case already been pending? Powerpud has spent thousands of hours on it.
I've taken over cases from other lawyers. It sucks and it takes a long time.

It's surprising in that I fully expected the judge to just clear everyone, too. Having my expectations partially subverted doesn't make me see it as a win. The judge did his job, defended the Party and its men, and left the door wide open to keep going.
Will Willis have trouble finding the new guy? Maybe so. But there *will* be a new guy, and the same corrupt shenanigans will continue in the same corrupt courts.

We will never get justice. Not ever. We are playing to run out the clock. That was always the end game as I saw it. The judge's decision absolutely will delay the case.

To stop it now - hell, even a serious attempt at minor reform now - will blow up their entire system. So they have no choice. They just keep mashing the accelerator, the upcoming end-of-road markers be damned. If they're going down, they're going to take us all with them.
So since they can't stop it, they'll just speed and get whatever they can before the crash. If they're very lucky and very skilled, they get dominion of the wreckage, too.

I remember reading years ago that there is a careful accounting of all winning scratch offs and they know exactly where they are and when all of them are sold.

Ed Morrissey is saying this is a split the baby ruling. Judge who is up for reelection says there is convincing evidence of appearance of impropriety, but then placates his local base by not curing it. This will force the appellate court, who are under less political pressure, to do something about it when this ruling is inevitably appealed.

McAfee has this case because he worked for Fani and was perceived as a weak, new judge who could be manipulated. He's proved all that. But he was backed into a corner by the defense motions to disqualify and the evidentiary hearing. McAfee was screwed however he ruled. His ruling will be appealed, which will delay the case. And Fani will kick sweetdick, which means a new ADA will need time to get up to speed. And that won't happen quickly. Meanwhile, Fani must contend with an ethics committee and state legislature. This case is DIW.
