The Biden Administration May Have Delivered the Coup de Grâce to the 'Gig Economy'


The unions hate independent contractors because they can't strongarm them to join a union. And the left hates independent contractors because they can't be controlled like companies and corporations.
With so many big guns targeting independent contractors, the Biden administration had no trouble finding ways to try to destroy them.
The ostensible reason Biden wants to destroy the gig economy is that the poor gig workers are "exploited" because they don't get health insurance, unemployment, paid holidays, or any of the other goodies regular employees receive. If gig workers could get all those things and maintain their independent contractor status and work flexibility, and all the other benefits of gig work, I'm sure most would jump at the chance.
But the rule change that's going into effect substantially narrows the definition of independent contractor.

What too many Republicans get wrong about the Constitution


As part of a growing movement to push back against federal overreach, Tennessee lawmakers earlier this month introduced SB 2775, the Restoring State Sovereignty Through Nullification Act. The bill would empower all state and local government stakeholders to pursue a process barring the enforcement of unconstitutional federal laws within the Volunteer State.

While similar bills empower only the state attorney general or legislature to interpret the Constitution, SB 2775 would leave that power in the hands of the whole people — as it was always meant to be.
Here’s how it would work. The law would permit the governor to issue an executive order declaring a federal policy null and void. Or any member of the legislature could trigger a floor debate and vote to nullify the policy. Or any state court may find the policy unconstitutional if the question arises during a legitimate case or controversy. Or any combination of 10 local governing authorities — either through their respective executives or legislative branches — may submit a petition for nullification that would trigger a vote in the legislature. Or, last but not least, any group of 2,000 registered voters could submit a similar petition triggering an automatic legislative vote on nullification.
In other words, the bill underscores how we are all responsible for safeguarding the Constitution. When everyone understands the federal government frequently oversteps its boundaries, we have an obligation to push back.

We penned a note on Saturday, recapping last week's surge in aviation incidents across the US. The spike in mishaps appears concentrated on Boeing jets, from a midair engine fire to a tire separating from the landing gear to another landing gear issue. We asked if this was sabotage or just shoddy maintenance. 
Consumers quickly realize, especially after January's midair door plug blowout incident on an Alaska Airlines flight involving a Boeing 737 Max 9 jet, that Boeing planes are flying "death traps." 
In recent weeks, the online travel booking website Kayak has seen a noticeable uptick in users who are filtering out Boeing planes for Airbus when searching for flights, according to ABC News. 

I used to feel better if the plane I was on was a Boeing. Mostly American pride I suppose. Not sure I won't be filtering for Airbus in the future. Can anyone think of a company that, if you'll please forgive the term, crashed and burned from self-made wounds faster than Boeing seems to be doing?

No, Joe, Teachers Don’t Deserve a Raise


After bragging about his defiance of the Supreme Court over student loans, and the need to provide relief, he added, "And while we’re at it, I want to give public school teachers a raise."

Democrats have been pushing for higher pay for teachers forever. It's the least they can do for the teachers' unions that help fund their campaigns and work on the ground for them when elections come around. And that's really what this line was about. Biden was sending a message to public school teachers that if they help get him reelected, they will be rewarded with higher pay.

There's no other logical explanation. He can't argue that teachers deserve a pay raise. He even made the case that they don't deserve higher pay on merit and accidentally pointed out how low our education standards are.

It's depressing to ponder exactly how many of our institutions function primarily as a mechanism to siphon money from the productive class and funnel it to the parasite class.

Afraid he would kill me, I pleaded with him to honor my commitment to Haiti, to him as a brother in the mutual struggle for an end to our common oppression, but to no avail. He didn’t care that I was a Malcolm X scholar. He told me to shut up, and then slapped me in the face. Overpowered, I gave up fighting halfway through the night.

Not once did I envision myself becoming a receptacle for a Black man’s rage at the white world, but that is what I became. While I take issue with my brother’s behavior, I’m grateful for the experience.

Haiti is 99.9% black, yet she sees this as the fault of the “white world”. Good thing this was a decade ago, if it happened today her rapist might have enjoyed a nice post-rape snack.

They love to upbraid those with unfashionable, traditional values and to try to correct their thinking. At best, they perceive the lower orders as did the well-meaning Liberals of the 19th century – through lordly condescension.
Modern leftists patronise the poor, keeping them in a state of vassalage, beggary and penury. They regard state benefits as a long-term right rather than a necessary evil or temporary safeguard. In this sense, today’s conspicuously compassionate are surely little different or little better than those white, male rock stars of yore declaring their devotion to saving Africa.

Exactly the same way American leftists treat blacks.

Decrepit Joe and his idiot cabinet officers NEVER explain their reason(s) or rationale for their policies. Neither did Barky and his minions. All we get/got from those two Juntas was assertions, if even that, for why their policies were necessary and wonderful. Also, the two Juntas rarely announced a schedule or any metrics for what they intended to do (to the populace). Joe says he's going to build half-a-million EV charging station across the country by 2030. Have Buttplug or Joe ever shown a year-by-year schedule of construction for those things? Of course not.

Several hundred years ago the whole roof of an original 737 blew off, over Hawaii I believe, no losses. Stress fractures.
Also, on a 747 coming in to CA a Japanese airline pilot inadvertently turned the engines off. He put the plane into a deep dive and restarted the engines. (the manual says you can't do that)

1. I think these incidents used to happen without garnering national attention by the hysterical media. I think the word is out to frighten people into traveling less.

the most horrifying story was the new model Airbus over the Atlantic that had a major computer crash on their fly by wire system. As the plance plummeted 40,000 feet into the ocean, there were indications that the crew was cracking open the operators manuals and desperately trying to reboot the computer controls.

He was perfectly happy with the arrangement - the hourly contractor pay made up for the lack of benefits.

He was fired after six years, because all the company's contractors got fired after six years.

That was because a California judge had decided that if a contractor worked more than six years for a single company, the contractor was actually a company employee - retroactive to the first day of employment.

So, the company would have to pay six years of back Social Security payments, six years of back unemployment insurance, etc. etc, etc.

More than a few of us have some connection. I will say anyone who heard/read that it is no longer the motto is misinformed. It remains the motto. The words have been changed for the Mission Statement many times over the last 100 years and DHC ws only put in the Mission Statement in 1998.

Believe me there are many more alarming things the Army and Academy have done or said. This is not a sign of something terrible.

I did some work at an automotive supplier plant in Detroit a couple of years ago. The stench of weed was omnipresent; the engineer types I asked about it just shrugged and said the union had a rule that no one could be canned for being high.

That place is closed now, and all the equipment shipped to Mexico. That union sure did some great work protecting jobs.

That said, I don't think this is anything new, but probably more widespread. I've heard plenty of stories from the '70s of workers at auto plants heading to the bar and getting sh*tfaced at lunch.

The problem was the fuel efficient engines had gotten too big for the 737 airframe, and instead of biting the bullet and designing a new airframe, Boeing said "well, we'll fix it with software".

Fundamentally unstable aircraft may work well for fighters, not so much for passenger transports.

Exactly. They were putting advanced turbofans with a 105-in. diameter on an airframe that was designed 50 years ago for 24" JT9Ds.

The new engines screwed up the flight characteristics so badly that Boeing had to use a computer as a band-aid to compensate for the wonkiness.

And then they farmed out the coding to Indians with no aeronautical experience. But they worked cheap.

The rest is history.

Also, on a 747 coming in to CA a Japanese airline pilot inadvertently turned the engines off. He put the plane into a deep dive and restarted the engines. (the manual says you can't do that)

That's a very good point. The new plane is 'wearing the skin suit of the 737' so to speak. I never really thought about the new designation (additional cost due to gov't cert.) versus redesign ('we're just doin' an upgrade here', while walking away, whistling). And of course the D.I.E. This sounds like the Microsoft case, from 2009, and it was a misclassification of employees issue. The contractors themselves sued and won- rightly so. MS embedded the contractors in with employees, treated them as employees,, managed them, set hours, etc, everything but then excluded them from rich MS benefits. Based on MS behavior, they treated these contractors as employees versus independent businesses and therefore made them employees by default.

Temp employees should have a veil between the regular employees and them with the temp agency managing the employee in terms of discipline, payroll etc. The time frame is less than 6 months, not 6 years, before you begin to run into dangerous territory.

When I had "thrown out my back", the doctor told me that at some point, I would notice that the pain had stopped. Then I was to immediately throw away the remaining pain pills and muscle relaxants.

I read a heated discussion about the dynamic stability of the 737 MAX. They argue it is not dynamically unstable per the definition, just handles very differently than the previous 737s did, and "all the software does" is make it handle like the previous ones did.

The definition of dynamic stability is, when the aircraft is in "simple flight", do perturbations tend to get out of control, or do the natural restoring forces tend to put it back into normal flight.

It was a very heated discussion about this for the 737 MAX.

Part of the answer was that we took it so seriously that we included contractors and temps with the training we gave our full time staff.

Naturally, that caused heartburn for HR because we were treating them like employees. So we stopped including contractors and temps in training for our employees and delivered the same message in separate training sessions for our contractors and temps.

230 I was trying to avoid getting involved, BUT, what does the airline scheduled maintenance being done in Mexico have to do with Boeing? They sold the aircraft to United, Southwest, and Alaska. Maintenance on their aircraft is up to them. Same thing with engine overhauls.
United is a special, scary, case. Their CEO went hard into DEI for hiring of pilots and maintainers.
The MAX crashes were runaway trim due to AOA sensor input. The 737 still has mechanical trim wheels on the console. You can see them rolling forward if the AOA sensors indicate you are too nose high(even if it is a false indication from a bad AOA sensor). There is a button on the yoke, two switches on the console, and the circuit breakers that will stop the trim motors. You can then use the trim wheels to put it where you want it. The two crews that crashed did none of those things. I will note that they were not American crews. The FMS had nothing to do with those crashes.

The video is over a year old and was overwritten. The fuselage from Spirit that needed rework was not an exception(which says a lot about the quality of their product) and there was no reason to preserve it. The paper records are something else. I have worked in aircraft maintenance and modifications and there are extensive records kept on just what was done to this airframe and when and by who. Someone has removed those records.

And Horror Express is a Hammer-style science fiction thriller set on the Trans-Siberian Express ferrying a host of travelers desperate to return to Europe. (and unknown to most aboard, a relic uncovered in Eastern China which is slowly coming awake .... It's chockful of horror icons like Christopher Lee and Peter Cushing and features a young Telly Savalas (as a Cossack?) in the process of establishing whether he wanted to remain the heel, or whether he could play a more mainstream character.

It's got elements of religion, early twentieth century geopolitics, and national rivalries that could destroy everyone on the Trans-Siberian. The action builds up to a satisfying, fever-pitch conclusion. So long as you don't have a hankering for the cinema of hifh art, you could definitely enjoy it.

That's what happens sometimes. Went to services after my FIL passed and asked for prayer for help doing my task as Trustee for my FIL's estate. Seems like quite a few minefields. Lawyer I was using to update my Trust after my wife passed is giving me some advice.

The mask the current Gov't has worn for a while is that of Uncle Sugar to the voting masses, with the voting masses dumbed down enough to not understand that Gov't is an evil.

Back in the 90's, there was a comparison made between the current school system budget vs having Community College profs teach classes in rented buildings with gyms, having books with gold leaf, reducing the class size, and sending kids on a trip to Europe as seniors; it cost the same. When signing up for subscriptions there are toggles for automatic payment, usually as a requirement to get a period of 'free trial'. You then have to remember to cancel the sub after the trial period, manually. If people sign up for subscriptions and hit the toggle, it's actually easy to forget what you've subscribed to. I once forgot I had Amazon Prime; it's happened to me a couple of times.

Trying to remember the last time I did subscribe to anything other than cable (gone now), Internet, a couple of credit cards, and the unavoidable evil, power bills. Even a magazine -- Analog SF magazine, maybe, in the '70s? Not sure.

Exactly, and it's especially easy like I said, if you have to hit the autopay toggle to get a free trial, and then forget you hit the toggle until you look at your bank statement and say, "What's this charge?" three months or whatever later.

354 Anyway! The Killer Kittens From Outer Space got revved up for some reason last night. During the cold spell in January, I discovered that my living room window is warped; you can see daylight at the bottom left corner, and cold air sprays in (and no doubt, A/C will leak out in hot weather). I folded a couple of towels and put them there to block the leak.

Last night Stirling discovered that pulling the towel away allows him to paw at the gap, no idea why, and I had to chase him off repeatedly. Then he and Dagny were galloping around after dinner. At one point I was standing looking at the TV. He reared up and *punched* my legs with his front paws the way a dog will, to get you to play. So I did.

I stuffed some insulation tape in the window gap, but they'll pull that loose too. The towel is easy enough to replace, though.
