I'm not seeing the issue. Citizens have right to travel, so we're good. A lot of US laws are a total patchwork. See knife and gun laws for example. My CCW from WA doesn't get recognized in OR. What knives are legal or illegal can vary based on what county I'm in and what cop wants to make it a big deal. Tax laws are all over the place too. It's a genuine strategy for big companies to operate with a generic tax strategy until the locals go to court to prove they're not following local law, then to follow the ordered court tax strategy. This isn't because they're intentionally thumbing their nose at the tax law, it's because tax law changes so much according to different zones, districts, states, counties, etc. it's literally cheaper to do it this way than to find an expert for each of these areas and follow their recommendations. 1. What is to prevent Texas - or any other state under this precedent - from enforcing such provisions against American citizens or legal residents? Is it because there is no law against a citizen entering Texas? I have a huge problem with Terry. Common Law not withstanding, it doesn't pass Constitutional muster. That's one of the points of the Constitution. Common Law is easily followed into tyranny, and the Constitution checks precedent.
The Constitution says due process and security in papers and belongings. It doesn't say, "unless an older Common Law precedent allows us to pretend otherwise." Hate to tell ya Joe but originalism uses common law (which was almost all criminal law) at the Founding as an example of what the Framers viewed. Security of papers and belongings is read narrowly for example and always has been outside of the home or business.
Due process itself does not create a separate right but instead is a process must be in place to protect them--in this case imprisonment etc. Due process then would be to support the warrant of the 4th provisions and that has been basically limited since the founding to places and things that you can exclude others via property rights. And before Katz, basically in public, your rights were negligible over privacy which is a modern conception of the law and how common law informed our constitution. The Fed law says illegal immigration is illegal, and they must face deportation. Biden is declining to enforce the law. Issues with that aside, that doesn't prevent Texas from passing their own law that mirror fed law and enforcing that. Courts have always blessed that action - why wouldn't you want both the state and the feds enforcing the same law? Hence unless the federal law says the states can't do this, then they can. I lived in Austin for a decade (almost a decade ago). I knew plenty of normal people, whether on the right or just apolitical. But overall it is very far to the left and has gotten worse in that regard, evolving from a Bohemian "keep Austin weird" mindset to just standard strip-mall progressivism. Even the non-leftists there often have danger hair and a full sleeve of tattoos.
