Yesterday, the Colorado Supreme Court ruled that Donald Trump is an insurrectionist and cannot be listed on that state's primary election ballot in one of the most egregious examples of judicial activism in our history. I won't go into the details - better men than I already have - but it is clear that the reasoning is tortured. Some amendments mean what they don't say while others don't mean what they do say. How did they arrive at their bizarre and dishonest conclusion? Political expedience, as always.

Trump is appealing to SCOTUS, of course. Despite that, the deadlines are what they are and unless SCOTUS does something by the first week of January, Trump's not going to be part of Colorado's first presidential primary election (it was until now a caucus state). Whether SCOTUS upholds or rejects the state Court's ruling in time to matter for the general (whether Trump is on that ballot or not) is somewhat beside the point. This is the crossing of a Rubicon, and not just because of the activist illogic and pseudo-legal divination of a bunch of hacks in black.

In the gallons of ink already spilled on this topic, it is clear that the left fairly generally is in full approval of this preemptive subversion of the will of the electorate. The cognitive dissonance on full display on the Left is, as always, remarkable. From DU:

The decision is a mixture of federal constitutional and state law.

The Colorado Supreme Court should have the last word on state law. SCOTUS should be hard pressed to separate the federal constitutional issues from the state statutory issues.

We know what a SCOTUS majority will want to do but it will be a trick to write a decision that is not blatantly outcome determinative.

So the SCOTUS ruling would be "blatantly outcome determinative" but the state's Supreme Court ruling that removes a candidate from the ballot is, for some reason, not "blatantly outcome determinative." So the big brains have their rationalization, but what about the chattering classes at DU? It's about what you'd expect. The ones not snarking about ketchup (Trump puts ketchup on steak, dontchyaknow) are just reveling. Very few of the big brains at DU have even the slightest pause, and their opinions are dismissed:
My problem with this is that
He hasn't been convicted of anything yet.

I think he's a horrible person who should never have been elected, and yet was, and the thought of him ever being in office terrifies me almost beyond belief, but he hasn't been convicted yet. I anticipate he will be, but this seems like something the Senate should have done after his second impeachment...and yet didn't.

C'mon, bro. Don't be so old-fashioned.

But that's DU. It's a dumpster fire anyway, right?The higher-brow (seriously, at least for this one) Daily Kos is more caught up in legal minutiae in the decision and the motivations of the justices. Full approval, of course. They're thrilled that "democracy" will be denied to Colorado's voters. It doesn't matter that Trump (or any Republican) doesn't have a hope in hell of winning in that state's general - the choice must be precluded.

But those are just chatterers. They don't get bylines. What of those who do? Well, Amanda Marcotte of Salon fully supports the most sweeping reinterpretation of the Constitution by a court in quite some time because, of course, it's obvious:

A shameless insurrectionist is running for president while under 91 felony indictments. To add to this historic situation, the Colorado Supreme Court on Tuesday banned Trump from appearing on the state's Republican presidential primary ballot. The 4-3 decision follows the clear language of the Constitution's 14th Amendment barring those who "have engaged in insurrection" from running for office. Yet anyone who thinks they know how this will play out over the next 11 months is kidding themselves. The one thing that is dead certain, however, is that the Supreme Court justices would be fools not to uphold this decision.
Fools indeed. They might suffer the wrath of activists with extralegal protections.

But Salon are hacks, too, right? Those straight-shooters at Politico are surely more even-handed, right? Well:

... said Ian Bassin, executive director of the nonpartisan but highly Trump-critical group Protect Democracy. "So if the Court is just applying the law, then a straight read of the law requires them to uphold the Colorado decision. ... But of course the Court does not exist in a vacuum. It is responsive to politics, and the political reality is that Donald Trump has built a large political following."
Ah, so the issues of legality, constitutionality or appropriateness are beyond question. It's obvious that the Colorado ruling is correct and proper, it's just that a political court beholden to Trump and his degenerate supporters hate the law. Top-notch political journalism.

The aftermath of and attitude about this ruling is, I think, evidence of the ongoing death throes of representative government - not in practice, but in spirit. Even among left-wingers who timidly say, "hey, maybe we should pump the brakes on this, eh," they are immediately opposed and silenced. If SCOTUS overturns this as it rightly should, these same papers and forums will decry the injustice of giving people a choice in an election. The dominant power movement in the country, the movement with most of the institutional authority, no longer even pays lip service to the notion that people should pick their own government.

78 It's not worth the effort to argue this "legal decision". It's ludicrous on its face.

The larger issue is how it will affect people's votes in '24. Even some Democrats are worried that this is such blatantly unconstitutional disenfranchisement that it will have the opposite of the intended effect. Voters are being show exactly what the Dems think of them, and what they have in mind for the future.

For most people, it does not redound to the electoral desirability of the Dems.

Ironically, even though they had to write in "Shelly Sekula Gibbs," tens of thousands of people did. Just not enough. So Nick Lampson was a one-term wonder.

For what it's worth, although he was an obvious Beaumont party hack who deserved to be defeated in the enxt election for a lot of reasons, Lampson was the best elected official out of all of them in the aftermath of Hurricane Ike. I give him kudos for that. He was like a one-man troubleshooter who was out there cutting red tape and swinging his weight in a good way.

If this violation of American principles is upheld by the SC, then-

from here on out anyvote fraud, voter suppression, stolen election, etc is de facto deemed legitimate,

because to merely question the legitimacy of the vote is insurrection.

So, Democrat-run gov't forever, with SC approval, even the Soviet and Chinese communist parties never pulled so blatant a "fuck you" to their citizens.

Democracy will be dead and rotten with a stake driven through it's heart, but still shambling as a corrupt zombie manque of it's former self.

On the upside, Our Corrupt Robber Politicians will be able to get their graft unimpeded by those silly voters.

A neighbor, who is a dentist, had come into the hall to help. He told her, "SAY SOMETHING!", which she could not do. It was then that we realized that she was choking.

The dentist-neighbor immediately got into position, behind my wife, to attempt the Heimlich maneuver. He told her what he was doing, then he did the Heimlich bear-hug.

While I don't doubt they will try I've been hearing similar predictions to this most specifically about Trump for the last 3 years and every attempt they have made to stop him and us has failed so far. Trump isn't just crushing the Republican nomination he is doing the same to Biden.

More than half the country now thinks there were serious problems if not outright fraud in the 2020 election and with this type of action the left is doing nothing to counter those beliefs. Barring a miracle Biden, if he is even still on the ballot next fall, will be so far behind Trump the cheating will be obvious to all. Not sure how the country reacts but I don't it will roll over and accept it.

I don't think they need to manufacture ballots any more. They just change the vote tallies electronically in Dominion. That's why they pushed so hysterically hard for these types of electronic vote systems: it makes fraud much easier. And conservatives just shrugged.

The 3 dissenting judges went to law school at the University of Denver. The 4 who voted to bar Trump all went to Ivy League or adjacent law schools.

The reaction to this ruling seems to be splitting the Democrat Party a bit from old school traditional Democrats from the Obama communist wing.

I don't know how Colorado election law works and they probably have their lawyers working on this, but parties still have to follow the Constitution, and this was a ruling based on the Constitution.

There are a lot of idiocies here that are appealable, including the blurring of findings of fact and conclusions of law and questions of state versus federal due process. The Supremes are probably going to punt by holding the case until after the primary occurs and then dismiss it as moot. And you are correct. CO's tech sector was fairly well-developed and so was a "low-cost alternative" for Silicon Valley grunt work. Lots of people flooded in from the Bay Area, and brought their creepy and evil attitudes with them.

If the primary election is held with Trump on the ballot, the case is moot and will be dismissed accordingly. If a caucus is held instead of the primary, the case is also moot and will be dismissed accordingly. The Supreme Court is going to sit on this and then dismiss it after Trump wins the Republican primary.

The only thing remaining of the decision is the civil finding of fact that Trump committed insurrection, which would have precedential authority for the general election in the Colorado courts. When the Colorado GOP files for the November ballot with Trup on it and the Secretary of State refuses to accept him, then the place the Colorado GOP should file for injunctive relief is in the federal District of Colorado. It will be granted, on due process grounds. The state of Colorado may appeal through the federal system, but it will lose.

@TJM, I cae up one ballot short once when running a polling place. The only conclusion I could come up with was that the voter probably put the ballot in her purse with her election materials and walked out with it, rather than putting it in the can.

The bigger problem is if a precinct reports more votes than the number of people who checked in.

Nah, they take money from everything they do. So while Ukraine is a way to do that, so is every hearing on domestic welfare policy. And the bribes taken to get things included in Medicare. Everything this government does includes dirty money.

It won't be rainbows and butterflies, but it won't be like it was with Trump. There's no reason for it to be, because she's on their team just like Bush 43 was.

Any Republican who is even *possibly* effective or an outsider, though, will get the Full Trump.

Hell no - GEORGE W BUSH is. BY FAR. Good lord. Other people have pointed out the major fuck ups like Medicare and NCLB (the spiritual predecessor of Common Core) and the Patriot Act, but lets also not forget how much of an EPIC disaster the Iraq War was. And the best one of all ? John fucking Roberts who proceeded to pervert constitutional interpretation to uphold the blatantly unconstitutional Obamacare and all but rubber stamp everthing Obama did.

There was so much backlash against this disaster that his presidency led DIRECTLY to Obama, and therefore, Biden. There is no way either of them could be the "worst ever" considering they were directly a result of the actual "worst ever" - GWB.

Okay, even the shithead Democrat judges can't prevent that, BUT...they say any write-in votes for Trump won't be counted.
....SO...the GOP needs to SUE the state of colorado for...wait for it..."voter SUPPRESSION"!
....Seriously. Since the U.S. Supreme Court has supported EVERY claim of "voter suppression" they'll have a far harder time reversing field and saying "DECREEING that voters can't do a write-in vote is NOT voter suppression."
