Fox Sends Cease and Desist Letter to Tucker Carlson, Telling Him He Is Not Allowed to Express His Political Opinions Until 2025

Foxweiser rips off whatever part of its mask was remaining.



Fox News has sent a cease-and-desist letter to Tucker Carlson as he ramps up a competing series on Twitter that drew a combined 169 million views for its first two episodes, Axios has learned.

Details: The cease-and-desist letter has "NOT FOR PUBLICATION" in bold at the top.

"NOT FOR PUBLICATION." LOL. It's adorable that Foxweiser thinks it can control what people do with its meritless legal threats.


What's happening: Fox is continuing to pay Carlson, and maintains that his contract keeps his content exclusive to Fox through Dec. 31, 2024.

Carlson is making a First Amendment argument for posting on Twitter, and asserts that Fox has committed material breaches of his contract.

What they're saying: Harmeet Dhillon, a lawyer who represents Carlson along with Bryan Freedman, said in a statement to Axios: "Fox News continues to ignore the interests of its viewers, not to mention its shareholder obligations."

"Doubling down on the most catastrophic programming decision in the history of the cable news industry, Fox is now demanding that Tucker Carlson be silent until after the 2024 election," the statement continued.

"Tucker will not be silenced by anyone ... He is a singularly important voice on matters of public interest in our country, and will remain so."

Fox News didn't comment.

Yup. Unless Carlson had an NDA with Fox for post-contract disclosures, they can put all the notices they want on it and it won't make a damn bit of difference.

Like when I get E-Mails from companies or lawyers (always accidentally for the latter) that have footers about how everything in that E-Mail was confidential.

Nice spin, but I kind of doubt that the '24 election is of paramount concern. If they can keep him silent for that long, he's finished. I think that's the real goal, and election stuff is secondary. If they can keep him quiet for a couple of years, there will likely be no comeback. He's done, and a major anti-establishment player is just gone.

He would have suggested a serious gag order or disparagement clause for the first to even fly - and you can't sign away your Constitutional rights in the first instance. Even gag orders have serious limits and don't often make it past the first appeal.

I believe certain clauses in contracts can be considered null and void if they conflict with the laws of the country, state, and/or local.
That being said, you can engage in an NDA and be expected not to talk about certain things.
No way to know without seeing the contract.

What kills me is that, now that Tucker is out at FOX, his audience was up for grabs - at least for a little while. All any of the other talent had to do was to take up Tuck's talking points and hammer those home to the remaining audience. If Laura, Sean or some newbie tacked in that direction, FOX could have weathered the storm. They chose to remain silent. And now, here we are.

Kind of like Mumford and Sons after the Winston Marshall was cast into the outer darkness.

It doesn't. It's either petty vindictiveness or Party-aligned action or both. There is no benefit to Fox in this. There was no benefit to Fox in firing Carlson in the first place. There is perhaps some vague "benefit" along the lines of "the rest of the propagandists and the state will quit trying to bury us so often," but that's pretty ethereal.

It is important not to think of the news companies - Fox or anyone else - as businesses. They aren't, in any traditional sense. It isn't about money. It isn't about growth. It isn't about the market. It isn't about the customer. Jeff Bezos didn't buy the WashPo and Carlos Slim doesn't shovel money into the NYT's maw because they're looking for a financial return on investment. That's not what it's about. It's about being in that vast propaganda complex and snuffing out dissent.

Probably not. Twitter is *incredibly* liberal in what it counts as a "view." If it's on your screen for more than two seconds (IIRC), it's a "view" on the public counter.

How many people *actually* viewed it by streaming standards? That is, total minutes of viewership and how many people watched at least 50% or 75% of the video? I don't know. I am sure Twitter does.

You can be sure it's a wildly smaller number than 169 million, though. Not that it matters. He was pulling in something like 4-6 million before Fox fired him. He is almost-certainly beating that by commanding margins.

Yep. People will handily tune into a 10-15 minute clip of Tucker Carlson over devoting an hour or so for a scheduled program. All he has to do is churn out regular clips of that length and he'll attract an audience like no one else can.

They're relying on the Dem-public-lore: "Of COURSE, Tucker publicized the Dominion conspiracy!!"

It was why so many Dems immediately took it that "Fox lied" when Fox did not allow its commentators to target Dominion. They were sure that Fox had said "something different" on air.

However, what Dominion was citing was that Fox was allowing *guests* who accused Dominion. And that would have been a hard test in any court (except a Dem-appointed Judge's court) to argue that Fox must comply with the de-platforming rules their competitors followed.

Breach of contract. Rumor has it that fox is/was paying tucker $10 million a year for his talent with an iron clad non compete agreement on any platform clause. Some say it is higher though. I have no idea other than what I have read.

The DOJ referral for indictment was in Miami because the DOJ says it was issue of who had jurisdiction was cause for concern for the prosecution. Mostly because the DC area court used for the Grand Jury indictment referral already ruled that PRA can't violate the Espionage Act of 1917 - oopsie! There goes the prosecution!

So, special idiot prosecutor Smith had to go to Miami's Trump appointed judge for venue purposes, anywhere else would have gotten the "we can't try this!" - so ops, oopsie! Smith is fucked, most lawyers that aren't living in "Trump is gonna die!" dream land know it.

there's a statement out today from Tucker's producer in which he says that Twitter was specifically excluded from Tucker's contract, because Fox never considered it to be a competitor.

This is starting to look like Fox's legal team knows they're going to lose big, but they've been ordered to do it so they're going to make it look good until they crash and burn. Something similar to Oberlin College's high dollar legal team, which got totally pantsed by the little guys.
