Sefton: sefton at cutjibnewsletter.com | Fox Notifies Tucker Carlson That Posting a Ten Minute Monologue on Twitter Breaches His ContractWhy it matters: A breach of contract claim sets Fox News up to explore potential legal action against Carlson, a move that would intensify the already thorny public battle between the two parties. Carlson's lawyers told Axios that any legal action by Fox would violate his First Amendment rights. "Fox defends its very existence on freedom of speech grounds. Now they want to take Tucker Carlson's right to speak freely away from him because he took to social media to share his thoughts on current events," said Carlson's lawyer, Bryan Freedman, in a statement to Axios.Tucker's motivation -- I speculate without evidence -- might have been to post a completely legal video, to induce Fox to declare he's in breach, so that Tucker can now say, "According to Fox, the contract is over, so I'm going ahead with my show. And I'm going to sue them for voiding the contract without cause so I can get my $25 million." I have no idea if this makes any sense. Tucker's Twitter debut garnered 70 million views. Egg with Legs Brian Stelter attacked Tucker Carlson's independent, wildcat show for being a skeleton crew operation: "Tucker on Twitter" is how @TuckerCarlson's video is branded. Non compete clauses are strictly construed against the employer. They have to be reasonable and limited in time and scope. They must specifically describe what exactly is "competition" and have a specific geographic limit. I can't imagine a non-compete clause that would prevent Tucker from doing a selfie video in his basement and posting it on Twitter to the entire world would survive any of those restrictions.

That's admirable, actually. "I don't have what I used to have, but I need to get back in it and if that means I wear multiple hats, then so be it" is a pretty good attitude to have. This is the typical leftist maneuver: If you observe a fact of leftist behavior and criticize it, you're engaging in "conspiracy theories and lies." But if you observe that same fact of leftist behavior and praise it, you're telling the truth. The truth or falsity of the observation depends entirely not on the external objective facts but only whether you are praising the left or criticizing it when noting the fact.
++++ This little interlude has it all, really. Conspiracy theories that aren't, but are called that. Elitism. Dependence on credential for "credibility." Rampant hypocrisy. They could probably even go a step further and say that Fox people always post stuff on Twitter without approval of management, so it's therefore not considered the same as having a show.
Fox may not want to open the pandoras box that comes along with a lawsuit, as then information about him being taken off the air goes public, and if it has anything to do with the Dominion suit, that seems like a a recipe for both Fox and Dominion to lose a few hundred million each, since having someone removed for something that had nothing to do with them seems like a clear case of wrongful termination. I'm not a lawyer, so I really don't know. Isn't it considered constructive dismissal to stop scheduling someone for their job? I'm assuming Tucker isn't hourly, but I'd guess his contract has some sort of bonuses for shows that get a certain viewership number or share. If Tucker isn't allowed to do shows, then it makes it impossible for him to attempt to fulfill that part of his contract.

I knew someone in a very high profile position that was in a similar situation of being in a non-compete.

All cable "sneewz" has been losing audience in huge chunks at least since the last election. That includes Fox, who simply manage to stay at the top of the dying carcass. People simply don't want what they're selling, which is catering to a specific conformation bias. Tucker changed that. He went old school and took on the stories and angles nobody else would pursue. He used simple logic and reason that most people could follow, and posed questions which challenged the prevailing narratives. That is, he didn't follow the crowd, he questioned the basis of their arguments which was almost always poorly sourced and backed only by their sycophants. I think Tucker going to Twitter will finally put the final nail in the mainstream media, and they know it. No talent, fat, pillow biting, buffet raiding mental midgets like Stetler can't live in a world where you have to actually form arguments, present proof and defend them. Pretty soon they're gonna find him face down in the pancake vat at IHOP.

"The gun lobby says we can't stop the carnage America now experiences every day without violating the 2nd Amendment – that thoughts and prayers are the best we can do… that's a lie," Newsom said in a statement. The amendment "permanently enshrines" four gun measures that Newsom claims have broad support. This includes raising the minimum age to purchase a firearm to 21. "Because if you can't buy a beer, you shouldn't be able to buy a gun," Newsom said in a video posted to YouTube. It would also mandate universal background checks, institute waiting periods for all gun purchases, & ban assault rifles. "Those weapons of war our founding fathers never foresaw," Newsom said. The governor asked supporters to go to campaignfordemocracy.com (Gavin Newsom PAC) to sign a petition. Posted by: BetaCuck4Lyfe at June 08, 2023 01:11 PM (MFZ8i) 159
I'm going with: Tucker was willing to live and let live when it came to the remainder of his contract with Fox. However, I'm also betting Fox will now have the privilege of paying the remainder of Tucker's contract. Plus, perhaps, whatever other money Tucker's lawyers can wring out of Fox.

Gavin Newsom
@GavinNewsom NEW: I’m proposing the 28th Amendment to the United States Constitution to help end our nation’s gun violence crisis. The American people are sick of Congress’ inaction. The 28th will enshrine 4 widely supported gun safety freedoms -- while leaving the 2nd Amendment intact: 1) Raising the minimum age to purchase a gun to 21 2) Universal background checks 3) A reasonable waiting period for gun purchases 4) Banning the civilian purchase of assault weapons Video: twitter.com/GavinNewsom/status/1666784034406666241 0:04 / 2:11 5:27 AM · Jun 8, 2023 Posted by: BetaCuck4Lyfe at June 08, 2023 01:12 PM (MFZ8i) 162

I don't mean to quibble, and Ace used the word "fake" too, but that's not the issue. There's some willful fraud in the raw 70m view count, maybe statistically significant, but it's not a huge concern. The problem is ignoring multiple views by the same person, and counting anyone who watches just a few seconds as a viewer. There's no filtering with appropriate minimum qualifications. One made a part "OMG is this our future?" And then posted about how this will now be common..... despite it being the first time it's happened. Still a different lunatic talked about how this is giving them anxiety...and stuff they said makes me assume its a 20 year old, who I'll also guess is afraid of rain and slight breezes. The format Tucker used means you have to actually form arguments, state conclusions and once he has guests, defend them. There are no circus distractions to make up for your lack of anything cogent or defensible. No "breaking" news or state sponsored commercials about the COVID vaccine. It's all under his control. Let that sink in for a moment. It vitiates their entire control of the narrative.

@296: "YouTube recently started publicly showing the most-rewound parts of videos ..."
A feature made popular by the porn industry before YouTube jumped on the bandwagon. Seriously! As far as not all videos, there needs to be a minimum view count and common pattern to the viewing pattern. For example, pop culture and sports video with ad reads have a common pattern since so many people manually skip past those. Product and movie review videos have lots of people skipping to the conclusion. But news and documentary videos won't show the timeline graph if people seem to be randomly skipping all over the place. Posted by: Walter Freeman at June 08, 2023 01:42 PM (k1Qly) 337

I watch a couple of YouTube's that don't seem to have much in the way of staff. What makes them interesting is the sheer amount of prep work that goes into them (They're both history.) The Metatron especially seems to spend hours on hours reading up on the topic and consults original sources. (Bastard reads and speaks both classical Latin and classical Greek.) TuCa seems to put as much effort into researching and double checking his resources. I think that's what keeps TuCa well ahead of the ordinary talking heads: he actually knows what the bloody hell he's talking about.

> If confirmed AI I will expect an apology from the DeSantis team.
Definitely. If they did it inadvertently, an apology will cover it for me, because that stuff is getting good enough that honest mistakes can be made (and Fauxci DID serve under Trump, after all... it's totally believable that there are pics of them schmoozing). On the other hand, if it was intentional... that would give me grave doubts about the integrity of the DeSantis team. By the way, I see that Schitt "Ziplock Bag of Hair Gel" Romney, Fat Fatty, and Great Value Race Bannon have all announced. Have I missed any? Posted by: polynikes at June 08, 2023 02:06 PM (MNhXM) The way they were used in the video it was hard to tell, but looking at the single images they were obviously not photographs, looked more like photo-realistic painting. Somebody knew, and yes if some sort of "those responsible were terminated" doesn't come out, Ron's stock is dropping at least for me. Of course, it'll also open the doors for some absolute hysteria in the coming months. Posted by: clutch cargo - processed in a facility that may contain lead at June 08, 2023 02:11 PM (zB/T/) 495

Was Tucker paid for this?
No? Then he is simply engaged in free speech. What's the difference between having a tweet, an e-mail, or a video rant get shared on social media? Tucker might have low balled this effort just so he could claim "hey, this is me just talking, hence I can't be in breach of contract." His contract might have a no compete clause, but if no money is changing hands, how is he competing? Does it have a no free speech clause? The way Twitter lists 'views' does get a little squirrely sometimes. But based on what I'm seeing here:
-More than 106,000,000 have at least gone his page in the last 45 hours. -And more than 22,500,000 have actually viewed his 10 minute monolog. That 22+ million number is about 8 times more than his nightly viewer number on Fox. AND it's about 35 TIMES MORE than CNN's primetime viewing numbers. But yeah, the cowardly elitists in media think the production quality wasn't any good. Posted by: Forheremenaremen at June 08, 2023 03:06 PM (VOHuN) 509
