Proud Boys Convicted of "Seditious Conspiracy" By Trump-Hanging Jury

As Julie Kelly wrote recently, this is just a set-up to prosecute the man they really want to imprison, Trump. If the Proud Boys are guilty of "seditious conspiracy," then anyone who conspired with them is equally guilty. Conspiracy only requires an agreement that some member of the conspiracy commit a crime, not that any part of the conspiracy commit the crime himself.

It doesn't even require that a crime be committed -- conspiracy is the agreement that some member of the conspiracy should commit the crime. Even if the crime is never committed, the conspiracy to commit that crime is still a crime.

They will attempt to claim that Trump's statement to the Proud Boys, "Stand back and stand by," was an acknowledgement of the conspiracy and further orders given to the conspirators.

Of the hundreds of video clips used as evidence in the marathon trial of five members of the Proud Boys, prosecutors began closing arguments not with a clip of the defendants engaged in criminal activity but with a clip of Donald Trump.
The government showed the jury a portion of the September 2020 presidential debate; goaded by Joe Biden and then-Fox News host Chris Wallace to condemn "white supremacists and militia groups" in an effort to downplay Black Lives Matter and Antifa violence, Trump asked them to "give me a name." Biden quickly answered, "the Proud Boys."
"Proud Boys, stand back and stand by," Trump said in response.
The offhand remark--Trump later said he did not know who the Proud Boys were--made the group "jubilant," assistant U.S. Attorney Conor Mulroe told the jury on Monday morning. "These defendants saw themselves as Donald Trump's army, fighting to keep their preferred leader in power no matter what," Mulroe said, referring to Ethan Nordean, Joseph Biggs, Enrique Tarrio, Dominic Pezzola, and Zachary Rehl.
Prosecutors have used the clip at other points during the nearly four-month trial--a not-so-subtle reminder to jurors from a city that voted 93 percent for Joe Biden that the men on trial supported Trump. But the Justice Department may have a more sinister reason to tie the Proud Boys to the former president. Any convictions in this trial would give Special Counsel Jack Smith, an independent prosecutor in name only, justification to pursue similar charges against Trump as a coconspirator of sorts.
In fact, the Proud Boys face three conspiracy counts: seditious conspiracy, conspiracy to obstruct an official proceeding, and a conspiracy to prevent an officer from discharging any duties. A conspiracy, according to the government, only requires the agreement of two or more individuals.
Prosecutors insist the conspiracy began on December 19, 2020--a date that should alarm Team Trump. At 1:42 a.m. on December 19, Trump tweeted this: "Statistically impossible to have lost the 2020 Election. Big protest in D.C. on January 6th. Be there, will be wild!" According to the Justice Department, that prompted Tarrio and Biggs to formulate plans to "radicalize" the group.

Prosecutors told the jury that no actual agreement was even required to commit the crime of conspiracy-- a "wink and a nod" will do, which is how they plan to get Trump.

Which explains why Graves' prosecutors pulled every dirty trick in the book to ensure convictions. Further, the burden of proof for the conspiracy charges is shockingly low. Consider the instructions given to jurors: "What the government must prove beyond a reasonable doubt is that two or more persons arrived at some type of agreement, including a mutual understanding or meeting of the minds, to try to accomplish a common and unlawful objective."
Mulroe, during his closing, even told the jury a "wink and a nod" represents agreement to join a conspiracy.
Preposterous.

"[There] was one final chance to keep Trump in power, January 6, 2021, and they knew the importance of that day," assistant U.S. Attorney Nadia Moore told the jury in her closing pitch on Tuesday afternoon. "These men's purpose was to illegally keep Trump in power."
And that will be the crux of Smith's case against Trump. Guilty verdicts in the most consequential January 6 trial will be the green light the Justice Department has been waiting for to go after him.

So this is 1, a farce, but 2, a very dangerous farce, as it sets a precedent for the prosecution of all future presidents: Joe Biden, obviously, has encouraged antifa and BLM's riots.

And with much more than a "wink and a nod."

Why shouldn't we throw his desiccated ass in prison for the rest of his miserable, brain damaged life?

And once presidents all understand that they will be imprisoned if they ever lose an election -- well, say goodbye to elections. No one's going to give up his life and freedom for the sake of "maintaining our precious normzzz."

America will be run by a tyrannical junta that routinely jails the opposition -- just the way it is in the Third World.

That seems like a leap, but it wouldn't be inconceivable for them to make that leap (or at least try). Even if you've "proven" that the Proud Boys engaged in conspiracy, that's not proof that Trump was a part of it. If you argue that the Proud Boys interpreted some Trump statement as a "wink and a nod," that doesn't mean that you can argue that Trump interpreted it as such or intended it as such.

If the standard is "Person Y interpreted what Person X said as instruction and encouragement to engage in crime, therefore Person X is guilty of conspiracy," then *everyone* is potentially guilty of conspiracy. That eliminates any efficacy of or respect for the courts. Just do what you want. You're a dead duck regardless, so YOLO it.

2. If he proceeds, he will be undercut at every turn by the MFM and GOP-e.

Many of us saw on the day it happened two classes of protesters in front of the capital. When the young strong and strangely dressed groups started making their way to the front you knew things were going to "happen".
And they did.
I suspected Antifa, but in retrospect probably the same cabal of jort wearing Ray-ban sporting folks we've come to know and love.

I partially thought the whole thing was a hoot and that it was time for the politicians in DC to have even a minutes worth of the fear the rest of the country had to endure all summer. Little did I know that the goal was to consolidate power by criminalizing one side's political opinion.

Ultimately, this is the reason why I support Trump in an uncontested primary for 2024. You simply cannot overlook the fact that this election was stolen, and that the state is looking to put Trump away for the rest of his natural life - even though he is one of the greatest presidents we've ever had, in many ways. I don't see how anybody else can run for POTUS without explicitly acknowledging what happened from 2016-2020, and explicitly looking to lock all these malefactors up so that this never, ever happens again. DeSantis can't say that yet - if at all. Only Trump can. Make America choose fraud or freedom, straight-up.

I see DeSantis strengths as protecting schools and attacking woke culture. I see Trumps strengths as the economy and foreign affairs. Together on the same ticket there's some synergy, and a lot of 'hot button' issues that might appeal to women.

The whole idea of "margin of fraud" was flawed. The idea of the "margin of fraud" is that there are limits to cheating before the cheating becomes obvious and unquestionable, and so the limits are somewhere below the threshold of obviousness because if that threshold is violated, the cheat will fail and potentially trigger a revolution.

When they YOLO'd in 2020 and blew through that limit, they got away with it. They did it again since in some races, like Lake's and probably Fetterman's.

2020 and a handful of races since have demonstrated that the thesis behind the "margin of fraud" concept is wrong. It does not matter if it is obvious, unquestionable fraud. It no longer needs to be believable. Because the root assumption has been demonstrated incorrect, the entire premise is incorrect. In many areas including virtually all of the hugely important ones, the "margin of fraud" does not exist.

There is an enormous difference between someone who lost and someone where the election was stolen, that's why. It's a time-honored tradition, especially in the GOP, that if you lost an election you step aside and let the next in line go for it. If you believe that Trump lost 2020 fair and square, and if 81 million people legitimately voted for Biden even though he campaigned in a basement (not saying that you assert that, of course), then I understand moving on from Trump. If we're getting outraged over the revelations that keep coming out about 2020, however, then I for one have to say that Trump needs to run again. If you run without acknowledging that, then - to me - you running hoping that the crocodile that got the last guy isn't going to get you.

The whole idea of "margin of fraud" was flawed. The idea of the "margin of fraud" is that there are limits to cheating before the cheating becomes obvious and unquestionable, and so the limits are somewhere below the threshold of obviousness because if that threshold is violated, the cheat will fail and potentially trigger a revolution.

After a big argument the night before, needed a break from the wifey last night -- so decided a good distraction would be heading to the virtually empty local movie theater to watch John Wick 4 as a guilty pleasure.

Just hilariously & fantastically over-the-top, as all three before, but tremendously admirable if you view it as a highly-choreographed ballet (trying to imagine how many takes Keanu has to do for each sequence) with unlimited bullets (how does he get those handguns to hold hundreds of rounds at a time? I saw maybe a handful of magazine changes) and other very cool weapons and scenes. [Perhaps the best scene, with an homage to "The Warriors" occurs around the Arc de Triumph.]

I really don't think so. All governments - even tyrannies - need a facade of legality. Elections can be adequately controlled. If they need to, they can steal the elections outright and the parties have good controls in place to prevent outsiders from getting in to the race at all (the Dems' are better than the Repubs', but both work fairly well). Irrelevant elections are much, much better than canceled elections. Elections serve as a useful fiction for the tyranny's rulers.

It depends on who's running. If there's an actual opponent, then yes - definitely.

If there's a good, solid, Uniparty man on both sides, perhaps not (or, rather, no more than the pre-2020 norm). If, say, Mitt Romney ended up as the GOP candidate, I doubt they'd fight him all that hard. Why bother? Keep up appearances and let the JV crew take a turn in the big chair. It doesn't make much if any practical difference anyway.

Perhaps, but Russia is operating under political constraints. They really hesitated before mobilizing 300,000 people into the military, and they seem very reluctant to do another mobilization.

Honest question. As someone who believes the same that the election was won by incredibly unjust means. (Suppressing and openly lying about the Hunter laptop, massive potential for hiding/producing ballots in mail votes). All I heard from Powell, Gulliani, etc. was promises of a Kraken and "there's no way Biden got 81 million votes".

And every time they were specifically asked by a judge if they had any specific evidence, the publicly documented answer was "No". At no press conference did they articulate to the American people exactly where the fraud was and believe me I wanted to hear that. It was all cloak and dagger about foreign datacenter gunfights and innuendo. This didn't persuade anyone but die hard Trump supporters.
