THE MORNING RANT: How to Respond to the Indictment of Donald Trump? By Arresting Alejandro Mayorkas

Donald Trump has been indicted for something old and trivial. Manhattan District Attorney Lavrentiy Alvin Bragg has acceded to the left’s demand that Trump be arrested for the unforgiveable act of winning the 2016 presidential election. Bragg was shown the man, and he obediently found “the crime.”

We can register our disgust about hypocrisy, or a two-tier justice system, or criminalizing politics, etc. Or we can respond in kind. The last option is the only one that will make this stop.

Jesse Kelly - Trump Arrest.JPG

What high profile Democrat should a Republican District Attorney indict? How about Alejandro Mayorkas?

As Secretary of Homeland Security, Mayorkas has thrown our border open to narco-terrorists, human traffickers, and anyone else who wants to cross the border.

What crime should he be charged with? Mayorkas is an accessory to every crime committed by someone who crossed the border illegally during the Biden administration. He is an accessory to every death from fentanyl that was transported across the border. He is an accessory to sex trafficking. He is an accessory to child abandonment. I could go on.

Who can indict him? There are 254 counties in Texas alone, most of them deep red, and there are a couple thousand more deep red counties throughout the country. The District Attorney in any county touched by the Biden administration’s open border/catch-and-release policy could summon a grand jury and indict Mayorkas.

Red Blue County Map.JPG

There are hundreds of Republican DAs across the country who look in the mirror and see a rising political star. All they have to do is arrest Mayorkas and they’ll rocket to political superstardom among the Republican base.

“But that’s not who we are…” says the surrender caucus of Conservative, Inc.

But that’s who the left is. And these are their new rules.

Arrest Mayorkas.

61 Whether a state may prosecute a federal official for a breach of state criminal law while acting within the scope of federal duties. No, because the federal official has immunity from the state criminal law, derived from carrying out federal law or duties and thus protected by the Supremacy Clause- the supremacy of federal law over state law. The threshold issue is that the federal official must have been working in the scope of his duties at the time. This issue was first faced by the Supreme Court in In re Neagle, 135 U.S. 1 (1890). In this unique case, a federal marshal killed a California man in defense of Justice Field, who was a member of the U.S. Supreme Court. The man had previously made violent threats against Justice Field, and Neagle was assigned to protecting him. In a belligerent encounter, the man slapped Justice Field to provoke a fight, and allegedly reached into his breast pocket. Neagle, fearful the man was going to pull out a weapon, fatally shot him. The man turned out to be unarmed, and a California sheriff arrested Neagle on murder charges.

64 On writ of habeas corpus, the U.S. Supreme Court released Neagle and made clear that state law is displaced if it imposes burdens on a federal officer's attempts to protect federal interests or execute federal law, even if no federal statute specifically authorizes the federal official's conduct, as was the case here. Neagle established a two-prong test for this type of immunity from state criminal law: (1) Was the officer performing an act that federal law authorized him to perform? (2) Were his actions necessary and proper to fulfilling his federal duties? If the federal officer satisfies this test, he or she is immune from prosecution for violation of state law.

71 A similar issue was brought forth more recently in the Ruby Ridge case, Idaho v. Horiuchi, 215 F.3d 986 (9th Cir. 2000). Horiuchi was an FBI officer who fatally shot an unarmed woman during an FBI raid on a ranch in Idaho. He had intended to shoot the armed man near to her. The state of Idaho subsequently brought criminal charges against the federal officer for involuntary manslaughter of the woman. The court, relying on Neagle, dismissed the charges. The officer was immune from the state charges through the Supremacy Clause because he satisfied the two prong test. Horiuchi was acting within the scope of his duties at the time, and he "reasonably thought" his actions were necessary and proper.

Beyond that. The argument against such an action - beyond any mealy-mouthed "not who we are" crap - is that escalating the weaponization of the indictment process will destroy whatever tattered remnant of law that still exists. The federal law system and the systems of various localities - mainly, the blue hives - is wrecked. Dead and gone and nothing but an offensive weapon.

Retaliatory indictment of Mayorkas (or whomever) will mean that the destruction of extends to the last holdout - non-blue-hive localities. It is a weapon at all levels and at all places, and there will be not even a patina of legality left at any level. That is the kind of action that can rip what's left of the system to pieces.

For me, though, I like the idea and think it should happen. Yes, it runs the risk of collapsing what's left, but playing by the rules against an opponent that has *no* rules at all is just a way to be ground into dust. Only a fool plays with clean cards while his opponent uses a marked deck.

Yup. Weaponizing the law against the people - specific people, and also people at random just to keep them on their toes - is a powerful tool. It's also a one-way street. Once you take the lid off of that particular variety of Pandora's Box, you cannot put it back on. You have to leave that lid on, no matter what because if you don't, the only way out of the problem is a new system. An entirely new system. And that implies collapse, revolution or invasion - or all of them, in various orders.

Well, because he was federally investigated by the SDNY and they indicted him in NY court and ostensibly his "lawyers," did not ask for a change of venue or some such.

Afterwards & separately, the president and VP of the company were indicted (NY) on charges of criminally assaulting and recklessly endangering lives (of their workers). They faced jail terms of several years for their convictions on assault and other charges but the Justice dismissed one of the assault charges and, further, ordered fines of 10K each and 6 months of weekends in jail.

Frankly, that case stunk at federal agency level but that didn't stop it from being issued & publicized, and then the state filing completely separate criminal charges. Now, the faces change - now more than ever - but the games remain the same or even more convoluted.

Secondly, found a very interesting document, dated February 13, 2023, entitled: READOUT: US Department of Labor expands OSHA's ability to protect all workers by certifying special visa applications to ensure effective enforcement. (So, Secretary Walsh gives OSHA authority to provide ‘U’ and ‘T’ visa certifications and then promptly leaves the U.S. DOL.)

Petrol dollar IS the US dollar. For a little while still.

RUS and CHN seem to be threatening a gold backed currency. Or basket of commodities currency.

Which of course means the nukes launch.

394 In theory, but Saudi Arabia definitely has nukes they bought from Pakistan. Never mind the Russian nuclear fleet. While the planet can be cooked by nuclear war, hyper urbanized blue America is uniquely vulnerable to fallout.

396 Clearly the only answer to this retarded political theater is even more retarded political theater. Host another fake and gay show trial so cringey Republicans can deliver snappy sount bites for the cameras before they cave to the Left like usual.

Meanwhile the Left are lining up to defend a child-murdering tranny and pedophiles giving lapdances to school kids, and they're going to get away with that unopposed. Hey, you want to really hurt Mayorkas? How about broadcasting every fucking day those horrific videos of infinity 70-IQ Haitians pouring across our border like the fucking Zerg swarm. You know, maybe use your platform and reach to hammer 24/7 on things that actually delegitimize the regime on a fundamental level and bring their true evils into the light. This is like the lowest-hanging fruit imaginable, and the Republicans are too fucking stupid to reach out and take it.

As galling as it is in siatuations like this, you can't defeat the System in a head-on fight from within the System when you control zero bases of institutional power. Trump is still learning that the hard way, and the rest of the Right needs to wake up to it as well.

397 @396

>>Trump is still learning that the hard way, and the rest of the Right needs to wake up to it as well.

Trump has been trying to get "his" people into positions of power, it's just the axis of power and Uniparty have been using their force multipliers to thwart that.

You know, "Quality Candidates," and all.

The idea that Trump hasn't been fighting to the best of his abilities to change the game and the system is short sighted.

The man has done more in less time than a 1000 Republicans in the last 25 years at least.

399 Why aren't we taking all of the Left's sacred cows to the BBQ?
Yes we only have 1/2 of 1/3 of the Government. We can still let things grind to a halt.
Do simple things. like no federal money in any form, loans, grants, payouts, to any school that practices DEI in admissions or hiring. The government may not do business with any company with a Chief Diversity Officer. No funding to schools that don't guarantee first amendment protections to all members of their communities'.
Start impeaching Leftist judges. The J6 judges have been an offense against the Constitution for a long time. And, yes they won't be removed, but let the process be the punishment. That's what they do to us. Convictions are just bonuses for them.
They've thrown out all the norms. Its time for them to start to pay too.

403 Better yet..arrest Bragg, and half a dozen other prosecutors who have launched "Get Trump" cases....for Federal Campaign Finance Felonies, each case and every dollar expended was/is a campaign donation to both DNC, and every federal Democrat office holder. Any communication of any kind between them is waived of any confidentiality, any dime donated, allocated, spent, is evidence of collusion to illegally effect elections, commission of further linked felonies... Goose Gander...same sauce. Roast them in the oven they built for Trump..

Indict Obama, Hillary, and Comey for colluding to overthrow a duly elected US President.

There is no statute of limitations on their crimes. And if anyone claims there is, do what Bragg did here with Trump, make it the fuck up.
