DeSantis: Apple's Threat to Deplatform Twitter from Its App Store is an Act of "Raw Monopolistic Power" Which Should Be Met by Congressional Action

Florida's Voice
@FLVoiceNews

WATCH: Ron DeSantis says Apple removing @elonmusk's Twitter from app store warrants Congressional response

"That would be a huge, huge mistake, and it would be a really raw exercise of monopolistic power that I think would merit a response from the United States Congress."

One of the most INFURIATING things about the current moment is the utter and complete silence and weakness of roughly 100% of DC establishment Republicans. Every single elected GOP person with a brain and/or spine or even a freaking PULSE should be saying at least this much.

I don't have words for how much I loathe establishment GOP & its unfailing weakness and humiliating impotence in the face of the left's assaults. Desperate to fellate the media and other regime actors with performative gatekeeping instead of real action, they are beneath contempt

I can't wait to read National Review's thorough commentary on this.

And I know National Review will in fact take a strong position on the antitrust violations of its corporate sponsors, because Rich Lowry tells me that National Review, unlike Some Other Conservative Blogs, is "fearless."

Donald Trump Wants National Review to Die

By RICH LOWRY
November 21, 2022 6:30 AM

You can keep us strong.

Donald Trump issued, by his standards, a fairly mild denunciation of National Review the other day.

He didn't insult anyone's wife, give us a nickname, or say that the title of our magazine somehow sounds Chinese.

He only said that we are lightweights who serve no purpose and whose publication deserves to die.

If you think he has a point, the rest of this post is probably not for you.

If you think, to the contrary, that it's more important than ever to have a fearless voice speaking the truth to try to get the party past the cycle of failure and frustration currently gripping it -- thanks largely to the destructiveness of the 45th president -- then I'm hoping you will contribute to our little fundraising effort.

Our position in the Trump era hasn't necessarily been a popular one -- and certainly not an opportunistic one.

Say, Rich, I notice your little blog has almost completely embargoed any mention of the enormous proofs that have emerged that your corporate patrons colluded with the federal government to censors the speech of conservatives -- which makes this not a case of Precious Corporate Speech, as you routinely defend such censorship, but of Government Censorship Through Corporate Deputies.

Apart from allowing your news blogger to write up a story here or there as these bombshells have emerged, you haven't had any of your lawyer-bloggers explain to your readers that this puts your corporate donors' censorship actions in an entirely different category of legality.

It's almost as if people who work there know that they're not allowed to speak badly about FaceBook and Google.

But you're "fearless," right, Rich? You tell the truth no matter what the consequences? You tell the truth without fear or favor, right?

The dynamic of the past several years has been that if you lose your mind about Trump and allow him to unmoor you from your conservative foundations, you will get widely praised and have opportunities in the mainstream media that you wouldn't otherwise, and hard-core Never Trump and/or Democratic donors will fund your publication.

On the other hand, if you a find a way to evade or justify all of Trump's failings and allow him to unmoor you from your conservative foundations (just in a different way from the category of people above), you will be hailed for your bravery and handsomely rewarded by MAGA world.

If you eschew both of those approaches and are happy to give Trump credit where it's due and maintain all your preexisting conservative commitments, but call out Trump as warranted and warn of his deleterious political effects, well, then, you are condemned as quislings or cowards by both the "Never" and "Always" factions.

How much money do you make for pretending for three fucking years to not notice that your primary donors are illegally colluding with government to censor the speech of your readers?

I'm not complaining. I think the ground NR has staked out is principled, prudent, and correct. The point is that no one would do it for self-serving reasons.

And, indeed, we haven't.

Except that your stupid little blog would go out of business if you upset your paymasters Google and FaceBook, so you don't upset them.

Rich boosts DeSantis here.

Does that mean that Lowry endorses DeSantis' notions that maybe Corporations don't have plenary power to limit citizen speech as the whim moves them? That maybe there are some limits on the censorship rights of Conservative, Inc.'s Holy Corporate Patrons? That maybe antitrust law is not, as Conservative, Inc. argues sub silentio, dead letter and just another part of the law that we ignore because "that's like a hundred years old, man"?

LOL, I doubt it.

"Fearless."

Fuck you, money-grubbing ridiculous gussied-up whore.

60 Apple tax-free shopping coming soon to nine US states, with Florida starting today
Ben Lovejoy - Jul. 25th 2022

There are different eligibility dates for different product types in each participating state, but nine of them allow tax-free shopping for various product categories sold by Apple at around the same time - starting from today.

Apple has a web page promoting the deals.

"Innovative. Powerful. And now tax-free.
Shop select Apple products in a store or online and save during your state’s tax holiday. And explore our additional offers for more savings.
Eligible products vary from state to state. And while the tax savings on your order may not appear at purchase, they will appear on the final receipt."

Apple has detailed which of its products are eligible for upcoming sales tax holidays in select U.S. states, including Arkansas, Florida, Massachusetts, Missouri, New Mexico, South Carolina, Tennessee, Virginia, and West Virginia

Huh? Is this from the same article? Is this from the same guy? He is describing himself. He lost his mind about Trump and became "unmoored from his conservative foundations" (they were never moored, of course, but that is beside the point) and his circle gets to go on MSNBC and laugh at the rubes and cash checks from other hardcore Never Trump or leftist donors. He is describing himself, with a fair amount of clarity.

Also, enough with this canard, Rich. Trump was a spendthrift, which isn't conservative (though it is very GOP) and did the prison reform thing (ditto). But on most of the rest - regulation, trade, foreign policy, abortion, etc. - he is far, far more conservative than you ever were.

The same way the rest of western institutions were corrupted: easy money and a lot of built-up social capital to play with. It meant that for years these organizations didn't actually have to be a net positive. Tech companies didn't have to run a profit, merely take more money from investors on the vague promises of some day being profitable.

The National Review really shouldn't be populist, but it should at least be something, shouldn't it? Maybe express some fire in defense of the Constitution? Liberty? The correct congressional response is to demand - publicly - that the FTC do its job - or else. The "or else" is writing its budget to zero, repealing the law that formed it, and creating a new agency or taking direct action itself.

154 I dont see it as an issue since nobody needs an app store in order to download an app. The app store is an app itself, and you don't need to use it. Phones also have web browers. With a web browser you can download an app from anywhere.

You absolutely need an app installer. The only way around it is to either use the mobile website (which is often slower and more cumbersome than the app, and notifications usually don't work as well or even properly at all) or to break the walled garden and load your own software ("sideloading" or "jailbreaking"), either of which will violate your EULA and technically let Apple terminate services without recourse if they want to, as well as deny any warranty service or technical support.

Apple and Google's walled gardens (Apple's is more complete) are ostensibly to ensure software quality, not software content.

161 Apple's Three-Month Tax Savings under President Trump's New Tax Law: $1.68 Billion
ITEP - May 2, 2018
Apple, the nation's most profitable corporation, revealed its quarterly earnings report earlier this week, providing the first concrete indicator of just how big a boost the new tax law is for the tech world darling. The report, covering the first three months of the company's activities under the new tax rules, shows $16.1 billion of worldwide pretax income, and an income tax provision of $2.35 billion, for a tax rate of 14.5 percent. By comparison, the company's effective tax rate for the first three months of calendar 2017 was 24.9 percent. If last year's effective tax rate were still applicable, the company’s first quarter income taxes would be $1.68 billion higher.

If its recent tax savings are a predictor of how Apple will fare over the rest of 2018, the company could see a net tax reduction of $6.7 billion in 2018. This is in addition to the $40 billion one-time tax savings ITEP has estimated Apple will receive from the deemed repatriation tax provision in last year’s tax bill.

Enforcement of the Sherman Act is controlled by the FTC. It is possible for private parties to sue, but they must show specific financial damages caused to them personally by the anticompetitive action, with the potential of being awarded triple damages.

Many people think it's possible to just "sue" because you don't like something, but it is far more complicated than that.

Posted by: Mary Poppins' Practically Perfect Piercing

Trump at heart is a deal maker. It is unclear what a DeSantis administration would do because Congress is hostile to any reform and the bureaucracy is much more resistant to any GOP president. I would not expect the same latitude in DC that DeSantis got from the Florida legislature and courts and we will see if the Disney or the Tampa Bay stadium issues are quietly fixed on the down low. That is how GOP usually does it. Blowhard and then go back to biz as usual when the publicity fades.

How is it certification if you are compelled to do it by threat of arrest and legal action? That's not agreement, its just a forced step to impose a tyrant's power.

If its not voluntary and cannot be refused, then its not certification at all its just rubber stamping the tyrant's will.

Until DeSantis takes aim at the spineless DC GOPe unlike Trump did from the very start, my fear is that DeSantis in office, because like Nixon, he is very calculating, will simply try to triangulate too much. Nixon did lasting damage to the US domestically by trading domestic liberalism with guns and butter for continuing the Vietnam War and Cold War. His appointees to the court were largely abysmal and his domestic legislation pure liberalism. Nixon and his henchman Kissinger essentially saw the whole world as a real life Risk game. Reagan or Barry would have made far better presidents in 68 than Nixon.

GOPe values generational wealth over any long term survival of the US as they figure to be on the beach somewhere else when the shit hits the fan. The Dems will fight over a dunghill for power, the GOP prefers to flee with their ill gotten gains. GOPe view politics as a business where they get rich in return for offering servicing to donors.

302 > Apple's OS has been more stable and consistent.

Apple has a big advantage in that they don't support old versions of their OS. They also don't support their own, very controlled versions of hardware, for as long as Microsoft supports old versions of their software.

Also, I would argue for probably the last two decades, almost all blue screens are directly related to hardware or poorly coded drivers.

This penetrates the psyche of people, even people who think of themselves as resistant to the drumbeat of Popular Corporate Propaganda.
My problem with Ron DeSantis (and he is a good guy, really) is that he is NOT personally wealthy (as is Donald Trump), and will be beholden to the Big Donors regarding his policies, plants, etc, if he becomes President.
A relative handful (maybe 100-200) of very wealthy people control both parties, and they have a lot more in common with EACH OTHER than they have with normal folks, like those that comment here on AoS. They have control, although most of them are pretty publicly invisible.
Rich Lowry speaks and acts as he is told. And that is why. Rich people who subsidize National Review control what the content is, relatively speaking.

328 Even a non-useless GOP House would have serious limits on their powers, of course we're not talking about a serious or useful GOP at this point.

Of course even in this situation, much can be done, in the way of politicizing or highlighting things to affect public discourse and be in a position to eventually take real action.

Like a serious attempted attack, and lots of blabbing, about the monopolies and oligopolies in tech, including everyone's favorites being mentioned here today. Or the same thing *directly confronting the outlandish hypothesis of AGW*, rejecting it by applying normal scientific standards, and common sense. NOT just quibbling about "costs" and "feasibility", which is a dumb and ruinous approach. No laws will be passed, but FFS how about reintroducing politics to politics?

Oh, and I'd mention O-care, and the long-term distortion and waste and dysfunction of the medical financing system of which it was the crowning atrocity - but the GOP of course probably could never mention that one again without the derisive laughter (of its own voters) drowning out the message.

Making it smaller and not as useful would negate its purpose. People watch movies on their phone, they play games.

If all people wanted was something to make calls with, yeah, that would work fine. To replace the phone you'd have to come up with some kind of cyber interface into your brain that gave you an internal HUD that you could interact with like Iron Man.

345 @203 I mean, there's a lot to say here, but the main takeaway is... how seriously are you to take a government that would arrest someone for not agreeing with their election? How is it certification if you are compelled to do it by threat of arrest and legal action? That's not agreement, its just a forced step to impose a tyrant's power.

----

Thing is, the threat of arrest makes a certain amount of sense. My understanding is that County A's certification is only supposed to apply to County A's election results. The fact that County B had a blatantly bad election but is certifying it anyway has nothing to do with whether County A's results should be certified. Because the two counties are basing their refusal to certify on the bad actions of a different county, the arrest threat is probably legal.

On the plus side, if it were legal for a county to refuse to certify because of the bad actions of another county, we'd probably see Democratic strongholds finding excuses to refuse to certify when the Republicans overcame the level of fraud in state-wide elections.

Republicans in Maricopa should be demonstrating 24/7 outside the homes of everyone involved.

Something like this will happen if and when Republicans start getting serious about mail-in voting and ballot harvesting. If they are successful at beating the Democrats at their own game, they will wail to high heaven and accuse the Republicans of stealing elections--and THEY'LL get an investigation.

When DeSantis tells Mitch to go off and die somewhere or the same for McCarthy, remind me.

Politics is the art of the possible and politicians-ALL OF THEM, will break your heart, steal your lunch money and liberty, and screw different groups at time for gain. I view a sanitation worker as serving for a more useful function.

For me, the republic is past saving at the national level, the question is divorce, collapse, or civil war (pick any two probably). So, my state and local officials make a helluva lot more difference than what the feds will do. In the world and at home, increasingly the only thing the feds can do is screw stuff up, not fix it. I've accepted that and this election was a perfect example of why the GOP will never change its stripes.

Covid 19 (as it has been called) was developed at UNC and Fort Dietrich by Ralph Baric. Along about 2015, there was beginning to be an uproar in the biomedical tech industry about "gain of function" research, and how dangerous it could be.
Peter Daszak and EcoHealth Alliance (largely funded by the CIA) took Baric's research and went to the Wuhan lab, where development was complete, with the help of Shengli Xi, "the bat lady", to develop the virus for release.
It was not a "lab leak". It was a deliberate release. And several strains were made of varying toxicity.
See Italy.
The Chinese already had the polypeptide code available for the mRNA vaccine "spike protein", and sold it to Pfizer and Moderna in early 2020.

Trump is running for personal reasons - he wants vindication and revenge for what happened to him. I wish him the best, but that doesn't matter to me or affect me, because his second Presidency would be a re-run of the first. It's a purely symbolic thing.

Any other Republican running for the Presidency can only grift, advance the Dem agenda, or get sidelined just like Trump did, and they all know that. The Presidency (and Congress) are effectively obsolete offices, anyway, but doubly so for a Republican.

If they're running, they're scamming you.

Ballot harvesting doesn't work with Republicans. The Republicans here in California tried it, but discovered that Republican voters are reluctant to trust their ballots to people they don't know who show up on their front doorsteps.

Drop boxes was the solution that the California Republican Party came up with instead.

419 If'n I was El Presidente, I'd do two thing immediatly.

1. Executive Order that All Foreign Aid depends on if said country embraces our Bill of Rights, including ACTUAL Freedom of Speech... if not? no foreign aid.

2. Push for a National Law much like the Race Discrimination laws, which say if you discriminate you can't get a business License in the US... but add that it goes for ALL Rights enshrined in the Bill of Rights.

We really do not HAVE property rights anymore in the US... most of us Pay Rent to a Government in property taxes, and ALL have some regulations saying what we can do with our land... so why does that trump the RIGHTS of others to Free Speech or to carry a gun?

True outsiders get shit on. Like Trump did. He wasn't/isn't a grifter. It cost him a lot. His relationship with the PGA for one. Half the country won't stay at his hotels now. And at his international properties its probably more than half the world. Getting into politics, if you are running a business, is a great way to destroy your brand. Which is why most of the people in politics stay in politics. Its polarizing and limits your market audience.

Unfortunately others get a say too and unless DeSantis plans to become Caesar, the GOP Senate under Thune will act to thwart his appointees that rock the boat, continue our fiscal collapse and the Dems will be even worse.

Like Trump found out after 2020 election, he looked behind and found little succor and support from his erstwhile fellow party officeholders. If you think that DeSantis won't have the same basic issue, I have a bridge to sell you.

And btw, I am not against DeSantis or Trump being the nominee like I am for such as Nikki or other snakes. I don't really care much one way or another but neither can save the dying republic but they might buy us some time. Trump bought us 4 years for those paying attention. If we can get another 4, it might just keep us from being obliterated by a nuclear attack or descending into Somalia.

it's not compulsory at all. He is perfectly free to chose the right answer any time he likes.

Mint and Linuxes can install their own bootloader and allow you to boot any you want. It's is a bit of an annoyance if you are going for the non-default partitition since you have to catch it in the act, but aside from that painless.

493 Barney stills sucks. It's an objective truth. But no matter what, Barney can never suck as much as Calliou. Calliou is the children's cartoon equivalent of sissy hypo pron. No matter how much something sucks, it sucks less than Calliou. Even full-blown AIDS.

499 "My question is, is DeSantis courting any of this, or is he is just coyly letting it play out and has no intention of singing any of their RINO tunes. He seems like a smart guy."

-------

He's courting it. There's been an invisible primary going on for about a year. Campaigns have been competing behind the scenes to lock-in donors and staff. It's a very small circle of GOP presidential-level donors and staff, so word gets around when recruiting efforts are made, particularly when the subjects of those efforts were in the past committed to a certain former president.

It's been an open secret in GOP circles that DeSantis would run since last winter, which is why the claim that Trump attacked DeSantis "out of the blue"/unprovoked is so disingenuous.

504 I think DeSantis is adhering to Reagan's 11th Comandment... thou shall not speak ill of a fellow Republican. He holds his snark for Dems and the Media.
Posted by: Romeo13

Stop with the Eleventh Commandment shit. That was a tactical nuke by Reagan invoked in 1980 to keep his frontrunner position for the nomination and prevent attack on him from the GOPe. He attacked Ford plenty in 1976 primaries.

If DeSantis has criticisms of Trump, let the guy air them, let Trump fire back. That is how you get candidates vetted instead of finding out the month before the election some crap that destroys them.

I have always despised the GOP fighting their political battles by passive aggressive bullshit behind aides or leaks. Trump using Twitter was a refreshing change. Instead, the GOP luvs them some coronations if the nominee is GOPe friendly and tries to backstab them if they don't like Goldwater, Reagan, and Trump.

The whale donors that call the shots in the GOPe don't like any threat to 'free enterprise' which is why the American Enterprise Institute and Cato Institute hires leftists that explain how corporations voluntarily supporting government censorship, tax avoidance, ESG, carbon taxes, open border, industry cartels, and corporate subsidies is very free enterprise.
