How GOP Legislatures Can Copy Johnny Depp and Defang the Lying Press Tomorrow With One Simple Trick

I am not a lawyer, so I can't speak definitively to the merits of the proposal, but it seems like a hell of an idea to me. Basically, what the author is arguing for, is for Republican state legislatures to add falsely calling someone a racist or white supremacist to the list of things that constitute defamation per se.

“Defamation per se” denotes statements so inherently damaging that their false utterance is presumed to hurt the target, no matter what – even if he cannot prove economic harm. The damages are simply assumed automatically. When a libel or defamation case involves statements that are defamation per se, it is substantially easier to win a case. But just as importantly, by reducing the pleading hurdles at the outset of a case, defamation per se makes it much easier to hold a defendant’s feet to the fire in discovery — for example, by demanding all Slack or Journolist logs pertaining to the smear.

Traditionally, four types of false allegations have been considered severe enough that they constitute defamation per se:
Claiming a person was involved in criminal activity
Claiming that a person was unethical or incompetent in their professional conduct
Claiming a person has some kind of contagious or loathsome disease.
Claiming a woman is unchaste or has otherwise engaged in sexual misconduct

He goes on to argue that a false accusation of racism today is far more damaging than the traditional allegations above.

Imagine you’re the typical American mid-career professional, a doctor or lawyer or college professor—if you already are one, no need to imagine. What do you fear more? Being falsely accused of having monkeypox, or of being a “racist”? Would it be worse to appear on your local newspaper’s front page under a headline suggesting you embezzled money, or one suggesting you are a white nationalist? The answer, we suspect, is obvious.

Holy Land, a restaurant and hummus brand in the Minneapolis area, was destroyed after activists dug up tweets the owner’s daughter made as a teenager eight years previously. Despite the owner firing his own daughter, stores yanked Holy Land’s products from shelves, a landlord evicted it from one of its restaurants, and ultimately nearly 70 people lost their jobs.

So what do some of you lawyerly types think of the idea?

Environment matters. When the environment around you does not seem conducive to serious courtship and marriage, then there is a high probability you will not seek those things. On the other hand, if you see the majority around you acting more mature and marrying earlier, then you will seek potential life partners from the outset and look for a different set of qualities.
A lot of young men, being naturally competitive, may not necessarily envision a life of casual sex but become seduced into it after observing their peers engaging in the lifestyle. Young men enter a sort of arms race against one another. Many of them will think: “Why should I settle down early when the other guys are hooking up with so many girls now? Are they cooler or better than me? I have to prove that I can do it to!” This will lead him down the rabbit hole of “hook up culture” which could become addictive. It may take years to undo this lifestyle.
Young women compete with each other too. If they think showing off their bodies on social media or having sex with the more popular guys will raise their status or secure a higher status man, then many of them will act accordingly.
It is difficult to commit to a partner unless you sense loyalty from that person. An environment of partying and easy online dating does not exude loyalty, but rather, opportunism and fleeting pleasures. This makes everyone involved more paranoid and avoidant.

Then there is this tweet, and the discussion that follows.

The third was a long Twitter thread from a lady who recounted, quite frankly, some of the things she had done as a young adult, including having a threesome with the man whom she later married, and how they reverberated to this day and almost destroyed her married sex life and indeed her marriage itself. I don't know if it was “brave” to post what she posted, but she was very candid about things that she had done and how they effected her later in life, and how she and her husband were working on healing the wounds. The thread was up for several days, but when I went to link it for the ONT it had been deleted.

As someone from Gen X, I sometimes think that we hit the sweet spot of the sexual revolution. The hedonism of the 70s certainly bled over into our high school and college experiences, but traditional expectation of marriage and families also held sway, and most people my age moved pretty seamlessly from college to career and marriage. Now than I am older I can see the problems with it, but all in all, and generally speaking, I don't think the college party scene impacted our future lives too badly.

Nowadays, however, for millennials and zoomers, it didn't end with college. Hook up culture continues right through their 20s and into their 30s. By the time they start to think about the future, the men are jaded and the women are bitter. Not everyone, of course, but a good chunk of the population. It's a problem. I can't think of a stable society that wasn't centered around the family unit,and ours is becoming less and less so.

This is always the final phase of crashing regimes, and it won’t go any better for them now.

Depends on the type of black olive. The ones in a can? Cardboard at best and just as tasteless. But kalamatas? OMG! They are another level of black olive. And they go so well with all types of Mediterranean cuisines, like Greek, Italian and French, even Middle Eastern.

Auntie wanted me to have a few of the family's ancient apple cider vinegar barrels which were a cash crop for my family for decades back in the day and her stash of Griswold cast ironware.

I have one barrel in my garage. The smell is wonderful and takes me back to childhood remembrances. I use the cast iron every day.

Crush three or four garlic cloves into that salt and rub them into the bowl. The oil matters. Half an onion, diced.
A small block of feta. One jar of kalamata olives.
Toss this all together.
Fry up about 1/4 pound bacon bits. Into the bowl. Stir again. Eat a bit. Eat a little more.
Put the bowl into the fridge to marry a bit, and start boiling shell pasta... I like big.
Once they're al dente, throw them in the bowl... wonderful hot. Better cold.

When I told my Irani olive oil supplier of this, he told me it matched a dish his wife made, only she used tomatoes instead of the pasta shells.

Dog in the shower with one of those hose attachments works well. You just go in with a swimming outfit because everyone's gonna get wet anyway. Also outside on a patio works well enough but you're limited by weather and the seasons.

There is a store near me that once in a great while has morels. They charge from $50 to $70 a pound. I got a handful earlier this year and it cost me about $7 because they don't weigh much. They were a yummy treat.

He wasn't sure if that; I said I expected AGI around 2032 and the decade before that, computers would start to get really scary. That prediction and timeframe has held up pretty good.

361 Jesse and I got married in a lawyer's office. She charged $100. I had bought a new dress for about $70. Afterwards we went to the range for celebratory gunfire and then out for a steak dinner. Under $300 total and I would not change anything about that day.

My friend was one of our witnesses for the ceremony and she took photos. Her iPhone takes little 2-3 second videos along with stills. That's the only video I have of Jesse.

Female fertility starts going down after...25? And has dropped dramatically by 35.

This would mean the college/4 year party route would have to end...but historically this isn't normal anyway.

Since women like to marry "up" marrying a 25 year old when you are 20 who has a career, if not much time in one yet, probably satisfies that itch too.

And yes all this is closer to what was traditional in the west. But...we've forgotten all the things that have worked in the past to try new stupid things. I mean seriously, imagine explaining to your average person in say the year 1300 that in our time most women wait to have their first child into their 30s...and no...not because they've been starving or running from Mongols before then.

Late this evening, we hoed out my youngest corn and the green beans.

I got to thinking about what it was like in the old days, pre-mechanization, pre-chemical, etc, when that is what you had to do all the live long day. Get out in the hot sun and hoe.

The FBI collected over 12 THOUSAND HOURS of video from J6, mostly cell phone video, but also a lot of TV camera video. So there are dozens, if not hundreds of the same activity from different angles.
With video production capabilities these days, it would only take a week or two to merge all this video into a 3-D production. Lots of closeups and far away shots. Everything, or at least 99.5% of everything that happened would be seen. Everyone would know exactly what happened. So why didn't this happen?
Because the way the laws work, Congress controls that FBI collection, and Nanzi Pelosi refuses to release any of it. Think of it, we would have everything answered with our own eyes instead of some panel of Democrats describing what Republican supporters did on that day.
Our leaders in power are crooked beyond belief. They are propagandists worse than any 20th century press corps was. F*ck them.

If she had been driving a Tesla she wouldn't have had a story to write. I've driven long distance with my Model S and the Tesla Supercharger network really does just work.

She also might not have had a story if someone had told her about a web site called "A Better Route Planner" (ABRP). She said she spent 18 hours trying to charge the Kia EV6 car; ABRP planned a route that included only 3 hours and 20 minutes of charging.

ABRP was routing to "Electrify America" stations, which probably would have been better than the ones she picked using PlugShare.com. Electrify America is nowhere near as good as the Tesla Supercharger network but from what I hear it's better than the miserable experiences she had with random chargers.

I don't want to be unkind to her, but my guess is she might not be the best with technology. She wasn't even able to figure out what exact model of car she had rented.

I haven't paid much attention to the specs and shit with the loathsome EVs, but I was just looking. Tesla battery is 450VDC. Has to be that high, of course to keep current reasonable. Also, dangerous fry you good DC voltage to have around.

Anyway, charging at 100A would be 45kW, of course (and that's ignoring heat losses, so I have no idea how much higher it would be for 45 kW to be stored in the battery).

So for a 50 kW charge rate, you're gonna be pumping 100A through the damn battery. For 300 kw, 6x that, or 600A through that damn battery?

That's a lot of current. And those batteries are fire-catchy any way. Yep, I would be backing away from one of those damned batteries being charged at that much current.

55 gal drum or larger, best if it is plastic. Put it up at least 4" but two cinderblocks should put it high enough to get a good siphon
You need to rerout your downspout, you can pull the elbow off the gutter and turn it 180 degrees.
You will probably have to cut your downspout to match it to your barrel, and you will need some sort of funnel to get all the water in. Say a cut off soda or plastic juice bottle, if you are not picky
You can piece together some connectors with PVC if you or your spouse are picky
to get the water out you can get one of those hand pumps or siphons for drums from ULINE. Or you can use a hose like siphoning gas.
You can put in a bulkhead fitting and a faucet instead, depending. Anyway you need some height to get a good pressure and the ability to put a pail under it to carry water that way
If you want to go real cheap just take the head off the barrel and run the downspout into it, and then dip water out of it with a bucket.

Finding some more specs. Looked up an individual module for one of those Tesla battery packs. They call it a module, which consists of several actual cells. These modules are then put together in some series and parallel configuration to give you the whole battery pack.

Module voltage is 23V roughly nominal. Continuous charge and discharge current is 225A. Intermittent output is 1500A for 3s, and 1000A for 10s.

Yep, you gonna fast charge one of those battery assemblies, you're talking some heavy current indeed.

I've been driving a Tesla for a while and I'm just not that worried about it. You plug in the cord, the pretty lights flash, the car charges. On a hot day you hear the air conditioner come on... it makes sure that the battery pack doesn't overheat. (As opposed to the Nissan Leaf, which uses passive air cooling and hope. There's a reason a Tesla costs more than a Leaf.)

What will be amazing is when the Tesla Semi comes out. Those have a special connector with four pairs of charging pins... and it's believed those are at double the voltage of Tesla cars. So it will be at least eight times as much current at once.

It still sounds better to me than pumping hundreds of gallons of diesel. A diesel with a 300 gallon tank is hauling a literal ton of fuel.

Tesla just plain tells you how much current their Superchargers can deliver. Old ones are 125 or 150 kW; for some reason some are 72 kW; and the new ones are 250 kW with rumors that 350 kW is coming.

But it's regulated somehow and you only get the full power if your car's battery is low enough. The closer to a full charge, the slower it charges. So if you take a new Model 3 down to 5% charge and take it to a 250 kW station, for five minutes or so you will get the full 250 kW and then it will taper down.

That's why planning software has you running your battery down low before stopping, and only charging a short time (15 minutes or 20 minutes). That's how you minimize overall charging time. I tend to overlap charging with meals and let it charge longer than the plan... it might be faster the other way but it's more convenient my way.

It sure is. At the outset, anyway. As the fuel is consumed, the weight of the remaining fuel diminishes. A semi truck can haul 40 tons, maybe more. So having one ton of fuel means the fuel is only 2.5% of the payload. How much does the battery in a Tesla weigh? And its weight does not diminish by so much as a milligram as the charge is exhausted.

2 hours at 50 kW to charge one completely from discharge. But, at fast-charging rates, efficiency drops to about 50%. Half is going into the battery, the other half is heat.

That's those blower motors the above enthusiast was talking about to get that heat the fuck out of there before yo' battry catches fire and blows up yo' ass.

When you figure in that 50% loss, shit fire. Yep, you're gonna need some serious power capacity to "fast charge" one of those things. And you're gonna waste a shit ton as heat.

I drove to Calgary today. Hopped in the '99 Suburban, looked at the fuel gauge; it was a tick over half tank. Drove 90 miles there, and 90 miles back, and it's a tick under a half tank. Suburbans have yuuge tanks; it will cost me over $200 at current prices to fill it. But "range anxiety" is simply not an issue. And the car is 100% paid for.

This is why, that if we, as a society, were really serious about going to an all-electric vehicle fleet, we would mandate swappable batteries as a matter of course. Your battery runs low, you wheel into a service station (why should we not call them that, eh?), and a robot drops out your depleted battery, notes the charge remaining, and swaps in a fully-charged one. Five minutes, tops, and you are back on the road. You pay only the net charge difference, plus maybe a fixed service fee.

Oh, a lithium ion battery pack is WAY heavier than the amount of gas or diesel with an equivalent amount of energy. The only reason EVs work so well is that an EV is five or six times more efficient than a similar ICE vehicle.

According to Wikipedia my car's battery pack weighs 1378 pounds, and it stores the equivalent energy of about 3 gallons of gas.

It's why I'm not expecting electric motor airplanes to be practical anytime soon.

But the big companies like Pepsi are drooling at the thought of the Tesla Semi because it will be so much less expensive to operate. It will cost a lot more up front but the payback period is less than two years. With a Democrat President, maybe less than one year. I think those companies will have to upgrade their electrical infrastructure and install their own Megachargers to make it work, but they're still going to do it.

The Tesla Semi is said to charge in under an hour. My car has a 100 kWh battery pack; the Semi is expected to have a battery pack of at least 500 kWh. But the Megacharger can deliver power 6 times faster than the best Superchargers.

That 500 kWh pack must be organized into four smaller packs that charge side by side, because the Megacharger connector has four pairs of charging pins.

I think you are right that the people who own these trucks are going to buy their own chargers; they aren't going to wait for anyone to pre-build a network of chargers for them.

I suspect that they will charge the trucks at the same time they load or unload them, to save time. But that might not be practical... I don't know that much about high voltage.

Flashlight manufacturers have used swappable batteries for over a hundred years. The humble "D" cell is over a century old. For electric vehicle batteries, there might be some advantage to going back to primary (non-rechargeble) batteries. You wouldn't need all that complex electronics in the modules to detect overheat and to control charge rate. Just use 'em up, send 'em back to the plant where their chemistry would be reversed, and new batteries built from the reclaimed materials.

Oh Lord, I don't know whether to laugh or cry. These Tesla Semis and their Megachargers.

They claim they're gonna charge one of those truck YUGE 500kW-hr batteries in 30 minutes, and with with a solar powered Megacharger.

To do that, output is going to be a MW. One megawatt. And the battery voltage is gonna be a kV, and need 1000A, a kA of current.

A megawatt solar array takes 2.5 acres, and 4 acres total for all the support equipment. So, 40 acres for 10 trucks. And all that out in the desert with a lot of sun.

Yeah, that's gonna happen.

We are living in Cloud Cuckoo Land, now. This is lunacy.

Hydrocarbons win out for the near and mid term at least. The energy density of batteries is not even close to enough. Even then electricity generation isn't even close to being developed. EVs: I first saw the "swapping battery in EVs" idea in Popular Science in the mid-70's. Three problems appear.

1. Swapping is time consuming. Using hand tools is prohibitive; that's why Tesla no longer makes it "easy" (supposedly, it was designed-in in the early models). Using a large fixture, like a car lift with additional "arms" to remove the battery and install a new one is very expensive. Then there's the problem of storing enough new/charged ones and the removed ones.

2. Getting an acceptable replacement battery is still tough. A brand new one, or even a certified remanufactured one should be okay, but every time? Bad batteries cut range, might brick the vehicle, and might even catch fire.

3. Charging is still a problem. I heard of a situation in Tehachapee CA, where Tesla drivers had a 5-hour wait to get a 1 hour charge. 5 hours won't work for trucks. Perhaps 6 times the chargers and ground space will work.

Finally, distribution infrastructure, specifically wires. We will need at least 3 times the number high-tension electrical transmission wires strung throughout the heavily-populated areas, where people use EVs. Does 130kV really cause leukemia?

Back one time in the '90s, he asked if he could train his mule on some of our land. He did, and introduced me to "Rosie", his new mule.

If I couldn't handle pushback I wouldn't be here talking about EVs. Every single time I mention EVs, people just start insulting me. I thought, maybe I'll be lucky and there will be one or two people who might like to get the perspective of someone who actually owns an EV. But I'm not actually a masochist and I do get tired of the abuse.

I try to be polite and just cite facts, but I draw the line at being accused of being one who loves Green Democrats.

For the record, I personally favor the Trump doctrine of making the USA a net energy exporter... and right now that means drilling for oil.

I'm getting rooftop solar for my house. That, combined with an EV, will be a good thing if times get tough. According to the estimates I will be nearly self-sufficient many months out of the year.

If we lose civilization completely I'll have to flee the state and head somewhere civilized, like Montana.

She rented a Kia EV6, she didn't buy a Honda Civic. She could have rented a Tesla Model 3 from Hertz, instead of buying a Tesla Model S Plaid (the one that costs $130,000). I was commenting on how good the Tesla Supercharger network is, not shaming some random journalist for not being able to afford a luxury sedan.

At current gas prices, my car is saving me at least $2000 per year on gas alone. Throw in the cost savings of no oil changes and in a dozen years it will have saved me the cost of a Honda Civic. This is why I keep saying that once the cost of an EV falls to the same level as the cost of a gas car, the average consumer will want to buy an EV, and gas car sales will fall off a cliff.

It's flattering that you think I can afford a $130,000 car, but I bought my Model S used when Trump was President and before the insane run-up in used EV prices. Even then it was the most expensive car I've ever bought, but I'm not going to apologize for buying the car I wanted and you can go soak your head. In gasoline.
