I'm not reassured, I would not be surprised if there is some kind of deal about Dem Senate leadership will bail on the BBB if they can get support for the Permanent Voting Fraud bill. The way the Dems think, gaining permanent power now by legalizing mail in voting fraud means they can pass as many BBB gazillion trillion bills after they achieve one party rule. Dems took the hit in 2010 to get their Obamacare rule, betting it would never be overturned. Who was right on that bet?

What Sinema may be worrying is that the election bill will definitely be held up by court challenges and may not go into effect until after the 2022 elections at the earliest. Thus, if the Republicans win in 2022 both branches, the minority in the Senate will be neutered by violating the sacrosanct filibuster which would neuter her as well.

There's no question the filibuster is gone, just a question of who gets to benefit "first" getting rid of it. We Know McConnell won't have the balls to get rid of it first. ++++ I think that's largely true, but it is still a gamble. Not all positions are known, but importantly the future is unknown. That sounds stupidly simple, but it's something a lot of people forget. Right now, there is zero risk to nuking the filibuster, either as a one-off or in general. The Republicans are useless criminals and the Democrats are effective criminals and there are too few who aren't to swing things beyond scoring political points. But what does tomorrow bring? I don't think there's anything about filibusters in the Constitution. It was simply a gentleman's agreement between the two sides. That doesn't work very well when neither side contains gentlemen.

Under House rules, especially now, the leadership says jump and the rank and file have to say how high. In the Senate, the maj and minority leaders are schedulers and fundraisers for their party. The Senate could grind to a halt with most of their legislation requiring steps for unanimous consent--thus one senator objecting could bring the whole thing to a stop. Right now, Wyden is holding up Uighur sanctions on the Chinese and Biden appointees. If House rules are adopted, he doesn't have that power to hold either up. That is why true believers get little accomplished in the Senate--the rules themselves are designed for consensus on legislation passage but giving enormous power to individual senators to block things. The problem with this line of argument is that the founders expected the people would overthrow any authoritarian government that came to power in the US. Filibuster isn't "unconstitutional" since nothing in the constitution says "Senate can't have internal rules that require supermajority voting on some issues." In fact, the constitution specifically says "Each [chamber] may determine the Rules of its Proceedings."
You can say it's contrary to Founders' intention or whatever, but yeah most things in the modern state are. So no particular reason to get bent out of shape about Senate filibuster on that basis since it would probably be about 1 millionth on the list of things about present day US government the Founders wouldn't like. I wouldn't care if they were successful 100% of the time on everything they did. That's. Their. Job. They're not getting any *more* of my money than they already take from me in taxes to pay their salaries. No politician should ever be asking me for my money for anything. If they're successful, good, that's their job. If they're unsuccessful, what makes them think I'm going reward their failure with a donation? They already have my money in the form of their salaries that are paid for with taxpayer dollars. Fifth Circuit has ruled back the national injunction against the healthcare mandate. It only applies to 24 states now. Is that enough? Because it certainly ruined my day. === The Fifth Circuit noted that the government is likely to prevail on limiting the scope of the nationwide injunction, and as such, the appellate court stayed the injunction with respect to jurisdictions outside of the 14 states included in the lawsuit. In other words, although the CMS Rule is still halted in the 14 states that brought the lawsuit in Louisiana, and in the other 10 states that are part of the Missouri lawsuit, for everywhere else, the injunction is lifted. As Ace pointed out when Obamacare didn't get repealed, the filibuster is a tool for the party in power, because it allows them to refrain from making politically self destructive moves and to placate the base at the same time.
